HomeMy WebLinkAboutOrdinance No. 2017-36 (Title: An ordinance repealing Ordinance No.2007-20 that adopted the revised FEMA flood insurance study dated June 18,2007,which established the areas of special flood hazard for that portion of the City within Harris County and amending Sec. 34-24 to reflect those changes.) _ ORDINANCE NO. 2017-36 AN ORDINANCE REPEALING ORDINANCE NO. 2007-20, THAT ADOPTED THE FLOOD INSURANCE STUDY FOR HARRIS COUNTY, TEXAS, AND INCORPORATED AREAS, DATED JUNE 18, 2007; AMENDING CHAPTER 34, ARTICLE 11, DIVISION I, SECTION 34-24, BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD; PROVIDING FOR A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION HEREOF; AND PROVIDING FOR SEVERABILITY. �: K � x x • x x x x WHEREAS, the City of Friendswood had adopted the latest flood hazard mapping for Harris County by the Federal Emergency Management Agency (`FEMA") in 2007, based in part on the analysis of data collected during Tropical Storm Allison; and, WHEREAS, the adoption of the latest flood hazard mapping was one of the recommendations during a FEMA Community Assessment Visit to the City; and WHEREAS, the City has recently been advised by FEMA that despite the 2007 action taken, the official FIRMette illustrates the effective maps for Friendswood is still based on the 1999 FIRMS; and WHEREAS, the City of Friendswood recommends repealing Ordinance 2007-20 and by default readopting the 1999 FIRMS for consistency in determining flood zone designations, regardless of the County; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. That Ordinance No. 2007-20 is repealed in its entirety. Section 2. That Section 34-24 of the Code of Ordinances of the City of Friendswood, Texas, is amended to read as follows: Section 34-24. Basis for establishing the areas of special flood hazard. The areas of special flood hazard identified by the Federal Emergency Management Agency in a scientific and engineering report entitled, "The Flood Insurance Study for Friendswood, Texas, Galveston and Harris Counties," dated September 22, 1999, with accompanying Flood Insurance Rate Map and Flood Boundary-Floodway Maps (FIRM and FBFM), and any revisions thereto are hereby adopted by reference and declared to be a part of this Ordinance. Section 3. Any person who shall knowingly, willingly, or with criminal negligence violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $2,000.00. Each day of violation shall constitute a separate offense. Section 4. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts.
