A ORD�NANCE OF THE CITY OF FRRINDSWOOD, TEXAS,
FIXING TEMPORARY RATES; EXTENDING THE DATE FOR
FILING OF TF� RATE-FILING PACRAGE; AND,
RATIFYING AN AGFZ1?F.MF.NT WITfi TEXAS-NEW ME?XICO
POWER COMPANY.

WI3LRF.AS� the City of Friendswood, Texas, as regulatory authority under the
Public Utility Regulatory Act has ordered Texas-New Mexico Power Company to
file a Rate Filing Package with the City in order to determine if the
utility's rates are fair, just and reasonable and its tariffs adequate; and
WHEREAS, the City's order requires the utility to file its rate filing
package with the City not later than 120 days from the date that the utility
received notification of the City's order; and
Vif�REAS, the City and the utility would like an opportunity to discuss
matters of mutual concern relating to the rates of the utility prior to the
time that the utility submits a full rate filing package to the City; and
WHF.RRAS� the City, as part of the Gulf Coast Coalition of Cities, has been
presented with an agreement negotiated with Texas-New Mexico Power Company
relating to various rate related issues, including matters currently pending
before the City; and
WEIEREAS, ratepayers can only be protected from the adverse effects of
delay by establishing temporary rate.
NOW, THEREFORE, BE IT RESOL�iED BY THE CITY COUNCZL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
l. The findings and recitals set forth in the preamble hereof are
adopted in their entirety.
2. Pursuant to the Public Utility Regulatory Act 2.211(c) , the 120
day period for Texas-New Mexico Power Company to file its Rate Filing
Package with the City is hereby extended to Ju1y 1, 1997.
3. Pursuant to the Public Utility Regulatory Act 2.211(d) , the
current rates of Texas-New Mexico Power Company are hereby fixed as
temporary rates effe�tive May 15, 1997, and such temporary rates shall
continue in effect until a final determination of the matter is made.

4. The agreement dated February 12, 1997, by and between Texas-New
Mexico Power Company and the Gulf Coast Coalition of Cities, is hereby
ratified. A copy of the agreement is attached hereto, and made a part
hereof for all purposes.
5. The Gulf Coast Coalition of Cities is hereby authorized to negotiate
an agreement in principal on behalf of the City regarding settlement of the
rate and tariff issues, including competitive issues, in dispute, but the
City shall not be bound by any such agreement until it is ratified or
otherwise adopted by the City.
6. The City hereby reserves the right to discuss rate and tariff
matters at issue, including competitive issues, with the utility, however,
the utility is hereby ordered to direct any and all discussions initiated by
the utility regarding the rate, tariff or competitive matters in dispute to
the Gulf Coast Coalition of Cities Negotiating Committee.
7. This ordinance shall be served on the utility by certified First
Class U.S. Mail, return receipt required.
8. This Ordinance shall become effective from and after its adoption.
