A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXAS CREATING WITHIN THE MUNICIPAL
COURT DEPARTMENT OF THE CITY A CITY WARRANT OFFICER
POSITION TO REPLACE THE EXISTING WARRANT OFFICER
POSITION WITHIN THE CITY'S POLICE DEPARTMENT,
ESTABLISHING STANDARDS FOR QUALIFICATION OF CITY
WARRANT OFFICERS, PROVIDING FOR SUPERVISION OF THE
CITY WARRANT OFFICER'S AUTHORITY, AND PROVIDING FOR
SEVERABILITY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. There is hereby created within the Municipal Court Department of the
City a City Warrant Officer Position, the same being intended to supersede and replace the
existing Warrant Officer position currently contained within the City's Police Department.
Section 2.
(a) Position created. There is created within the municipal court of the City
a position of City Warrant Officer, pursuant to the terms and provisions of this resolution.
(b) Appointment; supervision. Subject to the approval of the Director of
Administrative Services and the Municipal Court Judge, the City Manager shall appoint a
City Warrant Officer, who shall thereafter be under the direct supervision of the Director
of Administrative Services or his/her designee.
(c) Duties. The City Warrant Officer shall serve and execute warrants of
arrest, subpoenas, and other legal process issuing out of the Municipal Court of the City.
The City Warrant Officer shall also serve subpoenas or other legal process issuing out of
the Council, any Board, Commission, or Department requiring legal process for hearings,
condemnation hearings, and none other. The City Warrant Officer shall serve as court
bailiff in the Municipal Court. The City Warrant Officer shall additionally perform such
other and further duties as may be assigned by the Director of Administrative Services or
designee.
(d) Certification required. The City Warrant Officer shall meet the
qualifications for certification as a peace officer as established by the Texas Commission
of Law Enforcement Officer Standards and Education pursuant to Chapter 1701 of the
Texas Occupations Code and shall seek and receive such peace officer certification
within the time prescribed by Chapter 1701 of the Texas Occupations Code, as a
necessary condition for continued employment as a City Warrant Officer.
(e) Authority. The City Warrant Officer shall serve as a peace officer and
shall have full police authority in the exercise of his assigned duties.
(� Status as a police officer. The City Warrant Officer is not a regular
member of the Police Department of the City within the meaning of the state laws
governing such department as to department policies, minimum wages or hours of
employment. Neither shall the City Warrant Officer be a paid law enforcement officer
for the purposes of and within the meaning of Chapter 1701 of the Texas Occupations
Code.
(g) Effect of appointment on regular police officers. Nothing provided in
this resolution shall prevent or in any way inhibit any regular police officer of the City
from serving or executing any process issuing out of the Municipal Court which may be
placed in his hands to be served or executed.
Section 3. In the event any clause phrase, provision, sentence, or part of this resolution
or the application of the same to any person or circumstances shall for any reason be adjudged
invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or

invalidate this resolution as a whole or any part or provision hereof other than the part declared to
be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares
that it would have passed each and every part of the same notwithstanding the omission of any
such part thus declared to be invalid or unconstitutional, whether there be one or mare parts.
PASSED, APPROVED, AND RESOLVED by the City Council of the City of
Friendswood, Texas on this the 21St day of March 2005.
