HomeMy WebLinkAboutOrdinance No. 128 . . , , ' . . ` a ! / A � 'J� ! . � /� �� ��—� _1--. �;L�� � ..U�� La=C/�� . . � t ORDINANCE N0. 128 AN ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES WITHIN THE CITY OF FRIENDSWOOD; DES- IGNATING CERTAIN AREAS AS ''NO PARKING" PLACES; REGULATING CURB PARKING; PROHIBITING PARKING OF VEHICLES FOR SALE; REGULATING LOADING ZONE PARKING; REGULATING PARKING IN ALLEYS, OVER- NIGHT PARKING ON STREETS, AT BUS STOPS OR AT SIGNS ERECTED FOR CONTROL OF PARKING; PROHIBI- TING PARKING ON PRIVATE PROPERTY; PROVIDING FOR TOWING AWAY OF VEHICLES AND RECOVERY OF SAME; PROVIDING A PENALTY; PROVIDING A SEVERA- BILITY CLAUSE AND REPEALING ALL PORTIONS OF ORDINANCES IN CONFLICT NEREWITH. WHEREAS, a need exists in the City of Friendswood, Texas to regulate parking of motor vehicles within the City and WHEREAS, the Chief of Police of the City of Friendswood has, as the result of traffic studies, made the City Ceuncil aware of such need, therefore BE IT ORDAINED by the City Council of the City of Friendswood, Texas duly assembled, SECTION I Definitions Whenever in this ordinance the following terms are used, they shall have the meanings respective7y ascribed to them in this section. Alley: A pu�lic way within a block, generally giving access to the rear of lots or �uildings and not used for general traffic circulation. Crosswalk: That portion of the roadway included within the prolongation of the sidewalk lines at street intersections. Emergency Vehicle: Police vehic7e, vehicles of the Fire Department, ambu- lances, vehicles carring a State, County, Municipal or Federal Officer or employee in response to an emergency call , and emergency vehicles of public service corporations on emergency czll . Motor Vehicle: Every vehicle which is self propelled by any type of engine or power supply, but not operated on rails. Park: To stand a vehicle whether occupied or not, for a period of time greater than is reasonably necessary for the actual loading or unloading of persons or cargQ. Public Building: A building used by the municipality, the county, any park district, school district, the State of Texas or the United Stated Gov- ernment. Safety Zone: That portion of a roadway reserved for the exclusive use of pedestrians exclusive7y marked or elevated. School bus: Every motor vehicle operated by or for a public, or governmental agency or by or for a private or religious orqanization solely for the transportation of pupils in connection with school activities. Sidewalk: That portion of a street between the curb 7ine or roadway and the adjacent property line designated for pedestrian use. Street or Highway: The entire width between property lines or every way or place of whatever nature when any part thereof is open to the use of the pu�lic, as a matter of right, for the purpose of vehicular traffic. Traffic: Pedestrians, ridden or herded animals, vehicles and other convey- ances whether singly or together while using any highway for the purpose of travel . Vehicle: Every device in, upon or �y which any person or property is or may be transported or drawn upon a highway except devices moving by human po�er or used exclusively upon stationary rails or tracks. SECTION II No Parking Places At any time it shall be unlawful to permit any vehicle to stand in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the directions or a policeman or traffic control device: 1 . In any intersection 2. In a crosswalk 3. Upon any bridge 4. Between a safety zone and the adjacent curb or within thirty (30) feet of a point of the curb immediately opposite the end of a safety zone. 5. Within thirty (30) feet of a traffic signal , beacon or sign an the approaching side. 6. Within twenty (20) feet of any intersection or crosswalk 7. At any place where the standing of a vehicle will reduce the usable width of the roadway for moving traffic to less than eighteen (18) feet 8. Within fifteen (15) feet of a fire hydrant. 9. At any place where the vehicle would block the use of a driveway 10. Within fifty (50) feet of the nearest rail of a railroad grade crossing 11 . Within twenty (20) feet of the driveway entrance to any fire department station and on the side of the street opposite the entrance to any such station within seventy- five (75) feet of such entrance when properly sign posted 12. On any sidewalk or parkway 13. At any place where official signs prohibit or limit or regulate the hours of parking 14. At any time within 100 feet of any intersection on the paved shoulder of that part of FM 518 between the inter- section of FM 528 and Choate Road (FM 2351), lying within the City limits of Friendswood. SECTION III Parking at Curb No vehicle shall be parked with the left side of such vehicle next to the curb except on one-way streets, and it shall be unlawful to stand or park any vehicle in a street other than parallel with the curb and with the two right wheels of the vehicle within twelve (12) inches of the regularly established curb line, except that upon those streets which have been marked for angle parking, vehicles shall be parked at the angle to the curb indicated by such marks. SECTION IV Vehicles for Sale It shall be unlawful to park any vehicle upon any street for the purpose of disp7aying it for sale, or to park any vehicle upon any street from which vehicle merchandise is peddled or offered for sale. SECTION V Loading Zone It shall be unlawful for the driver of a vehicle to stand a passanger vehicle for a period of time longer than is necessary for the loading or unloading of passengers, not to exceed three (3) minutes, and for the driver to stand any freight carrying vehicles,for a period of time longer than is necessary to load, unload and deliver materials, not to exceed thirty (30) . , � � � , _. - �., . . , ' ' minutes, in any place designated by the Chief of Police of the City of Friendswood as a loading zone and marked as such. SECTION VI All Night Parking � No person shall park any vehicle on any street for a period of time � ,���� longer than thirty (30) Minutes between the hours of 12:00 midnight and ���,�� 5:00 a.m. of any day, except physicians on emergency calls. SECTION VII A71eys No person shall park a vehicle within an alley in such a manner or in such a position as to leave available less than ten (10) feet of width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle within an alley in such a position as to block the driveway or entrance to any abutting property. SECTION VIII Bus Stands No vehicle other than a bus shall be parked in the place so desig- nated as a bus loading zone. SECTION IX Time Cimit Parking Except on Sundays or holidays, it shall be unlawful to park any vehicle for a longer consecutive period of time than that designated be- tween the hours of 8:00 a.m. and 6:00 p.m. in any area designated as a limited parking area and so marked. SECTION X Parking Motor Vehicles on Private Property It shall be unlawful to park any motor vehicle on any private prop- erty without the consent of the owner of the property. SECTION XI Signs The Chief of Police or any other person authorized by the City , � ' � . . ., . ' . � - . � . . . . � Council sha71 cause signs to be posted in all areas where parking is limited or prohibited indicating such limitations or prohibitions. SECTION XII Towing Vehicles Away The police department, and all members thereof assigned to traffic duty, are hereby authorized to remove and tow away, or have removed and towed away by commercial towing service, any car or other vehicle illegally parked in any place where such parked vehicle creates or constitutes a traffic hazard, blocks the use of a fire hydrant, or obstructs or may ob- struct the movement of any emergency vehicle. Any car parked continously for a period of more than 72 consecutive hours on any city street or state right of way within the city limits of the City of Friendswood may also be removed and towed away as provided above. Any car or other vehicle parked in any area designated by the Chief of Police of the City of Friendswood as a tow away zone may also be removed and towed away as provided above. Cars so towed away for illegal parking shall be stored in a safe place and shall be restored to the owner or operator of such car upon pay- ment of a fee of Ten ($1Q.00) Dollars within twenty-four (24) hours after the time such car was removed plus Five ($5.00) Dollars for each additional 24 hours or fraction thereof, plus any costs incurred by the City of Friends- wood to a commercial towing service for the purpose of removing the vehicle from its illegally parked position to storage. SECTION XIII Penalties Any person, either by himself or agent, and any firm, corporation or other entity who violates any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction of any such violation, shall be fined in any sum not to exceed One Hundred ($100.00) Dollars; and each day during which such violation continues shall constitute a seperate and distinct offense. Any offense defined herein which has been defined by laws of the State of Texas as an offense and for which penalty has been prescribed shall be punished as provided in said State Law and nothing herein shall be held as fixing any penalty contrary to any penalty provided rV • , � by the laws of the State of Texas. In any case of a violation of any of the terms of provisions of this ordinance by any corporation, the officers and agents actively in charge of the business of such corporation shall be subject to the penalty herein provided. SECTION XIV Form of Complaints In any prosecution hereunder, it shall not be necessary for the complaint to negative any exeeptions contained in this ordinance concern- ing any prohibited act, but any such exception may be urged as a defense by any person charged by such complaint. SECTION XU Severability If any provision of this ordinance or the application thereof to any person or circumstances, is held invalid, the remainder of the ordinance, and the application of such provision to other persons or circumstances shall not be effected thereby and shall remain in full force and effect. SECTION XVI Repealing All ordinances or parts of ordinances in conflict herewith are here- by repealed. PASSED AND APPROVED ON FIRST READING this 20th day of October, 1969.
