ORDINANCE NO. 98-35
AN ORDINANCE AMENDING ARTICLE IV OF CHAPTER 2 OF THE
FRIENDSWOOD CITY CODE, SAID ARTICLE BEING CITY OF
FRIENDSWOOD ORDINANCE NUMBER 91-21, ADOPTED AUGUST 5,
1991, AND BEING THE ETHICS ORDINANCE, BY STRIKING THE
DEFINITION OF "CITY OFFICER" IN SECTION 2-106 THEREOF AND
SUBSTITUTING THEREFOR A NEW DEFINITION AND BY ADDING A
NEW SENTENCE TO PARAGRAPH (6) OF SECTION 2-122; DELETING
CERTAIN JUDGES AND COMMITTEES FROM THE DEFINITION OF
"CITY OFFICER"; ADDING A NEW SECTION PROHIBITING CITY
OFFICERS FROM TAPE RECORDING AND/OR COPYING TAPES,
NOTES, AND OTHER MEMORANDA OF THE CITY WHICH ARE OF A
CONFIDENTIAL NATURE; AND PROVIDING FOR SEVERABILITY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE
OF TEXAS:
Section 1. The Friendswood City Code is hereby amended by striking from Section
2-106 thereof the definition of "City Officer" which reads as follows:
[City Officer means the mayor, members of the city council, the city manager,
city secretary, municipal court judge, alternate judges, and substitute judges,
department and deputy department heads, and where no deputy department head serves,
the first principal assistant of such department, and such additional city employees as
the city council shall name, and members and alternate members of each of the
following boards, commissions, and committees:
(1) Zoning Board of Adjustment;
(2) Building Codes Board of Adjustment and Appeals;
(3) Charter Review Commission;
(4) Planning and Zoning Commission;
(5) Community Appearance Board;
(6) Construction Standards Arbitration Committee;

(7) Electrical Board;
(8) Library Board;
(9) Parks and Recreation Board;
(10) Friendswood, Pearland, Alvin "Cloverfield" Aviation Committee; and
(11) Fourth of July Steering Committee.
and substituting therefor the following:

(10) Community and Economic Development Committee.
Section 2. The Friendswood City Code is hereby further amended by adding a new
subsection 5.06A. to Section 2-121 thereof which shall read as follows:
5.06A. Pertainin� to Executive Sessions. The personal recordin� of
information of a confidential nature shall be limited to handwritten notes and

Section 3. In the event any clause phrase, pxovision, sentence, or part of this
Ordin� or the application of the same to any person or circ�cnstauces shall for aziy �ea.s�n be
adjudged invalid or htld unconstitutional by a court of compete,�t�zrisd�ction, it sf�all �ot afFect,
unpair, or invalidate this Orclinance as a whole or any part or provision hereof other tha� the psz�t
decIared ta be invatid or un�onstitutional; and the City Council of ttte City of Fric�dswood,
Texas, declares that it would have pass�d each and every part pf tbe samc norwittista�di.r�g the
ornission of any sueh part thus dxiarcd to be invalid vr uncoa�stixutianal, whether there be one or
more parts.
