HomeMy WebLinkAboutOrdinance No. 64 ORDINANCE NO. 64 AN ORDINANCE PROVIDING A CURFEW FOR ALL CHILDREN TWENTY-ONE YEARS OF AGE AND YOUNGER; PROVIDING A PENALTY OF A MAXIMUM FINE OF ONE-HUNDRED ($100.00) DOLLARS AND A MINIMUM FINE OF TEN ($10.00) DOLLARS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: SECTION ONE: It shall be unlawful for any child under the age of twenty- one years to be and remain upon any streets or other public places in the City of Friendswood between the hours of one. o ' clock a.m, and five o' clock a.m, and for any child under the age of eighteen years to be and remain upon any streets or other public places in the City of Friends- wood between the hours of twelve o' clock midnight and five o ' clock a.m. and for any child under the age of fifteen years to be and remain upon any of the streets or other public places in the city between the hours of ten o' clock p.m. and five o' clock a.m, unless said child shall be accompanied by its parent or guardian or some other adult person or there exists a reasonable need or necessity therefor. SECTION TWO: It shall be unlawful for any parent, guardian or other person having legal care and custody of such child, to allow or permit any such child, ward or other person under such age, while in his legal custody, to go or be upon any of the streets or other public places in the City of Friendswood within the time and as prohibited in this section unless such child shall be accompanied by its parent or guardian or some other adult person;. or there exists a reasonable necessity therefor SECTION THREE: Any person violating the provisions of this Ordinance shall be subject to a maximim fine of ONE-HUNDRED ($100.00) DOLLARS and a minimum fine of TEN($10.>00) DOLLARS. SECTION FOUR: If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconsti- tutional by any court of competent jurisdiction, such section, subsection, sentence, clause, phrase or portion shall be deemed separate, distinct and an independent provision and such holding shall not effect the validity of the remaining portion hereof.
