HomeMy WebLinkAboutResolution No. 99-36 , . , • �''` ^� RESOLUTION NO. 9 9—3 6 � A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY MANAGER TO TAKE CERTAIN ACTION TO PROTECT THE INTEREST OF THE CITY OF FRIENDSWOOD, TEXAS IN CERTAIN LITIGATION; MAKING FINDINGS AND PROVIDING PARTICIPATION WHEREAS, a class action involving gas companies and entities is now pending in a lawsuit styled City of San Benito, et al., vs. PG&E Gas Transmission, Texas Corporation, f/k/a VALERO ENERGY CORP., et al., filed in the 107�' Judicial District Court of Cameron County, Texas; and WHEREAS, the City of Friendswood wishes to continue to participate in the Citv of San Benito lawsuit; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1: The City Council of the City of Friendswood hereby adopts the recitals and findings set forth in the preamble hereof. Section 2: The City Council of the City of Friendswood hereby approves remaining in the lawsuit styled Citv of San Benito, et al., vs. PG&E Gas Transmission, Texas Corporation, f/k/a VALERO ENERGY CORP., et al., filed in the 107`�' Judicial District Court of Cameron County, Texas, being represented by class counsel, and does not wish to object to the fairness of the proposed settlement. Section 3: The City Council of the City of Friendswood, having been briefed by its attorney on the current status of settlement negotiations, hereby accepts and approves the settlement agreement in concept in the above lawsuit. Such acceptances and approvals are to be complete upon final approval of the class settlement by the judge in the above cause. Section 4: The City Council of the City of Friendswood hereby authorizes and directs the Mayor and the City Manager to execute any and all necessary documents to complete the settlement of the issues in the above referenced litigation, following final approval of the class settlement by the judge. Section 5: If any section, paragraph, clause or provision of this Resolution shall be for an reason held to be invalid or unenforceable, the invalidity or unenforceablity of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this Resolution.
