ORDINANCE NO. 2005-04
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
CITY OF FRIENDSWOOD, TEXAS TO ADOPT THE 2003
EDITION OF THE INTERNATIONAL FIRE CODE, INCLUDING
APPENDICES, AS PUBLISHED BY THE INTERNATIONAL
CODE COUNCIL, INC.; BY AMENDING SECTION 30-61 OF THE
CODE OF ORDINANCES TO DELETE THE REFERENCE TO
THE 2000 EDITION OF THE INTERNATIONAL FIRE CODE AND
INSERTING A REFERENCE TO THE 2003 VERSION THEREOF;
BY AMENDING SECTION 30-61 OF THE CODE OF
ORDINANCES TO REMOVE THE WORDS "STANDARD" AND
"PREVENTION" IN REFERENCE TO THE CITY'S FIRE CODE;
TO ADOPT THE 2003 EDITION OF THE LIFE SAFETY CODE,
INCLUDING ALL APPENDICES THERETO; PROVIDING
CERTAIN AMENDMENTS TO THE CODE ADOPTED HEREBY;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; PROVIDING A PENALTY OF AN
AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF
VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING
FOR SEVERABILITY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
Section 1. City of Friendswood, Texas Ordinance No. 2002-19, as amended,
originally adopted on or about the 18t" day of November 2002, same being a portion of
Chapter 30 of the Friendswood City Code, is hereby amended by deleting the reference to
the 2000 version of the International Fire Code contained in Section 30-61 thereof and
adding thereto a reference to the 2003 version of the International Building Code to read
as follows:

"Sec. 30-61. International Fire Code adopted; amendments.
The International Fire Code, [2000] 2003 Edition, including appendices,
as published by the International Code Council, Inc., an authentic copy of
which has been filed with the city secretary, is hereby adopted and made a
part of this division, except as follows:
(1) Section 101.1 is hereby amended to read as follows:
101.1 Title. These regulations shall be known as the Fire Code of the City
of Friendswood, Texas, hereinafter sometimes referred to as "this code."
(2) Section 102.6 is hereby amended to read as follows:
102.6 Referenced codes and standards. The codes and standards
referenced in this code shall be those that are listed in chapter [14] 45
hereof, and such codes and standards shall be considered part of the
requirements of this code to the prescribed extent of each such reference.
Where differences occur between the provisions of this code and the
referenced standards, the provisions of the most restrictive shall apply.
Whenever amendments have been adopted to the referenced codes and
standards, each reference to said code and standard shall be considered to
reference the amendments as well.
(3) Section 108 is hereby amended to read as follows:
108. Board of appeals. The city zoning board of adjustment and appeals
shall act as the fire and life safety code board of adjustments and appeals.
(4) Section 109.3 is hereby deleted in its entirety.
(5) Section [505.5.1] 508.S.1 is hereby amended to read as follows:
[505.5.1] 508.5.1 Where required. Where a portion of the facility or
building hereafter constructed or moved into or within the jurisdiction is
more than 300 feet from a hydrant on a fire apparatus access road, as
measured by an approved route around the exterior of the facility or
building, on-site fire hydrants and mains shall be provided where required
by the code official.
[(6) Section 903.2.8 is hereby amended to read as follows:
903.2.8. Group R-2. An automatic sprinkler system shall be provided
throughout all buildings with a Group R-2 fire area of two stories or more
in height, including basements, or where having more than eight dwelling
units. ]
(6) Section 903.2 is hereby amended to read as follows:
903.2 Where required. Approved automatic sprinkler svstems in new
buildings and structures shall be provided in the locations described in this

section or when the gross square footage of the building or structure
exceeds 11,999 square feet."
Section 2. The Code of Ordinances of the City of Friendswood, Texas is
hereby amended by deleting the words "Standard" and "Prevention" in Section 30-63
thereof to read as follows:
"Sec. 30-63. New materials, processes or occupancies which require
permits.
The city council, city manager and the fire marshal shall act as a
committee to determine and specify, after giving affected persons an
opportunity to be heard, any new materials, processes or occupancies
which shall require permits, in addition to those now enumerated in the
[Standard] Fire [Prevention] Code. The fire marshal shall post such list in
a conspicuous place in his office, and distribute copies thereof to
interested persons. "
Section 3. City of Friendswood, Texas Ordinance No. 2002-19, as amended,
originally adopted on or about the 18'�' day of November 2002, being a portion of Chapter
30 of the Friendswood City Code, is hereby amended by deleting the reference to the
2000 edition of the Life Safety Code in Section 30-76 thereof and adding thereto a
reference to the 2003 edition of the Life Safety Code to read as follows:
"Sec. 30-76. Life Safety Code adopted.
The [2000] 2003 Edition of the Life Safety Code, including all
appendices thereto, as published by the National Fire Protection
Association, Inc., an authentic copy of which has been filed with the city
secretary, is hereby adopted and made a part of this division."
Section 4. Any person who shall violate any provision of this Ordinance, or any
provision contained in any code adopted hereby, shall be deemed guilty of a misdemeanor
and, upon conviction, shall be fined in an amount not to exceed $2000. Each day of
violation of any such provision shall constitute a separate offense.

Section 5. All ordinances or parts of ordinances inconsistent or in conflict
herewith are,to the extent of such inconsistency or conflict, hereby repealed.
Section 6. In the event any clause phrase, provision, sentence, or part of this
Ordinance or the application of the same to any person or circumstances shall for any
reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it
shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision
hereof other than the part declared to be invalid or unconstitutional; and the City Council of
the City of Friendswood, Texas, declares that it would have passed each and every part of
the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, whether there be one or more parts.
