HomeMy WebLinkAboutOrdinance No. 117 ORDINANCE NO. ��� AN ORDINACE OF THE CITY OF FRIENDSWOOD, TEXAS DECLARING THAT GALVESTON COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. 21 HAS BEEN COMPLETELY ANNEXED; PRO- VIDING THAT THE CITY SHALL TAKE OVER ALL PROPERTIES AND ASSET5 OF THE DISTRICT; PROVIDING THAT THE CITY SHALL BE LIABLE FOR ALL DEBTS AND OBLIGATIONS OF THE DIS- TRICT AND CONTAINING OTHER MATTERS RE- LATING TO THE 5UBJECT. WHEREAS, by Ordinance No. 102 the City of Friendswood, Texas on the 16 th day of OCtOber , 196? annexed a tract of acres of land on the northwest side of the then current limits of the City of Friends- wood, Texas, and WHEREAS, after final adoption of Ordinance No. 102 the City had annexed all of the territory which was legally within the boundaries of Galveston County Water Control and Improvement District No. 21 of Galves- ton County, Texas, and WHEREAS, Section 2 of Article 1182 C-1 Texas Revised Civil Statutes Annotated provides that when an incorporated city annexes all of the terri- tory within a water control and improvement district such city shall take over all properties and assets, shall assume all debts, liabilities and obli- gations and shall perform all functions and services of such district, and after such annexation such district shall be abolished; and, WHEREAS, Galveston County Water Control and Improvement Dis- trict No. 21 has heretofore issued its bonds in the principal sum of Six Hun- dred Thousand ($600, 000. 00) Dollars, such bonds being designated Galves- ton County Water Control and Improvement District No. 21 Water Works and 5anitary Sewer System Combination Tax and Revenue, Bond Series 1964, dated November 1, 1964, all of which presently remains outstanding and un- paid; and, WHEREAS, since the city has now annexed all of the territory which was legally within the Galveston County Water Control and Improvement District No. 21, the City of Friendswood, Texas is now legally obligated to pay all principal and interest requirements on said $600, 000. 00 bonds and is obligated to abide by all the terms and conditions of the order of the Board of Directors of Galveston County Water Control and Improve- ment District No. 21 dated October 15, 1964 authorizing the issuance of said bonds; and WHEREAS, by operation of law, on the 14thday of Januarv, 1968� said date being 90 days after the effective date of Ordinance No. �02 (which annexed all of Galveston County Water Control and Improvement District No. 21 to the city) the city became obligated to take over all pro- perties and assets of the district and assume all debts and liabilities and obligations of the district and on such date Galveston County Water Con- trol and Improvement District No. 21 was abolished and, WHEREAS, the City Council now desires to pass an Ordinance clearly reflecting its obligations with respect to Galveston County Water Control and Improvement District No. 21; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS. Section 1. That the City of Friendswood shall take over all proper- ties and assets of Galveston County Water Control and Improvement Dis - trict No. 21 and shall assume all debts, liabilities and obligations of said Galveston County Water Control and Improvement District No. 21 and shall perform all functions and services of such district. Section 2. The water works and sanitary sewer system of Galves- ton County Water Control and Improvement District No. 21 shall be operated as a separate system from the city's present system and all revenues col- lected from the operation of said water works and sanitary sewer system shall be used only as provided in said October 15, 1964 order of the Board of Directors authorizing issuance of said $600, 000. 00 bonds. Section 3. Mayor and City Secretary and other appropriate officials of the City of Friendswood are hereby authorized and directed to do any and � . ---� � .> - , . . . . � +. � all further acts necessary to carry out the terms of this ordinance and assure the owners of said $600, 000. 00 bonds that their rights shall not be impaired. Section 4. This ordinance shall take effect immediately upon its final passage and approval. PASSED AND APPROVED this 21 day of October , 1968 on first reading.
