AN ORDINANCE CLASSIFYING A 63.5 ACRE TRACT OF LAND AS
SINGLE FAMILY RESIDENTIAL (SFR) PURSUANT TO APPENDIX C OF
THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING THE
ZONING ORDINANCE OF THE CITY; AND PROVIDING OTHER
MATTERS RELATING TO THE SUBJECT.

WHEREAS, pursuant to City of Friendswocd, Texas, Ordinance No. 95-20, the Ciry
extended its corporate boundaries to include a 63.5 acre tract of land, more or less, out of and a
part of Lot 25 of the I. & G. N. Railroad Company Survey, Galveston County, Texas, said 63.5
acre tract being more particularly described in said Ordinance No. 95-20, a true and correct copy
of which is attached hereto as Exhibit "A" and for all things made a part hereof; and
WHEREAS, the Planning and Zoning Commission and City Council of the City of
Friendswood have conducted, in the tune and manner and after notice required by law and the
Zoning Ordinance of the City, a public hearing on the classification of such tract under said
Zoning Ordinance; and
WHEREAS, the Planning and Zoning Commission recommended and the City Council
deems it appropriate to assign and designate such 63.5 acre tract as Single Family Residential
(SFR) under the Ciry's zoning regulations; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE
OF TEXAS:
i n 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.

i n 2. The zoning classification of the 63.5 acre tract of land described in E�ibit
"A" hereto is hereby designated as Single Family Residential (SFR) pursuant to Appendix C of
the Friendswood City Code.
Section 3. The Official Zoning Map of the City, as provided for in Section 3 of said
Appendix C of the Friendswood City Code, shall be revised to show the zoning classification of
said 63.5 acre tract as provided in Section 2 hereof, with the appropriate reference thereon to the
number and effective date of this Ordinance and a brief description of the nature of the change.

AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS, EXTENDING
THE CITY LIMITS OF SAID CITY TO INCLUDE ALL OF THE
TERRITORY WITHIN CERTAIN LIMITS AND BOUNDARIES AND
ANNEXING TO THE CITY OF FRIENDSWOOD ALL OF THE TERRITORY
WITHIN SUCH LIMITS AND BOUNDARIES; APPROVING A SERVICE
PLAN FOR ALL OF THE TERRITORY WITHIN SUCH LIMITS AND
BOUNDARIES; CONTAINING OTHER PROVISIONS RELATING TO THE
SUBJECT; AND PROVIDING A SAVING AND SEVERABILITY CLAUSE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section l. The boundaries and limits of the City of
Friendswood, Texas, are hereby extended to embrace and include all
of the following described territory, and the following described
territory is hereby annexed to and made a part of the City of
Friendswood, to-wit: .
Part of Lot 25, of the I. & G. N. R. R. Survey, in
Galveston County, Texas, and being more fully described
by metes and bounds as follows:
COMMENCING at an old 1" iron pipe set for the most
Northerly corner of said I. & G. N. Survey No. 5 (fence
corner) according to a recorded Survey Map by C. A. Sias
(See Book 113, Page 22) in the office of the County Clerk
said 1" iron pipe also being in the Southwesterly line of
the Mary Fabreau Survey A-69 (Book 119, Page 515) office
of the County Clerk, Galveston County, Texas, and also
being the most Easterly Northeast corner of Lot 7 of the
BURGESS SUBDIVISION as recorded in Book 119, Page 14,
Office of the County Clerk;

Section 2 . The plan for the extension of municipal services
into the territory annexed to and made a part of the City of
Friendswood by the provisions of this Ordinance is set forth in the
"Municipal Service Plan" attached hereto and made a part hereof for
all purposes. Such Municipal Service Plan is hereby approved.
Section 3 . With reference to the foregoing matters, it is the
intention of the City of Friendswood and its City Council to fully
comply with all applicable provisions of the laws of the State of
Texas.
Section 4 . The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place, and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Act, Chapter 551, Texas Government
Code, as amended; and that this meeting has been open to the public
as required by law at all times during which this Ordinance and the

subject matter thereof have been discussed, considered, and
formally acted upon. The City Council further ratifies, approves,
and confirms such written notice and the contents and posting
thereof.
Section 5. If any section or part of this Ordinance be held
unconstitutional, illegal, or invalid, or the application thereof
ineffective or inapplicable as to any territory, such
unconstitutionality, illegality, invalidity, or ineffectiveness of
such section or part shall in no wise affect, impair, or invalidate
the remaining portion or portions thereof, but as to such remaining
portion or portions, the same shall be and remain in full force and
effect; and should this Ordinance for any reason be ineffective as
to any part of the territory hereby annexed to the City of
Friendswood, such ineffectiveness of this Ordinance as to any such
part or parts of any such territory shall not affect the
effectiveness of this Ordinance as to all of the remainder of such
territory or area, and the City Council hereby declares it to be
its purpose to annex to the City of Friendswood every part of the
territory described in Section 1 of this Ordinance, regardless of
whether any other part of such described territory is hereby
effectively annexed to the City. Provided, further, that if there
is included in the general description of territory set out in
Section 1 of this Ordinance to be hereby annexed to the City of
Friendswood any territory which is already a part of and included
within the general limits of the City of Friendswood, or which is
presently part of and included in the limits or extraterritorial
jurisdiction of any other city, town, or village, or which is not

� within the City of Friendswood's jurisdiction to annex, the same is
hereby excluded and excepted from the territory to be annexed
hereby as fully as if such excluded and excepted territory were
especially and specifically described herein.

Zoning Analysis: The land contingent to the subject property
on the Friendswood Side is zoned Single
Family Residential (SFR) . There is no zoning
on the League City Side.
