HomeMy WebLinkAboutOrdinance No. 137 ORDINANCE N0. 137 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, AMENDING ORDINANCE N0. 132; GRANTING A SPECIFIC USE PERMIT TO THE HERITAGE GARDENERS; ACCEPTING AND ADOPTING THE FINDINGS OF THE PLANNING AND ZONING COMMISSION. Be it ordained by the City Council of the City of Friends- wood, Texas, that: WHEREAS, The question of granting a Specific Use Permit in this ordinance was referred to the Planning and Zoning Commission to hold a public hearing thereon; and WHEREAS, Such a public hearing was held, after due public notice, in the manner provided by Ordinance No. 132 of the City of Friendswood and by the statutes of the State of Texas; and WHEREAS, The Planning and Zoning Commission has made a report, containing findings of fact and recommending the granting of such Specific Use Permit: NOW, THEREFORE, Be it ordained by the City Council of the City of Friendswood, Texas: A Specific Use, according to the authorizations and limitations set forth in Section 9 of Ordinance No. 132 (the Friendswood Zoning Or- dinance) is hereby granted to the Heritage Gardeners to construct a two- story wooden frame replica called the Frank Brown Heritage Garden Center, to be used as a historical museum, according to the plans and specifica- tions heretofore submitted,on the premises described as: Part of Lot 2, Block 4, Tract 15, Friendswood Subdivision such property presently existing in an R-2 district and such Specific Use is subject to the following conditions: Such Specific Use Permit shall not allow a violation or variation from other ordinances of the City of Friends- wood pertaining to building permits, construction requirements, or other provisions set forth in Ordinance No. 132 (the Friendswood Zoning Ordinance) . The findings and recommendations of the Planning and Zoning Commission on the question of granting a Specific Use Permit to the Heritage Gardeners, which included the following exceptions: At Heritage Gardens, provide twenty (20) off-street parking spaces, on this or adjacent property; At Heritage Gardens, all fencing must adhere to ordinance requirements. (Front yard fence not to exceed 30" height. ) (The F.P.Z.C. also suggests the architect be consulted concern- ing closing in the foundation. ) are hereby accepted and adopted and made a part of this ordinance. PASSED AND APPROVED on first reading this the 3rd day of August, 1970. PASSED AND APPROVED this the 17th day of Au�ust , 1970.
