ORDINANCE NO. 9 7-5 AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY DELETING THE INTRODUCTORY PARAGRAPH OF SUBSECTION A OF SECTION 7 THEREOF AND SUBSTITUTING THEREFOR A NEW INTRODUCTORY PARAGRAPH, BY ADDING TO SECTION 7 THEREOF A NEW SUBSECTION A.1., BY ADDING TO THE PERMITTED USE TABLE CONTAINED IN SECTION 7 THEREOF A NEW ZONING DISTRICT DESIGNATION FOR DISTRICT SFR-E, HAVING AS PERMITTED USES AND PARKING GROUP DESIGNATION THE SAME AS PROVIDED THEREIN FOR DISTRICT SFR, AND BY STRIKING THE "REGULATION MATRIX - RESIDENTIAL DISTRICTS" TABLE CONTAINED IN SECTION 7 THEREOF AND SUBSTITUTING THEREFOR A NEW "REGULATION MATRIX - RESIDENTIAL DISTRICTS" TABLE; PROVIDING FOR THE CREATION OF A NEW SINGLE-FAMILY RESIDENTIAL ZONING DISTRICT TO BE ENTITLED "SINGLE-FAMILY RESIDENTIAL ESTATE DWELLING DISTRICT" (SFR-E); PROVIDING USE, DENSITY, YARD AND LOT AREA, HEIGHT, AND PARKING REQUIREMENTS FOR SUCH DISTRICT SFR-E; PROVIDING OTHER MATTERS RELATING TO THE SUBJECT; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. � * * * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the zoning ordinance of the City, is hereby amended by striking the introductory paragraph of Subsection A of Section 7 thereof, which introductory paragraph provides as follows: [A. SFR, residential, general purpose and description. The SFR, single family residential dwelling district is the most restrictive residential district. The principal use of land in this district is for low-density single-family . Low-density residential areas shall be protected from higher-density residential development and from the encroachment of incompatible uses. Said Appendix C of the Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Section 7 thereof a new Subsection A.1 to provide as follows: A.1 SFR-E, residential, eg neral purpose and description The SFR-E sin�le-familv residential estate dwellin� district is the most restrictive residential district. Area and hei�ht re�ulations. Area and hei ht re�ulations in an SFR-E, sin�le-familv residential estate dwellin� district are set forth in section 7-0.2f7-Q.2.1. Regulation Matrix 2 2. See section 8 for sunplementary district re�ulations. 3. See section 9 for temporarvi certificate of zonin� compliance that may be �ranted by the administrative official and specific use permits that may be recommended b,� the planning and zoning commission with the SFR-E district under certain circumstances and conditions. 4. Permitted uses. Uses permitted in an SFR-E, sin�le-family residential estate dwelling district, are the same as SFR. and are set forth in Section 7-P. Permitted Use Table. Section 3. Said Appendix C of the Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to the Permitted Use Table contained in Section 7 thereof a new zoning district category entitled "SFR-E," including verbatim under such SFR-E category the same permissible uses set forth under the category of use entitled SFR, and including said District SFR-E within the same parking group as District SFR. Section 4. Said Appendix C of the Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by striking the "Regulation Matrix - Residential Districts" as �, contained in Section 7 thereof, and as set forth in Exhibit "A" attached hereto and for all things made a part hereof, and substituting therefor a new "Regulation Matrix-Residential Districts" for said Section 7 as set forth in E�chibit "B" attached hereto and for all things made a part hereof. Section 5. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 6. In the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, 3 . , , � � . . . . , impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
