Tfie invocation was given by Pastor Ralph Hobratschk with Hope Lutheran Church. Mayor Holland led the Pledge of Allegiance to the United States and to the State of Texas. COMMUNICATIONS FROM THE PUBLIC Katie White, ..Friiendswood resident, addressed .Council.and stated she, lives in Timberfield Estates Subdivision, She bought her house a year ago because of the beauty of the house, neighborhood, and surrounding community. She grew up in Katy, Texas, and when her parents bought their house Katy was a rural area, over-the years,businesses came in and'the community grew. At first her family was thrille6. With the growth, but as the-years passed businesses struggled and closed down. The closed businesses were replaced with new businesses each less desirable than the one before. Her parents moved away from the city they had called home for 30 years after all her siblings graduated from high school. On a recent trip to the community she grew up in it was unrecognizable. She does not want that to happen to the City of Friendswood. Ms. White asked Council to not bring added traffic and decrease property vaiues:by rezoning the property at 104 Whispering Pines for commercial use. Jane Gibson, Friendswood resident, addressed Council and stated she lives in Timberfield Estates subdivision. The property at 104 Whispering Pines near the corner of FM 518 is currently zoned for residential use with the exception of'the church, and Council is considering rezoning the property to commercial use. She believes that if the zone change is approved the property next to the church, which still has a house on it, will also apply for a zone change to commercial use. The residents that have lived in Timberfield Estates for decades invested their homes in a residential area. Whispering Pines was a nice-little road that came across the creek and residents have worked diligently to keep the small neighborhood atmosphere.. The homes, park, and streets of Timberfield Estates are an asset to the cothmi nity. Ms..Gibiion further stated she has been'fold that the current emphasis on development in the bowntown'District is food establishments. No matter what type of development buys the proposed property, the residents of Timberfield Estates will live literally feet from the property. Residents already face increased traffic due to the expansion of Whispering Pines and take their lives in their hands trying to get in and out of their neighborhood. Vehicles traveling across the bridge back up at FM 518 and block both entrances to Timberfield Estates. Commercial development of the proposed property will only I 06/05/17 4690 increase the traffic nightmare. Ms. Gibson asked Council to support the residents of Timberfield Estates in their efforts to stop the rezoning request. Phil Ratisseau, Friendswood resident, addressed Council and thanked Council for allowing him to speak. Mr. Ratisseau asked City Attorney Mary Kay Fischer to keep the taxpayers in mind when she provides legal guidance to City leaders, believes in the past that the City has been given poor legal advice which has cost the taxpayers a lot of money. WORK SESSIONS Mayor Holland opened the discussion regarding the Multi-Year Financial Plan. Katina Hampton, Acting Administrative Services Director, presented a PowerPoint presentation regarding an overview of the City's Multi-Year Financial Plan (MYFP), and primarily focuses on the General Fund and Debt Service Fund used in decision making. The scope of detail for the MYFP includes revenue projections, expenditure projections, and Decision Package impacts carried out through the plan. The plan will impact the Fiscal Year 2018 projected operating and fund balance. Planning assumptions with key revenue source being property taxes. Tax revenue is based on projected tax values with modest growth in the tax base throughout the plan, other revenue sources are based on population projections, and are increased by 2% per year throughout the plan. Revenue planning data includes planning and economic development, residential/commercial growth projected, current trends are considered, tax base is identified, fiscal policies are considered, revenue forecasting, departmental input in regards to fee adjustments needed, and alternative revenue options available. Fiscal Year 2018 Projected General Fund Revenue, total General Fund Revenue of $27,007,758 with non-tax revenue being $4,129,083, franchise taxes being $1,671,779, sales taxes being $5,507,257, and property taxes being $15,699,639. The sales tax revenue generated from the half-cent sales tax approved by voters in 2016 for street improvements and the Friendswood Downtown Economic Development Corporation (FDEDC) is recorded and expended in funds separate from the General Fund. Non-tax revenue includes building permits, intergovernmental ' grant revenue, court fines, and interfund transfers. Property tax components include gross appraised value approximates market, taxable value, tax levy, and tax revenue. The tax rate has two parts that are considered when adopting the tax rate, Interest and Sinking (I&S) for debt service along with Operations and Maintenance (O&M) for General Fund. The debt service rate is levied to meet debt service obligations. The MYFP reflects debt service tax rate projected to meet existing debt service obligations and potential new debt. Tax drivers include property tax revenue, in the MYFP is based on the Effective Tax Rate, maintaining debt service tax rate allows for debt capacity, and O&M tax rate will not maintain current service levels throughout the plan. Revenue growth relating to property values, in the MYFP is projected from revaluations and new construction estimates. Planning assumptions in _regards to expenditures include personnel expenditures to increase 3% annually throughout the plan, includes increases due to salaries and related benefits, and non-personnel expenditures to increase 5% year over year based on historical average. Planning assumptions for fund balance, target of 90-days operating reserves, undesignated fund balance uses are emergencies, one-time expenditures with no operating cost increase, major capital purchases, and start-up expenditures for new programs. The MYFP indicates 90-day operating reserve maintained through Fiscal Year 2021. With current projections and assumptions, no Decision Packages are funded in the five-year planning window. Council's role is guidance on tax rate, and participation in budget development. Discussion took place between Mayor, Council, and Staff regarding Staff bringing back to Council possible ideas for alternative revenue streams and a breakdown of property tax exemptions at a future meeting. Mayor Holland opened the discussion regarding Capital Projects update. Director of Public Works/City Engineer Patrick Donart presented a PowerPoint presentation regarding the progress made on Capital Projects since the May Council meeting. He reported on the Fire Station No. 4 expansion and the Kenneth Camp Fire Station, Centennial Park basketball pavilion, restroom and pavilion at Lake Friendswood, Old City Park, Round 1 Street Improvements, Blackhawk Boulevard Phase II and Woodlawn Drive, Lift Station No. 18 and 23, the Blackhawk Wastewater Treatment Plant, current Texas' Department of Transportation (TxDOT) projects throughout the City, and replacement of the Mandale 06/05/17 4691 Bridge. Discussion took place between Mayor, Council, and Staff regarding Gulf Coast Water Authority (GCWA) being interested in partnering with the City to replace the Mandale Bridge but only with a wooden bridge. The last bridge was built in 1985, has lasted 32 years, GCWA has agreed to fund 80% of the project, and consensus of Council was for Staff to pursue the project with GCWA. Director of Public Works/City Engineer Patrick Donart presented a PowerPoint presentation regarding Agenda Item 17A, Resolution R2017-14 Design Criteria Manual. Pending Council's approval later in the meeting, the effective date of the Design Criteria Manual would be July 1, 2017. Notable proposed changes in the manual are non-single family residential force main manhole would require lining, and requirements above Galveston County's grease trap requirements. Councilmember Rockey asked for a Point of Order and stated the Design Criteria Manual was not listed on the agenda. Mr. Donart stated the Design Criteria Manual was part of the Capital Projects update, and there is a resolution later on the agenda for Council's approval regarding the manual. Mayor Holland opened the discussion regarding the Police Department radio purchase. Friendswood Police Chief Bob Wieners presented a PowerPoint presentation regarding the Police Department public safety radio system. Chief Wieners gave a brief history on the radio equipment and stated Council was briefed at the June 2015 Council meeting regarding the need for radio equipment replacement, and the estimated cost was $1.7 Million. Since June 2015, radios have been incrementally replaced using budgeted funds, grant funds, and the Police Investigative Fund. Motorola notified its subscribers of the cancellation of its XTS 6000 mobile and handheld radios in November 2013, cancellation of flash upgrades in December 2016, and that support of XTS 5000 would end in 2018. The current radio inventory consists of both XTS handhelds and XTL mobiles in the Police Department only. Total interim ' purchases that have been made were $459,249 consisting of consoles, consultees and recording equipment, vehicle mobile radios in new vehicles, and APX handheld. Total Police Department and Friendswood Volunteer Fire Department equipment that have been purchased to date is $870,668. Future purchases that will be needed are 35 replacement mobile radios, 85 replacement handheld radios, and accessories with an estimated cost of$650,000. With•concurrence of Council, Mayor Holland moved to Agenda Item 16, Discussion and possible action regarding concurrence with the City Manager's appointment of the Director of Administrative Services, ACTION ITEMS **Councilmember Hill moved to approve the City Manager's appointment of Katina Hampton as the new Director of Administrative Services. Seconded by Councilmember Rockey. The motion was approved unanimously. With concurrence of Council, Mayor Holland moved to Agenda Item 11, City Manager's Report. CITY MANAGER'S REPORT City Manager Roger Roecker reported that the Fourth of July Steering Committee and the City of Friendswood would like to invite all to participate in the City's 122nd Annual Friendswood Fourth of July Celebration. The daylong celebration is packed full of entertainment, food and fun for the entire family The theme for this year's celebration is "Salute to America, Texan Style." The day will kick off with the Grand Parade that will travel down Friendswood Drive. The parade will begin at 10:00 AM at the corner of FM 518 and Heritage Drive, and will feature over 100 entries from Friendswood and around the State of Texas. The parade will conclude at Stevenson Park where over 50 vendor booths, rides, games, food, live entertainment, and fun for the entire family will take place. The activities will begin shortly after the conclusion of the parade, and will conclude at approximately 3:30 PM. The evening program will be held at Centennial Park and begins at 7:30 PM. The band "Bee Gees Gold", a Bee Gees tribute band, will headline the night's entertainment. The evening will conclude with a fantastic fireworks extravaganza that 06/05/17 4692 will light up the sky beginning at approximately 9:20 PM. The fireworks will be choreographed to patriotic music and the show is expected to be one of the best fireworks displays in the Houston area. Public parking will not be available at Centennial Park for the evening program, but a free shuttle service is provided to gain admittance into the park. The shuttle service will be available from Clear Brook High School and from Friendswood High School, and will begin running at 6:30 PM. Do not miss out on this family event as the community of Friendswood celebrates our country's independence in patriotic style. The City Manager reported that the City is proud to recognize Friendswood Police Officer Mitchell Jeffcoat as the recipient of the Fifty Club Officer of the Year Award for outstanding law enforcement efforts while serving during 2016. Officer Jeffcoat is a dedicated family man. He and his wife Lauren have a six-year old daughter and a two-year old son. He finds the time in his hectic schedule to teach and mentor at the Alvin Community College Peace Officer Academy as well as train and race in Ironman Distance Triathlons. Officer Jeffcoat has a Bachelors degree from Sam Houston State University. In 2007, he completed the basic Peace Officer Law Enforcement Academy at Alvin Community College, currently holds a Master Peace Officer Certificate and has attended over 1,700 hours of in-service training. He is a nine-year veteran of law enforcement, joined the Friendswood Police Department in 2007, where he quickly earned the respect of his coworkers and supervisors. He started his career in the patrol division, and in just a few short years his people-skills and street-smarts earned him a position with the Field Support Unit, also known as the Narcotics Unit. As a Patrol Officer, some of his assignments were Field Training Officer, DWI Breath Test Operator and SWAT team member. During his present assignment, he has led several major narcotic investigations. Those investigations have led to numerous felony arrests, seizure of monies and property, and a significant quantity of illegal narcotics being removed from street level dealers. Officer Jeffcoat has a strong desire to make a difference in the community and this desire is shown in the performance of his everyday duties. The City Manager reported that in Friendswood, Galveston and Harris Counties are responsible for mosquito control. The City of Friendswood supplements the counties' efforts by spraying at all City ' facilities, public parks, and by providing additional spraying in public rights-of-way in the Harris County portion of Friendswood, due to Harris County only focusing on areas that have been impacted by confirmed cases of mosquito-borne diseases. Residents can also call their respective county to request spraying in a specific area. The City Manager reported that the City of Friendswood ranked number eleventh in SafeWise's Fifty Safest Cities in Texas for 2017. SafeWise is a home security and safety brand committed to increasing safety education, awareness, and preparedness in American communities. The City Manager thanked Council for always providing that the Police Department has the right equipment, number of employees, and that they are compensated competitively. The City Manager reported that the Friendswood Volunteer Fire Department's Emergency Medical Services (EMS) division was recognized with the American Heart Association's Mission: Lifeline EMS Gold Plus Award. Lifeline participants share a common commitment to American Heart Association's best-practice guidelines and data-based quality measures, benefit from recognition, regional networking, and knowledge transfer. Nationwide every year, more than 250,000 people experience an ST elevation myocardial infraction, the most deadly type of heart attack caused by a blockage of blood flow to the heart that requires timely treatment. All the City of Friendswood's ambulances are equipped with a Lifepak 15. This is a very sophisticated machine which includes a defibrillator and 12-lead Electrocardiogram (ECG). The City Manager reported that Waste Connections provided scholarships to Clear Creek Independent School District (CCISD) and Friendswood Independent School District (FISD) graduating seniors as part of their commitment to community involvement within the City of Friendswood with $500 being contributed to Clear Brook High School, $500 to Clear Springs High School, and $1,000 to Friendswood High School. Each school's scholarship committee selects the recipients and the scholarships are awarded according to financial need, academics, and community service. This year's scholarship recipients were Kennedy Bateman from Friendswood High School, Austin Tuan-Nam Luong from Clear Springs High School, and Hanna Mitschke from Clear Brook High School. The City appreciates Waste Connections' continued support and assistance to high school graduates in pursuing their college education. 06/05/17 46g3 With concurrence of Council, Mayor Holland moved to Agenda Item 20, Consent Agenda. CONSENT AGENDA Councilmember Hill recused himself for a conflict of interest. "Councilmember Scott moved to approve all items on the Consent Agenda as presented: A. Authorizing Council to invoke Rule 1(A) of the Rules of Procedure to schedule the July City Council meeting for the second Monday, July 10, 2017. B. Approving a Buyout License Agreement for 506 and 508 North Shadowbend Avenue and authorizing the Mayor to execute the agreement. C. Acceptance of Paving and Utilities improvements at completion of one year maintenance period of the Fountains of Friendswood. D(. Acceptance of Paving and Utilities improvements at completion of one year maintenance period of Sterling Creek Section Two. E. Acceptance of Paving and Utilities improvements at completion of one year maintenance period of the West Ranch Sierra Section Two. F. Acceptance of Paving and Utilities improvements at completion of one year maintenance period of the West Ranch Sierra Section Three. The motion was approve 6-0 with Councilmember Hill recusing - himself. With concurrence of Council, Mayor Holland moved to Agenda Item 6, Closed Executive Session. CLOSED EXECUTIVE SESSION ' Mayor Holland asked if anyone would like to speak regarding the Executive Session. No one spoke. Council convened into Executive Session in accordance with the Texas Government Code, pursuant to Section 551.071 —Consultation with Attorney regarding pending claims (Olson & Olson, LLP) and Section 551.071 — Consultation with Attorney regarding potential litigation arising from pending zoning change application (Verizon Wireless). The Executive Session pursuant to Section 551.071 — Consultation with Attorney regarding pending litigation (Robert J. Bertrand, et al v. City of Friendswood) did not convene. RECONVENE INTO OPEN SESSION Council reconvened into Open Session with no action taken later in the meeting. ACTION ITEMS (continued) **No motion was made on discussion and possible action regarding a settlement offer relating t pending claims against Olson & Olson, LLP. COMMUNICATIONS FROM THE PUBLIC Tracey Dinh, Friendswood resident, addressed Council and stated she is speaking as a representative from Timberfield Estates, current Homeowner's Association (HOA) President. The residents of Timberfield Estates are concerned about the proposed rezoning of the current church property on Whispering Pines from residential to commercial. If Council approves the rezone request there will be ' increased safety concerns and increased traffic flow in the area. Pedestrians currently have a difficult time using the intersection in the area and there is a limited line of sight on Arbre Lane and Verdun Lane. If a commercial property is developed in the proposed area, there would be an increased safety factor for pedestrians that use the intersection. Another concern is that the high school and junior high bus stop is 06/05/17 4694 located on Whispering Pines and Arbre Lane, and residents have noticed traffic does not currently stop while the bus has its lights flashing. More traffic will increase safety issues for the bus stop. The residents of Timberfield Estates do not believe there will be any additional benefit for Council to rezone the property to commercial. David Allen, Friendswood resident, addressed Council and stated former Councilmember Patrick McGinnis used to say the Declaration of Independence each year. Mr. Allen recited a portion of the Declaration of Independence in honor of the 41h of July. Mr. Allen further stated that what makes the United States of America (USA different is the government is by and for the people, let us keep it from perishing, and remember this 4' of July the special form of government the USA has. Events in England are out of control, large numbers of unvetted people are being imported, the country has to somehow get ahold of what is going on, in the meantime pray for our country, the USA has so much to be thankful for, and an amazing tradition to pass down to our children. Marianne Duncanson, Friendswood resident, addressed Council and stated she lives on Arbre Lane and would like to request Council not approve the rezoning request for the property on Whispering Pines. If the property is rezoned to commercial it would increase safety issues but also cause an issue regarding property values. The residents of Timberfield Estates would like Council to vote against the rezone request at least until restrictions could be placed on the property restricting the type of business that could be developed there. Jack Click, Friendswood resident, addressed Council and stated he lives on Arbre Lane, and asked that Council vote against the rezone request for the property on Whispering Pines. He moved to Timberfield Estates two and a half years ago and it was a sleepy little neighborhood with a couple lanes of road, is now a super highway outside his neighborhood. He stated he does not see the value in the City to rezone the property since it is currently a church. If it is going to remain a church, it should not be zoned commercial. The City is not currently collecting property taxes on the property. Timberfield Estates ' residents have a difficult time exiting their neighborhood, traffic has backed up past Arbre Lane, many times residents have to drive the loop and use Verdun Lane. If there is no value to the City to rezone the property, why would Council approve the request. Andrew Duncanson, Friendswood resident, addressed Council and stated he would like to discuss the rezoning of the property at 104 Whispering Pines. He moved to Friendswood 27 years ago to a subdivision on a quiet residential street, is no longer a quiet street, and from the way it looks it will not be a neighborhood anymore. The residents of Timberfield Estates did not move into a commercial district, they moved to a neighborhood in a community of people, is not here just for a few days, has raised his children here for 27 years. Rezoning the property would only benefit the seller, at Timberfield Estate resident's detriment, and would ask Council to vote against the rezone request. Phil Ratisseau, Friendswood resident, addressed Council and stated he would like to speak in support of the Timberfield Estate residents. There is no need for the City to rezone the proposed property, will not change the tax benefits to the City, wait until there is a buyer and the property is under contract. At that point, the purchaser can request a zone change from the City, could determine the type of business that would be developed and if the business would be immutable with the residents. He requested Council vote against the rezone request. COMMUNICATIONS FROM COMMITTEES AND SPECIAL REPORTS Planning and Zoning Commission Chair Craig Lovell presented the annual report and stated over the past year the Planning and Zoning Commission (P&Z) have looked at four preliminary plats, 14 final plats, 10 commercial site . plans, 11 zone change recommendations, and two vacation of rights-of-way. Accomplishments P&Z had throughout the year include conducting an annual review of the Permitted Use Table and the NAICS codes, worked with Council to change uses allowed in the Downtown District, ' commission and subcommittee worked on large retail ordinance, discussed and reviewed various zoning related items, and five commissioners attended the American Planning Association Texas Chapter Conference. Ongoing projects include review of the Future Land Use Map, Official Zoning Map, Major 06/05/17 4695 Thoroughfare Plan, Zoning Ordinance and Subdivision Ordinance updates, and personal care facility requirements. Mr. Lovell thanked City Staff from 2016 for their work and effort. Discussion took place between Council and Planning and Zoning Commission (P&Z) Chair Craig Love 1 regarding the process that P&Z uses to make recommendations to Council on appointments to the commission, City will maintain all records and follow the City's retention policy, P&Z will provide a detailed report on all applicants and who P&Z is recommending and why. Fourth of July Steering Committee Vice Chair Barbara Blanchard presented the annual report and stated this year's parade is the 122ntl annual with entertainment, food and fun for the entire family. The theme is "Salute to America, Texan Style." The parade will begin at 10:00 AM. Friendswood Independent School District (FISD) Superintendent Trish Hanks will be honored for her many years of service to the community and school district as the Grand Marshall. There will be over 50 vendor booths, rides, games, food, live entertainment, fun for the entire family will take place, and daytime activities will conclude at approximately 3:30 PM. The evening program will take place at 7:30 PM at Centennial Park, with the band "Bee Gees Gold" which is a Bee Gees tribute band who will headline the evening entertainment. Fireworks will begin at approximately 9:20 PM, and there will be a shuttle service for the evening program from Clear Brook High School and from Friendswood High School. Vice Chair Blanchard listed all the members of the Fourth of July Steering Committee, and thanked the city's Parks and Recreation Department for all the help they provide. West Ranch Management District Board President Brian Gibson presented a PowerPoint presentation regarding the West Ranch Management District(WRMD). He showed a slide of the current land plan and reported that 80% of residential homes are occupied, 24 of the 27 sections are developed, homebuilding is underway in seven of the 24 sections, two sections are currently under construction, one future section remains to be constructed, and home building is expected to be completed by 2019. Assessed valuation ' and'tax rate, current 2016 assessed value is 1394,783,333 with 2016 total tax rate of $0.55, projected 2017 total tax rate of$0.50, projected 2018 total tax rate of$0.45, and total tax rate is expected to level off at$0.45 until the commercial value is realized. Completed projects are Falcon Lakes Boulevard, West Boulevard, East Friendswood Lakes Boulevard, multiple detention ponds, FM 518 traffic signal, and Lake Friendswood parking lot. Current project is Lake Friendswood Park pavilion. Construction is expected to begin the middle of June 2017, contractor has obtained construction permits from the City, anticipated completion date is October 2017, and 1.1 acre park site will be gifted to the City once the project is completed. A future project is West Friendswood Lakes Boulevard, four-lane boulevard from West Boulevard to the western border of the District, funds for the project are in the District's escrow account', construction contracts have been fully executed, and construction is expected to start in September 20171. Commercial property status, 45 acres of commercial development remains near the intersection of FM 518 and West Boulevard, 13 acres of commercial development remains near the intersection of West Boulevard and Friendswood Lakes Boulevard, utilities are available to the sites, and Friendswood Development Company has indicated that they are still seeking a potential town center developer. Long term goals and objectives are as values continue to increase and commercial tax base is established, the board will continue to weigh lowering the tax rate and continue to pay off bonds. Maintenance for the project, City of Friendswood maintains water, sanitary and storm sewers, West Ranch Community Association maintains landscape reserves, WRMD maintains detention ponds, and the 2016 WRMD maintenance tax is$0.09/$100. Mayor Holland asked West Ranch Management District Board President Brian Gibson to possibly present a report on the West Ranch Management District to Council once every six months. ACTION ITEMS (continued) **Councilmember Scott moved to approve the reappointment of Renae Rives, Kathy Molinaro, Barbara ' Blanchard, and Terri Corbett to the Fourth of July Steering Committee with terms to expire July 2020; reappointment of Todd Mendenhall and Natasha McAdoo to Keep Friendswood Beautiful with terms to expire July 2020; and reappointment of Greg Hughes, Steve Knis, and Mike Czarowitz to the Zoning Board of Adjustment with terms to expire July 2019. 06/05/17 4696 Seconded by Councilmember Branson. The motion was approved unanimously. **Councilmember Rockey moved to approve the reappointment of J. J. The motion was approved unanimously. **Councilmember Foreman moved to approve a proposal from Infrastructure Management Services (IMS), for engineering services for development of a Pavement Management Master Plan and authorize the Mayor to execute the contract. Discussion took place between Mayor, Council, and Staff regarding the development of a Pavement Management Master Plan, evaluate current conditions of City streets, information obtained by Infrastructure Management Services (IMS) could be utilized for annual maintenance contracts, forecast budgeting, future bond proposals, and potential sales tax allocations. IMS owns a complex engineered vehicle to drive over streets and capture many different pieces of information from the pavement. The data is utilized to determine at which point on a life cycle curve a given segment of pavement is currently located. The current baseline used for roadways is greatly outdated, IMS will evaluate all roads maintained by the City, and the process should take two to three months. **Councilmember Hill moved to approve a change order with El Dorado Paving Company, Inc., for the reconstruction of Woodlawn Avenue. RESOLUTIONS **Councilmember Foreman moved to approve Resolution R2017-14 — A resolution approving and ' adopting updates/ amendments to the "Design Criteria Manual' for the City of Friendswood, Texas; approving the standards contained therein for the design, construction and installation of public infrastructure and related facilities and improvements within the City; and repealing all prior design criteria manuals and repealing other resolutions or parts of resolutions inconsistent or in conflict herewith.
