Ordinance No. E2017-26 AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS, ADOPTING A TEMPORARY EMERGENCY CURFEW AND h PROVIDING COMMANDEERING OF PRIVATE PROPERTY DUE TO THE EXPECTED CONDITIONS FOLLOWING TROPICAL STORM/HURRICANE HARVEY; AND PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH VIOLATION OF ANY PROVISION HEREOF. j x WHEREAS, by proclamation issued August 24, 2017, the Mayor declared a state of disaster for the City of Friendswood as a result of the pending dangers to life and property from Tropical StormiHurricane Harvey; and � I( WHEREAS, said state of disaster requires that certain emergency measures be taken pursuant to the Executive Order of the Governor Relating to Emergency Management; now, therefore, BE IT ORDAINED IN THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The following regulations shall take effect immediately upon adoption E hereof, A. CURFEW. It shall be unlawful for any person to remain or travel upon any public or private property within the city limits of the City of Friendswood, between the hours of 10:00 pm to dawn on August 27, 2017, and dusk to dawn until the state of disaster is terminated. B. this Subsection A shall not apply to: 1. a person authorized by the Emergency Management Director to assist in the production of the health, safety, or welfare of the public; or y 2. a person who remains or travels upon private property which is owned by him or upon which the person has been invited. C. The City of Friendswood may commandeer private property, subject to compensation requirements to respond to the disaster. Section 2. Any and all emergency regulations heretofore entered by the Mayor in i I connection with the disaster declaration of August 24, 2017, are hereby in all things approved, ratified, and confirmed. These regulations shall be in effect when duly filed with the City I Secretary. A person who violates any provision of these regulations, upon conviction, is punishable by a fine of not more than two thousand dollars ($2.000). Section 3. The City of Friendswood hereby declares that a state of emergency exists, and that in accordance with §3.11(b) and 3.12 of the City Charter, this ordinance is passed as an emergency ordinance, and shall take effect immediately upon passage.
