HomeMy WebLinkAboutOrdinance No. 95-25 ORDINANCE NO. 95-25 AN ORDINANCE AMENDING APPENDIX B OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX B CONTAINING RULES AND REGULATIONS GOVERNING PLATS AND THE SUBDIVISION OF LAND, BY DELETING ALL OF SUBPARAGRAPH (j) OF PARAGRAPH (3) OF SUBSECTION (a) OF SECTION III THEREOF AND SUBSTITUTING THEREFOR A NEW SUBPARAGRAPH (j) , BY ADDING TO SUBPARAGRAPH 1 OF SUBPARAGRAPH 1 OF PARAGRAPH (3) OF SUBSECTION (a) OF SECTION III THEREOF A NEW SENTENCE; PROVIDING THAT THE MINIMUM RIGHT-OF-WAY WIDTH FOR PRIVATE STREETS IN GARDEN HOME SUBDIVISIONS SHALL BE 50 FEET; PROVIDING THAT DEAD END CUL-DE-SAC STREETS IN EXCESS OF 600 FEET MAY BE APPROVED UNDER LIMITED CIRCUMSTANCES; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. * * * * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The Code of Ordinances of the City of Friendswood, Texas, is hereby amended by striking all of subparagraph (j) of paragraph (3) of subsection (a) of Section III of Appendix B thereof, said Appendix B containing rules and regulations governing plats and the subdivision of land, which subparagraph (j) provides as follows: [ (j) Street right-of-way widths shall be as shown in the general plan for the City of Friendswood, and where not shown therein shall be not less than follows: Street Type Minimum Right-of-Way Width Major thoroughfare 120 feet Collector 80 feet Minor 60 feet Commercial streets 80 feet Boulevards 80 feet � Typical sections - Exhibit A. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to subparagraph 1 of subparagraph 1 of paragraph (3) of subsection (a) M of Section III of said Appendix B a new sentence to provide as follows: 1. . .Notwithstanding the foreqoing, in cases where proposed subdivisions are surrounded by existinct development which precludes compliance with block lenath standards, the Planninq Commission may approve the creation of dead end cul-de-sac streets which exceed 600' in length if the subdivider can establish that lots fronting thereon will not, as a result of the length of such street, be deprived of a level of public services which would otherwise be afforded to lots on dead end cul-de-sac streets of 600' or less. In considering anv such application, the Planninq Commission shall consider measures which would assure �1) adequate water pressure for potable water needs and fire fiqhting capabilities, S2) the abilitv of the City to timely provide emergencv services, and (3) that traffic hazards and traffic conqestion is not created due to density or number of lotso In achieving these measures, the Plannina Commission may require the use of inedians, larger lot dimensions, or other alternative solutions deemed appropriate by the Commission as may be necessary to satisfy the intent of this paragraph. Each application for an extended dead end cul-de-sac street shall be FWD\SUBDI V-AMN.ORD\7 01996 -2- considered on an individual case-by-case basis, and dependinq on the particular circumstances surroundina the property in question. Section 3. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2000. Each day of violation shall constitute a separate offense. Section 4. In the event any clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more partss PASSED AND APPROVED on first reading this 2nd day of October , 1995s PASSED, APPROVED, AND ADOPTED on second and final reading this 6th day of November , 1995. � Evelyn . All pavement failing to meet the required standards shall be replaced. b.
