ORDINANCE NUMBER 35
AN ORDINANCE CREATING A PLANNING AND ZONING COMMISSION
FOR THE CITY OF FRIENDSWOOD, TEXAS AND PROVIDING FOR
THE QUALIFICATIONS OF MEMBERS, THEIR APPOINTMENT AND
TERM OF OFFICE: RULES AND REGULATIONS: POWERS AND
DUTIES GENERALLY, PROVIDING FOR SEVERABILITY CLAUSE,
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. That there is hereby created and established for the
UlEy of—riendswood, Texas, a planning and zoning commission,
which shall be composed of five (5) members. The members shall be res
ident citizens, taxpayers and qualified voters 6f the City, all
of whom shall be appointed by the Mayor subject to confirmation by th
governing body, (City Council), to serve for the terms of three (3)
years. All vacancies shall be filled for the unexpired term in the
same manner as provided for the orginal appointments. All expired
terms shall be filled for terms as, provided for the original '
appointments and in the same manner. Members of the Commission
may be removed by the Mayor, with ,the consent of the City Council,
after public hearing and for cause assigned in writing. The
members of the Commission shall serve without compensation.
Section 2. There shall be two ex-officio members composed of the
y ecretary and one other Council member who shall be annually
selected by the Mayor for a one (1) year term. The ex-officio
members shall act in an advisory capacity and shall not havelthe pow-
er to vote ( except this first year of the Commission, during this
period the Mayor, City Secretary and the Council Member shall
have a vote) .
Section 3. The Planning and Zoning Commission shall elect a
chairman and Vice Chairman from its membership and shall have the you
er to employ such qualified persons as may be necessary for the
proper conduct and undertakings of the Commission and to pay1for
their services and such other necessary expenses, providing that
the cost of such services and expenses shall not exceed the amount
appropriated by the City Council for the use of the Commission.
It shall also have the power to make rules, regulations and by-laws
for its own government, which shall conform as nearly as possible
with those governing the City Council and same shall be subj6ct to
approval by such Council. Such by-laws shall include, among other
items, provisions for: '(a) regular and special meetings, to be
open to the public; (b) records of its proceedings, to be open for
the inspection of the public; (c) reporting to the City Council
and the public form time to time and annually; and (d) for the
holding of public hearings on its recommendations.
Section 4. It shall be the duty of the Commission to act as an
advisory oard to the City Council and to act on all matters, referr-
ed to it by the Council.
Section 5. All Department Heads and Officials of the City of
r en swood, Texas, shall be available to the City Planning
Commission for advice and consultation and they shall cooperate
with and render such services for the City Planning Commission as
shall come within the scope of the duties of such Department Heads
and Officials and city employees.
Section 6. The City Planning Commission shall have the power and
authority and it shall be its duties with the consent and at the
directions of the City Council:

(a) To make studies and project plans for the improvements
of the City of Friendswood with a view of its development and
extension, and to recommend to the City Council all matters for: the
development and advancement of the city facilities, layouts and, appez
ance and to perform the duties imposed upon the City Planning
Commission by the Statutes of the State of Texas, and specifically
by Chapter 231, Acts of Regular Session of 40th Legislature,
1927, the same being Article 974A, Vernon's Annotated Revised
Civil Statutes of Texas.
(b) To make plans and maps of the whole or any portion of
the City of Friendswood, and of land outside the City Limits,
located within the 100' strip and' any other land outside teh City of
Friendswood, which in the opinion of the City Planning bears relat-
ion to the planning of the City of Friendswood and' to make such
changes, in additions and extensions of plans or maps within the City
as it deems same advisable,
(c) To confer with and advise private property owners per-
taining to location and erection of private structures with the
view of having the same conform to the overall city plan and to
advise with the Building Inspector in the performance of his duties.
(d) To aid and assist the Mayor and City Council in the pre-
paration of the City Budget and determination of sources of funds
and in the procuring of finicial and other aids and assistance
for the City from the State and the Federal Governments and their
agencies for each and all of the purposes herein enumerated.
(e) To act with and assist all other municipal and govern-
mental agencies and especially the City Council in formulating and
executing proper plans for municipal development.
Section 7, To plan and recommend the location, plan and extent of
City Alleyways, parks, playgrounds, airports, automobile parking,
and other public grounds and public improvements, for the location
and• planning of public buildings, schools, and other properties,
and public utilities, including bus terminals, railroad depots
anditerminals, whether public or privately owned, for water,
lights, sanitation, sewage disposal, drainage, flood control,
transportation, communication and shipping facilitiesm and for the
removal, relocation, widening, extension, narrowing, vacation, .
abandonment or change of use of any of the ' foregoing public places, _
works, buildings, facilities, or utilities.
Section 8. To plan and recommend to the City Council routes, streets
avenues, and boulevards and particularly to investigate and
recommend the opening, widening, or abandonment of streets, avenues,
boulevards and alleyways or the changing thereof to conform to the
City's system, present and future', all streets, avenues, boulevards,
alleyways and parks.
Section 9. To investigate, consider and report to the City Councilt:'q
upon a layout and plan of any new subdivision as outlined in the
Subdivision Regulations for the City of Friendswood, Texas.
Section 10. To recommend to the City Council for adoption, idditiona.
rules and gulations governing platsaand subdivisions of land
within the corporate limits df the City within the 100' boundary
to promote health, safety, moral and general welfare of thelcommunit;
and the safe and orderly and healthful development of the community,
such rules and regulations may be adopted by the City Council only
after public hearing held thereon.

City Council in devising, establishing, locating, improving, select-
ing, maintaining the public parks, playgrounds and lakes for
public recreation.
Section 12. To aid and assist the City Council by recommending
plans for the development of civic centers and to make investigations
consider and male recommendations to the City Council concerning
traffic regulations, routing and control, and highway designaitions.
Section 13. To review all zont6ng regulations and make recommendations
or amendments thereto and to review and act on all exceptionslper-
mitted under zoning changes involving major land use. ( TO develop
the original zoning plan for Friendswoodl.
Section 14. All ordinances and parts of ordinances not consistent
with or contrary to(here) are hereby repealed.

Section 15. If any section, subsection, sentence, clause, phrase,
or por on of this ordinance is for any reason held invalid or
unconstitutional by any court of competent ,jurisdiction, such
section, subsection, sentence, clause, phrase or portion shall be
deemed separate, distinct and an independent provision and such
holding shall not effect the validity of the remalligg portion
hereof.
