AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD
CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD,
TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY
ADOPTED THE 19TH DAY OF NOVEMBER 1984, AND BEING THE
ZONING ORDINANCE OF THE CITY, BY CHANGING THE ZONING
CLASSIFICATION OF A CERTAIN 404.5 ACRE TRACT OF LAND
FROM SINGLE-FAMILY RESIDENTIAL (SFR) TO PLANNED UNIT
DEVELOPMENT (PUD) — CLUSTER HOMES, SUCH TRACT BEING
KNOWN AS TRACTS 1 AND 5 OUT OF THE JOHN DICKINSON
LEAGUE ABSTRACT 9, IN THE CITY OF FRIENDSWOOD,

TEXAS, ALL OF WHICH ARE WITHIN THE CITY LIMITS OF THE
CITY; PROVIDING FOR THE AMENDMENT OF THE CITY'S
OFFICIAL ZONING MAP; PROVIDING FOR SEVERABILITY; AND
PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000
FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF.

WHEREAS, Wesley West Cattle, L.P., and/or Wesley West Descendants Trust are the
owners (the "Owner") of a certain 404.5 acre tract presently zoned Single-Family Residential
(SFR), pursuant to the City's Zoning Ordinance, as amended; and
WHEREAS, the Owner has made application to the City to change the zoning
classification of said 404.5 acre tract, same being more particularly described in Exhibit "A"
attached hereto and for all things made a part hereof, from Single-Family Residential (SFR) to
Planned Unit Development (PUD)—Cluster Homes; and
WHEREAS, Wesley West Cattle, L.P., and/or Wesley West Descendants Trust are the
owners (the "Owner") of a certain 240.19 acre tract presently zoned Multi-Family Residential —
Garden Home District (MFR—GHD), pursuant to the City's Zoning Ordinance, as amended; and
WHEREAS, the Owner has made application to the City to change the zoning
classification of said 240.19 acre tract, same being more particularly described in Exhibit "B"
attached hereto and for all things made a part hereof, from Multi-Family Residential — Garden
Home District (MFR—GHD) to Planned Unit Development(PUD)—Cluster Homes; and
WHEREAS, Autumn Creek Development, Ltd. is the owner (the "Owner") of a certain
47.35 acre tract presently zoned Single-Family Residential (SFR), pursuant to the City's Zoning
Ordinance, as amended; and
WHEREAS, the Owner has made application to the City to change the zoning
classification of said 4735 acre tract, same being more particularly described in Exhibit "C"
attached hereto and for all things made a part hereof, from Single-Family Residential (SFR) to
Planned Unit Development (PUD)—Cluster Homes; and

WHEREAS, the Planning and Zoning Commission and the City Council have
conducted, in the time and manner required by law and the Zoning Ordinance of the City, a
public hearing on such requests; and
WHEREAS, the Planning and Zoning Commission has recommended approval of the
applications and the City Council deems it appropriate to grant such requests; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. The zoning classification of the 404.5 acre tract of land, same being more
particularly described in Exhibit "A," attached hereto and for all things made a part hereof,
known as Tracts 1 and 5 of the John Dickinson League Abstract 9, City of Friendswood,
Galveston County, Texas, located on FM 518 and commonly known as the West property, and
within the city limits of the City, is hereby changed from Single-Family Residential (SFR) to
Planned Unit Development (PUD)—Cluster Homes.
Section 3. The Zoning District Map of the City of Friendswood shall be revised and
amended to show the designation of said 404.5 acres, as described and as provided in Section 2
above, with the appropriate reference thereon to the number and effective date of this Ordinance
and a brief description of the nature of the change.

Section 4. The zoning classification of the 240.19 acre tract of land, same being more
particularly described in Exhibit "B," attached hereto and for all things made part hereof, known
as Tracts 2, 4, and 6 of the John Dickinson League Abstract 9, City of Friendswood, Galveston
County, Texas, located on FM 518 and commonly known as the West property, and within the
city limits of the City, is hereby changed from Multi-Family Residential — Garden Home District
(MFR—GHD)to Planned Unit Development (PUD)—Cluster Homes.
Section 5. The Zoning District Map of the City of Friendswood shall be revised and
amended to show the designation of said 240.19 acres, as described and as provided in Section 4
above, with the appropriate reference thereon to the number and effective date of this Ordinance
and a brief description of the nature of the change.
Section 6. The zoning classification of the 47.35 acre tract of land, same being more
particularly described in Exhibit "C," attached hereto and for all things made a part hereof,
known as Tract 8 of the John Dickinson League Abstract 15 and the Sarah McKissick Survey,
Abstract 549, City of Friendswood, Harris County, Texas, located on West Bay Area Boulevard,
and within the city limits of the City, is hereby changed from Single-Family Residential (SFR) to
Planned Unit Development(PUD)—Cluster Homes.
Section 7. The Zoning District Map of the City of Friendswood shall be revised and
amended to show the designation of said 47.35 acres, as described and as provided in Section 6
above, with the appropriate reference thereon to the number and effective date of this Ordinance
and a brief description of the nature of the change.

Section 8. This Ordinance shall in no manner amend, change, supplement, or revise
any provision of any ordinance of the City of Friendswood, save and except the change in zoning
classification of said 404.5, 240.19, and 47.35 acres to Planned Unit Development (PUD) —
Cluster Homes, as described above.
Section 9. The Council further finds it appropriate to impose certain conditions on
this change in zoning, and that the following conditions shall be imposed on the land uses within
the PUD: No more than 1,500 total home sites will be permitted on the tracts rezoned herein,
mare particularly described in Exhibits "A," "B," and "C," attached hereto. For purposes of the
limitation contained in this Section, the three tracts rezoned herein and described in Exhibits
"A," "B," and "C" will be considered as one tract; that is, no more than 1,500 total home sites
will be permitted on the three tracts as a whole.
Section 10. Additionally, the Owners defined herein shall dedicate a total of thirty-
percent (30%) of the total Planned Unit Development (PUD) — Cluster Homes, described in
Section 9 above, as open space as that term is defined in the City's zoning ordinance.
Section 11. In the event that the City's zoning ordinance governing Planned Unit
� Development (PUD) — Cluster Homes is amended by the City Council, the Owner shall be
permitted to operate under the amended regulations with regard to Planned Unit Development
(PUD) — Cluster Homes, or the regulations existing with regard to Planned Unit Development
(PUD)—Cluster Homes as of the effective date of this Ordinance, at the Owner's choice.
Section 12. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or

provision hereof other any part or provision hereof other than the part declared to be invalid or
unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the omission of any and every part
of the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, or whether there be one or more parts.
Section 13. Any person who shall violate any provision of this Ordinance shall be
deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed
$2,000.00. Each day of violation shall constitute a separate offense.
PASSED AND APPROVED on first reading this 20th day of September 2004.
