ORDINANCE NO. 95-24
AN ORDINANCE ESTABLISHING A SCHOOL ZONE ALONG F.M. 528
BETWEEN ITS INTERSECTION WITH BLACKHAWK DRIVE AND A POINT
528 FEET WEST OF BAY AREA BOULEVARD; PROVIDING A MAXIMUM
PRIMA FACIE SPEED LIMIT WITHIN SUCH SCHOOL ZONE OF 35
MILES PER HOUR BETWEEN THE HOURS OF 8:30 A.M. AND 9 : 30
A.M. AND 3 : 30 P.M. AND 4 :30 P.M. ON SCHOOL DAYS;
PROVIDING A PENALTY OF NOT LESS THAN ONE DOLLAR ($1. 00)
NOR MORE THAN TWO HUNDRED DOLLARS ($200. 00) FOR FAILURE
TO OPERATE A VEHICLE WITHIN THE MAXIMUM SPEED LIMITS
ESTABLISHED HEREBY; AND PROVIDING FOR SEVERABILITY.

WHEREAS, Article 6701D, Texas Revised Civil Statutes, provides
that whenever the governing body of a city shall determine, upon
the basis of an engineering and traffic investigation, that any
prima facie speed therein set forth is greater or less than is
reasonable or safe under the conditions found to exist at any
intersection or other place or upon any part of a street or highway
within such city, taking into consideration the width and condition
of the pavement and other circumstances on such portion of said
street or highway, as well as the usual traffic thereon, said
governing body may determine and declare a reasonable and safe
prima facie speed limit thereat or thereon by the passage of an
ordinance, which shall be effective when appropriate signs giving
notice thereof are erected at such intersection or other place or
part of the street or highway; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. Upon the basis of an engineering and traffic
investigation, the following street, or portion thereof indicated,

is hereby designated as a school zone and no person shall drive or
operate a vehicle at a speed in excess of thirty-five (35) miles
per hour in such school zone on days when school is in session,
between the hours of 8: 30 a.m. and 9: 30 a.m. and 3 : 30 p.m. and 4 : 30
p.m. , when signs are in place giving notice of such speed limit:
F.M. 528 between its intersection with Blackhawk Drive
and a point 528 feet west of Bay Area Boulevard.
Section 2 . Any person who shall fail to observe and comply
with a duly posted traffic control device erected pursuant to this
Ordinance, or who shall in any manner violate any provision of this
Ordinance, shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be fined in an amount of not less than
$1. 00 nor more than $200. 00.
Section 3 . In the event any clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same
to any person or circumstance shall for any reason be adjudged
invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this
Ordinance as a whole or any part or provision hereof other than the
part declared to be invalid or unconstitutional; and the City
Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the
omission of any such part thus declared to be invalid or
unconstitutional, whether there be one or more parts.
