AN ORDINANCE PRESCRIBING RATES TO BE CHARGE
FOR DISTRIBUTION AND SALE OF NATURAL GAS WITH-
IN THE CITY, AND REPEALING ALL OTHER ORDINANCES
OR PART5 OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
SECTION 1. The following rates and charges are hereby fixed
as the maximum monthly rates and charges to be applied and used by
Houston Natural Gas Corporation (the "Cornpany"), its successors or assigns,
for the distribution and sale of natural gas in the City of Friendswood,
effective on and after the first billing date after April 15, 1968.
Residential and Commercial Rate
First 400 Cubic Feet or less $2. 00
Next 2, 600 Cubic Feet @ 10. 2�` per Ccf
Next 7, 000 Cubic Feet @ 8. 7� per Ccf
Next 40, 000 Cubic Feet @ 7. 6� per Ccf
Next 50, 000 Cubic Feet @ 7. 1� per Ccf
All over 100, 000 Cubic Feet @ 6. 1�` per Ccf
Minimum Monthly Bill $2. 00.
The above base rates are net rates and will apply to all bills paid
within ten (10) days of date of rendition. If bills are not paid within ten (10)
days of date of rendition, gross rates shall apply, which rates shall be the
above net rates plus one cent (1�) per Ccf of gas consumed per month. Ccf
as used herein means one hundred (100) cubic feet of natural gas.
The Railroad Commission of Texas, after notice and hearing of
its Docket No. 246, by its order dated December 1, 1958, established and
fixed the rate to be paid at the City Gate for gas purchased for resale to the
customers affected by this ordinance. If such City Gate Rate is hereafter
decreased or increased by subsequent order of the Railroad Commission
(and from time to time as such orders may issue) the rate herein fixed for
Residential and Commercial use shall forthwith be likewise adjusted by
changing the price per Ccf of each step of the above two schedules in an
amount equivalent to the change in the City Gate Rate, minus or plus, as
may be appropriate.
The rates in effect hereunder shall also be adjusted by the Company
(1) so as to accomplish a decrease or increase of such rates equivalent to
the change in the amount of taxes payable solely by reason of any change in
rates pursuant to the provisions of the preceding paragraph; and (2) upon the
imposition of any new or increased rate of taxes determined or measured by
the volume, proceeds, or receipts of gas delivered to its customers, to the
extent necessary to pass the effect thereof on to such customers. The word
"taxes" as used herein refers only to (1) gross receipts taxes payable to the
State of Texas and (2) gross receipts taxes or charges payable to the City of
Friendswood, Texas.
Whenever an increase or decrease in the foregoing rates becomes
appropriate under the foregoing adjustment provisions, the Company shall
promptly file with the City Secretary a sworn statement setting forth the
changes in the City Gate Rate and/or taxes and the resulting tentative adjust-
rnent shall become effective for bills rendered on or after the first day of the
third billing month following the month in which such statement is filed unless,
within thirty days after the filing of such statement, the City Council shall
have disapproved such tentative adjustment by motion or resolution. If any
such tentative adjustment in rates is disapproved by the City Council, the
foregoing rates shall continue to be adjusted by the total increment established
by the last previous adjustment not so disapproved, until another adjustment
shall have taken effect hereunder. Within the thirty day period provided for
its approval or disapproval of any such tentative adjustment, the City Council
may order the filing of any additional inforrnation or statements, deemed to
be necessary in the public interest, or may order a public hearing with regard
to such approval or disapproval.
SECTION 2. The Company shall establish and post in its office
rate schedules providing monthly billing rates complying with Section 1 of this

ordinance and may, in addition, establish special contract rate schedules
for large volume commercial or industrial use providing other rates and
charges.
SECTION 3. All ordinances, resolutions, franchises, or parts
thereof in conflict herewith are hereby repealed insofar but only insofar as
such conflict exists.
SECTION 4. This ordinance shall become effective on the first
billing date after April 15, 1968.
