AN ORDINANCE REGULATING THE BURNING OF BONFIRES AND OUTDOOR
RUBBISH FIRES; REQUIRING ISSUANCE OF PERMITS FOR CERTAIN
TYPES OF BURNING; PROHIBITING BURNING OF MATERIALS THAT SMOKE
EXCESSIVELY OR SMOLDER OR GIVE OFF NOXIOUS ODORS; AUTHORIZING
FIRE MARSHAL TO PROHIBIT BONFIRES AND OUTDOOR RUBBISH FIRES
UNDER CERTAIN CONDITIONS; PROVIDING A PENALTY.
WHEREAS, the City Council of the City of Friendswood is aware that
the growing population of the City requires regulation of burning of trash
and other combustible materials and
WHEREAS, the urbanization of Friendswood has increased the potential
danger of fire resulting from uncontrolled burning of rubbish and trash;
now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS, DULY ASSEMBLED:
Section 1 : Permit Required
No person nor corporation shall kindle or maintain any bonfire, rubbish
fire or any fire to burn trash, weeds, leaves, grass, brush, lumber or other
combustible material or authorize any such fire to be kindled or maintained
on or in any public street, alley, road or other public ground without a
permit from the Fire Marshal . During construction or demolition of buildings
or structures no waste materials or rubbish shall be disposed of by burning
on the premises or in the immediate vicinity without having obtained a permit
from the Friendswood Fire Marshal or his duly authorized agent.
Section 2: Burning Restrictions
A. No person shall kindle or maintain any open fire or authorize any
such fire to be kindled or maintained on any private land without first having
obtained a permit from the Fire Marshal or his duly authorized agent.
B. No fire shall be kindled or maintained in any outdoor container
unless such container has been approved by aforesaid Fire Marshal or his duly
authorized agent.
C. The burning of garbage, refuse or any material that smokes excessively
or smolders or gives off noxious odors is prohibited.
Section 3: Fire Marshal May Prohibit Burning
The Fire Marshal of the City of Friendswood may prohibit any and all
bonfires and any other intentional fires when wind or atmospheric conditions
or other circumstances make such fires hazardous.
Section 4: Supervision of Permitted Fires
No person shall maintain or cause to be maintained any permitted
fire under this ordinance without adequate safeguards to extinguish or control
such fire whether such safeguards be mechanical devices, incinerators or
human supervision.
Section 5: Exceptions
The provisions of this ordinance do not apply to fireplaces in homes,
nor to barbecue pits, permanent or portable, when used for cooking purposes
and not as burning receptacles for trash, grass, lumber, leaves or like
materials.
Section 6: Penalty for Violation
Any person, firm or corporation violating this ordinance shall be
fined not less than Ten ($10.00) nor more than Two Hundred ($200.00) Dollars
for each offense.
Section 7: Savings Clause
If any portion, paragraph or part of this ordinance shall be held to
be illegal or unconstitutional , then such holding shall in nowise affect the
remaining portion of such ordinance and the same shall remain in full force
and effect as if such portion so held to be unconstitutional had remained
unchallenged.
