ORDINANCE NO. 9 6-16 AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING THE ZONING ORDINANCE OF THE CITY, BY STRIKING FROM SECTION 15 THEREOF ALL OF SUBSECTIONS B AND E AND SUBSTITUTING THEREFOR NEW SUBSECTIONS B AND E; PROVIDING THAT THE PLANNING AND ZONING COMMISSION SHALL MAKE FINAL REPORTS TO THE CITY COUNCIL REGARDING PROPOSED CHANGES TO DISTRICT BOUNSDARIES OR REGULATIONS WITHIN THIRTY (30) DAYS FOLLOWING THE CLOSE OF THE PUBLIC HEARING THEREON; REMOVING THE REQUIREMENT THAT THE AFFIRMATIVE VOTE OF FIVE MEMBERS OF CITY COUNCIL IS NECESSARY TO ADOPT A CHANGE TO A DISTRICT BOUNDARY OR REGULATION WHEN THE PLANNING AND ZONING COMMISSION DOES NOT RECOMMEND APPROVAL OF SUCH CHANGE; PROVIDING THAT THE AFFIRMATIVE VOTE OF THREE-FOURTHS OF THE MEMBERS OF CITY COUNCIL IS REQUIRED TO ADOPT ANY CHANGE TO A DISTRICT BOUNDARY OR REGULATION IN THE EVENT OF WRITTEN PROTEST OF THE OWNERS OF TWENTY PERCENT (20%) OR MORE OF EITHER THE AREA OF THE LOTS INCLUDED IN THE PROPOSED CHANGE OR THE AREA OF LOTS ADJOINING SAME AND EXTENDING 200 FEET THEREFROM; AND PROVIDING FOR SEVERABILITY. * �x * * :� BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS Section 1. Appendix C of the Friendswood City Code, said Appendix C being the Zoning Ordinance of the City, is hereby amended by striking from Section 15 thereof all of Subsection B, which Subsection B provides as follows: ["B. Submission to planning and zoning commission. Before taking action on any proposed amendment, supplement, or change the city council shall submit the proposed revision to the planning and zoning commission for its � recommendation and report. The planning and zoning commission shall make its final report within 60 days."] and substituting therefor a new Subsection B to provide as follows: 08/02/96 "B. Submission to planning and zonin� commission. Before taking action on any proposed amendment, supplement, or chan�y ordinance of a district boundary or re�ulation, the city council shall submit the pro,Qosed revision to the plannin� and zoning commission for its recommendation and report. The planning and zonin� commission shall make its report within thirty (30) days following the close of the public hearing thereon." Section 2. Said Appendix C of the Friendswood City Code is hereby further amended by striking from Section 15 thereof all of Subsection E, which Subsection E provides as follows: ["E. Vote required in the event of nonapproval or protest. Unless such proposed amendment, supplement, or change has been approved by the planning and zoning commission or in case of a protest signed by the owners of twenty percent (20%) or more either of the area of the lots included in such proposed change, or those immediately adjacent to the rear thereof extending 200 feet therefrom, or all of those directly opposite thereto extending 200 feet from the street frontage of such opposite lots, such amendment shall not become effective except by the favorable vote of five members of city council."] and substituting therefor a new Subsection E to provide as follows: "E. Vote required in the event of protest. In the event of a written protest to an, s�proposed amendment, supplement, or change to a district boundary or re�ulation si n�y the owners of twenty percent (20%) or more either of the area of the lots included in such proposed chan�e or those immediately adjacent to the area of the lots or land immediatelv adjoining the area covered by the proposed change and extending 200 feet from that area, such amendment shall not become effective except by the favorable vote of three-fourths of all members of city council." Section 3. In the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part of provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, declares that it would have passed each and every part of the same notwithstanding the omission O8/02/96 2 � • . ,.-o • , .. of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
