ORDINANCE N0. 94-19
AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS,
ESTABLISHING A MAXIMUM PRIMA FACIA SPEED LIMIT OF
FORTY-FIVE MILES PER HOUR ALONG FARM TO MARKET ROAD 2351
BETWEEN ITS INTERSECTION WITH THE GALVESTON COUNTY/HARRIS
COUNTY LINE AND ITS INTERSECTION WITH BEAMER ROAD;
DESIGNATING THAT PORTION OF FARM TO MARKET ROAD 2351
FROM ITS INTERSECTION WITH HOPE VILLAGE ROAD TO A POINT
ONE THOUSAND AND FIFTY-SIX FEET ( 1056 ' ) FEET WEST OF ITS
INTERSECTION WITH HOPE VILLAGE ROAD, A SCHOOL CROSSING
ZONE; ESTABLISHING A MAXIMUM PRIMA FACIA SPEED LIMIT OF
THIRTY ( 30) MILES PER HOUR IN SAID SCHOOL CROSSING ZONE;
ESTABLISHING TIMES WHEN SAID SCHOOL CROSSING ZONE IS IN
EFFECT; PROVIDING FOR THE PLACEMENT OF SIGNS; REPEALING
ALL OTHER ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT
OR IN CONFLICT HEREWITH; PROVIDING A PENALTY OF AN AMOUNT
OF NOT LESS THAN ONE DOLLAR ($1. 00) NOR MORE THAN TWO
HUNDRED DOLLARS ($200.00) FOR EACH VIOLATION; AND
PROVIDING FOR SEVERABILITY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. Maximum Prima Facia Speed Limits . The City
Council of the City of Friendswood, Texas, upon the basis of an
engineering and traffic investigation, hereby establishes the
maximum prima facia speed limit for that portion of Farm to Market
Road 2351 from its intersection with the Galveston County/Harris
County line eastward to its intersection with Beamer Road to be
Forty-five (45) Miles Per Hour.
Provided, however, that no person shall drive a vehicle on a
public street or highway in the City of Friendswood, Tex.as, at a
speed greater than is reasonable and prudent under the
circumstances then existing.
Any speed in excess of limits set forth by this section shall

be prima facia evidence that the speed is not reasonable or prudent
and that it is unlawful .
Section 2 . Desiqnation of Schoal Crossing Zane. The City
Council of the City of Friendswood, Texas , hereby designates that
portion of Farm to Market Road 2351 from its �ntersection with Hope
Village Road to a pcint one thousand and fifty-six feet (1056' )
east of said intersection.
Sectio� 3 . S�eed Limit Within School Crossinq Zone . It is
established, based on an engineerinq and traffic investigation,
made as authorized by the provisions of Article 67o1d, Vernon�s
Texas Civil Statutes, the prima facie speed limit for vehicles in
the school crossing zone described in Section ?_ above, when said
zone is in effect, is Thirty (30) Miles Per Hour. Said speed limit
is determined and declared to be reasonable and safe; the times
during which the above descrzbed �chool crossing zone is in effect
are from 7: 00 a.m. until 7 : 30 a.m. , and from 2 : 15 p.m. until 2 :45
p.m. , school days only.
Pravided, however, that no person sha�l drive a vehicle on a
public street or hiqhway in the City of Friendswood, Texas, at a
speed greater than is reasonable and prudent under the
circumstances then existing.
Any speed in excess of such limits as described herein shall
be prima facie evidence that �he speed is not reasonabie or prudent
and that it is unlawful.
Sectian 3 . Placement of Siqns. The City Manager is hereby
authorized and directed to cause the placement and maintenance of
any and all signs necessary to carry out the provisions of this

provisions of this Ordinance in accordance with the laws of the
State of Texas and this Ordinance.
Section 4 . Repeal of Conflicting Ordinances. All
ordinances or parts of ordinances inconsistent or in conflict
herewith are, to the extent of such inconsistency or conflict,
hereby repealed.
Section 5. Penaltv. Any person who violates any provision
of this Ordinance shall be deemed guilty of a misdemeanor and, upon
conviction, shall be fined not less than One Dollar ($1. 00) nor
i more than Two Hundred Dollars ($200.00) . Each violation shall
Iconstitute a separate offPnse.
Section 6 . Severabilitv. In the event any section,
paragraph, subdivision, clause, phrase, provision, sentence, or
part of this Ordinance or the application of the same to any part
of this Ordinance or the application of the same to any person or
circumstance shall for any reason be adjudged invalid or held
unconstitutional by a court of competent jurisdiction, it shall not
affect, impair, or invalidate this Ordinance as a whole or any part
or provision hereof other than the part declared to be invalid or
unconstitutional; and the City Council of the City of Friendswood,
Texas, declares that it would have passed each and every part of
the same notwithstanding the omission of any such part thus
declared to be invalid or unconstitutional, or whether there be one
or more parts .
