ORDINANCE NO. 2005-15 AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER 1984, AND BEING THE ZONING ORDINANCE OF THE CITY,BY GRANTING A SPECIFIC USE PERMIT FOR CONSTRUCTION AND USE OF BUILDINGS AND FACILITIES OFFICE AND TOWNHOUSE PURPOSES TO BE LOCATED ON A 9.8718 ACRE TRACT OF LAND OUT OF LOT 5 OF THE HOIDALE AND COFFMAN SUBDIVISION, GALVESTON, COUNTY, TEXAS, COMMONLY KNOWN AS 511 N. FRIENDSWOOD DRIVE WITHIN THE CITY; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. * * * * * WHEREAS, pursuant to the Permitted Use Table contained in Section 7-P of Chapter 7 of Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the comprehensive zoning ordinance of said City, construction of office and multi-family buildings in a Planned Unit Development (PUD) is only permitted pursuant to a specific use permit granted in accordance with Section 9-G of said Appendix C; and WHEREAS, TGB Development, Ltd. has applied for a specific use permit for the construction and use of buildings and/or structures on its premises located within said City, and, WHEREAS, the Planning and Zoning Commission of said City, after notice and hearing as required by law, has recommended that the City Council grant the specific use permit subject to the terms and conditions contained in the final report of said Commission; and, WHEREAS, the City Council, following notice and hearing as required by law, concurs with the recommendation of the Planning and Zoning Commission that such specific use permit should be granted; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. A specific use permit authorizing construction and use of buildings and facilities for office and townhouse uses on the 9.8718 acre tract more fully described in Exhibit "A" attached hereto and made a part hereof for all purposes, is hereby granted in accordance with the terms and conditions set forth herein. Section 3. The granting of the Specific Use Permit as set forth in Section 1 above is subject to the following additional terms and conditions: a. The maximum density of the townhouse development shall be 4.87 units per acre. Section 4. All ordinances or parts of ordinances inconsistent or in conflict herewith are, to the extent of such inconsistency or conflict, hereby repealed. Section 5. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2000. Each day of violation shall constitute a separate offense. Section 6. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City ORD.2005-15 2 Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts.
