ORDINANCE NO. 2017-12 AN ORDINANCE AMENDING APPENDIX "C" "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS, SECTION 3, "PROVISION FOR OFFICIAL ZONING MAP", REZONING THE PROPERTY GENERALLY CONSISTING OF 4.6212 ACRES FROM BUSINESS PARK (BP) AND SINGLE FAMILY RESIDENTIAL (SFR) TO PLANNED UNIT DEVELOPMENT (PUD), SAID 4.6212 ACRES OF LAND BEING PART OF LOT TWO (2-3), IN BLOCK ONE, OF FRIENDSWOOD, A SUBDIVISION OUT OF THE SARAH McKISSICK SURVEY, ABSTRACT 151, IN GALVESTON COUNTY, TEXAS, CITY OF FRIENDSWOOD, MORE FULLY DESCRIBED IN EXHIBIT "A", INCORPORATED BY REFERENCE, WITH SUCH PLANNED UNIT DEVELOPMENT (PUD) TO BE GOVERNED FOR ALL PURPOSES AND CONDITIONS PURSUANT TO THE ATTACHED CONCEPTUAL PLAN INCLUDED IN EXHIBIT "B", ALL AS MORE SPECIFICALLY PROVIDED HEREIN; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF' ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. WHEREAS, FM 2351 Development Company, LLC, (the "Owner") owner of real property located within the City, same now consisting of 4.6212 acres of land, being a part of Lot Two (2-3), in Block One, of Friendswood, a subdivision out of the Sarah McKissick Survey, Abstract 151, in Galveston County, Texas, City of Friendswood, has filed an application to rezone the real property from Business Park (BP) and Single Family Residential (SFR) to Planned Unit Development (PUD), property to be known as "The Pond" more specifically described in Exhibit "A", including Warranty Deeds, survey, location map, zoning and aerial map, (the "Property"), pursuant to the conceptual plan attached hereto included in Exhibit "B"; and WHEREAS,, the Planning and Zoning Commission and the City Council conducted a joint public hearing to consider such application; and WHEREAS., the hearing was duly called as provided by the laws of the State of Texas and Appendix "C" of the Code of Ordinances of the City, ("Zoning Code"), and that in such hearing all persons attending were allowed to be heard on the question of whether or not to rezone the Property from Business Park (BP) and Single Family Residential (SFR) to Planned Unit Development (PUD), as requested in the application and as further depicted in the conceptual plan included in Exhibit "B", to determine whether such rezoning would affect the health, safety, convenience, or general welfare of the citizens of Friendswood, and whether or not such change in zoning would violate the rights of any interested person; and WHEREAS,pursuant to the Zoning Code, Section 7. "Schedule of District Regulations," J. "Planned Unit Development, General Purpose and Description," paragraph 7.c.2, Owner has determined to submit a conceptual plan at this time, (Option 2), a copy of which is attached hereto as Exhibit "B" and incorporated by reference, an option that will require the Owner to apply for site plan approval at a later date if the zone change to PUD is approved; and WHEREAS, the Planning and Zoning Commission has filed its written report with City Council, which recommends approval of the application for rezoning of the subject Property; and WHEREAS, as a result of the said public hearing, the City Council hereby finds and determines that the proposed change in zoning classification and the rezoning of the Property Ord 2017-12 2 would not be detrimental to the community, and is in conformance with the zoning ordinance; now, therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct, it being expressly understood that City Council of Friendswood ("City Council') is relying upon the express representations of Owner appearing in the documents submitted for final approval, (specifically including those documents in Exhibit "B"), and the representations made at the joint public hearing before the Planning and Zoning Commission and City Council to induce approval of the rezoning made the subject of this Ordinance. Section 2. The Friendswood City Code, Appendix C, "Zoning," Section 3, "Provision for Official Zoning Map," is hereby amended, rezoning the Property identified as a 4.6212 acre tract of land in the attached Exhibits "A" and "B," from Business Park (BP) and Single Family Residential (SFR) to Planned Unit Development (PUD), with such Planned Unit Development (PUD) to be governed for all purposes and conditions as depicted in Exhibits "A" and "B." (all of which are incorporated by reference), but otherwise consistent and subject to the current Zoning Code, and related conditions contained herein. This rezoning is specifically conditioned upon Owner's full compliance with Section 7. "Schedule of District Regulations," J. "Planned Unit Development, General Purpose and Description," paragraph 7.c.2 (Option 2) and the following use and development regulations: 1. Setbacks: Front: 3 0 feet Rear: 15 feet Sides: 25 feet 3. Building Height and Lot Coverage: Maximum building height: 52.5 feet on the front 203 feet of the property adjacent to FM 2351; remainder of the buildings on the tract are subject to a maximum height of 40 feet Maximum Lot Coverage: 32% 4. All other development regulations such as landscaping, parking, and signage will meet the current regulations of the Community Shopping Center (CSC) zoning district and the Community Overlay District(COD) outlined in City of Friendswood ordinances. Section 3. The Official Zoning Map of the City of Friendswood shall be revised and amended to show the designation of the Property, as described and as provided in Section 2 above, with the appropriate reference thereon to the number and effective date of this Ordinance, and a brief description of the nature of the change. This Ordinance shall in no manner amend,, change, supplement or revise any provision of any ordinance of the City of Friendswood, save and except the change in zoning classification of said Property as described above. Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence,, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any and every part of the same, notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts. Section 6. Any person who shall willfully, intentionally, or with criminal negligence violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined in an amount not to exceed $2,000.00. Each day of violation shall constitute a separate offense. Overall building layout Exhibit B Ord 2017-12 PLANNING, ENGINEERING, CONSTRUCTION MANAGEMENT March 14,2017 Ms, Becky Summers Development Coordinator City of Friendswood 910 S, Friendswood Dr. Friendswood,TX 77646 Re: Application to Change of Zoning from BP/SFR to PUD The Pond:Luxurious Senior Living-Senior Care Facility 4.62 Acre Tract on FIVI 2351 Friendswood, Texas 77646 Dear Ms. Summers: Attached for your review is the PD application package for the above referenced property, The property Is currently zoned BID &SFR. A request is being made to change the zoning for the subject tract to Planned-Unit Development to allow overall master planning of a Senior Independent Living and Senior Care Facility on a 4.62 acre tract on FM 2351. The proposed development will consist of approximately 150 unit complex'that supports seniors from simple independent living to advanced memory care. The facility will have 2 separate buildings. One building will be for independent living and the other for assisted living and memory care, The facility will have approximately a 75 unit(3 floor) Independent living building to the front of the property, Residents will have access to a restaurant, Bistro lounge, Salon, Fitness Center, Movie room, and Game room. A Continental Breakfast, Lunch, Dinner and Sunday Brunch will also be Included. Scheduled Trips and activities will also be provided. There will be multiple units to choose from that range from a 450 sq ft studio apartment to a larger 900 aq ft two bed room apartment. Rooms will have a full kitchen and most rooms will have a patio,water and electricity will be provided, Washer and Dryer access will be on each floor. Weekly housekeeping will also be provided, The Senior Living Facility will be.for 55 years of age and older. The main building will consist of management office space and 60 rooms(2 floors)of Assisted living, Residents will have the same amenities provided to Independent living guests but in the main building. In addition, Assisted living guests will have a day time nurse manager and I medical assistant per 5-7 residents in the daytime. At night there will be a nurse on call and a medical assistant on site. This will range from simply, help with medications to bathing and dressing services. The rooms will range from a 350 sq ft studio to a 600 sq ft two bedroom apartment. These rooms will have small refrigerators and microwaves. Lastly, the rear of the facility will be able to provide for up to 15 residents with Memory care needs. This wing will have its own nurse manager and memory rare assistants to deal with individual needs of these residents. These rooms will be 350 sq ft to 450 sq ft. The entire facility will have a Director, assistant Director environmental services staff, chef and assistants,marketing manager, maintenance staff,and a director of activities and security. Care will be taken to provide a nice outdoor living area for guests to walk and enjoy the outdoors. A pond will be a main focal point of the facility and will be located between the 2 buildings. As many trees as possible will be kept at the front of the property. Grain gge Storm water runoff from the proposed development will drain to the roadside ditch at FM 2361, GCCDD has advised us that this development is eligible to pay into the pro-rata share of regional detention pond in-lieu of on�slte detention. The proposed pond on the site will be used as an amenity pond only. Water&Sewer The proposed development will be served by the existing 8" watermain along FM 2351 and the existing 8" sanitary sewer along FM 2351, Prolgot Phasing The project will be developed In multiple phases. The first Phase will consist of Senior Care Facility along the rear. Once the Senior Care Facility's operations are stabilized,the Independent Living Units will be developed.
