HomeMy WebLinkAboutOrdinance No. 34 ORDINANCE NUMBER AN ORDINANCE CREATING THE OFFICE OF ASSESSOR AND COLLECTOR OF TAXES IN AND FOR THE CITY OF FRIENDSWOOD, GALVESTON,COUNTY, TEXAS,, PROVIDING FOR THE APPOINTMENT OF SUCH OFFICER, TERM OF OFFICE AND QUALIFICATIONS, OUTLINING THE DUTIES OF SUCH TAX ASSESSOR AND COLLECTOR, REQUIRING THE POSTING OF A BOND FOR SUCH OFFICER, DECLARING AN EMERGENCY AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH: whereas, Article 977 of the Revised Civil Statutes of Texas, and other Articles of Title 28 of the Revised Civil Statutes of Texas, authorize the governing body of any City or town operating under the general laws of Texas, having i less than five thousand inhabitants according to the last pre- ceding Federal Census, may, by Ordinance, create the office of Tax Assessor and Collector of such City or Town and at the same time by such Ordinance designated that such officer be appointed as the City Council may desire and that said Taxi Assessor and Collector for said City shall be appointed rather than elected. Ncw , therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,, TEXAS: i SECTION 1: The office of Assessor and Collector of taxes in and for the City of Friendswood, Texas, after the effective date of this Ordinance shall be filled by appointment by the City Council of the City of Friendswood, Galveston County, !Te- xas. SECTION 2: The duties, powers, rights, authority and obliga- tions vested by law upon an assessor and collector of taxes shall be the same as are conferred upon such officer;,by Article 977, Article 1044 and other Articles pertaining to the assess- ment and collectionof taxes and the officer holdirrj such office as provided in Title 28 of the Revised Civil Statutes of Texas, and amendments thereto, and shall perform such other dutieI as may be required of him by law, ordinance, resolution orl order of the City Council. SECTION 3: The Tax Assessor and Collector shall be appointed for an indefinite period of time and shall be subject to dls- -1- i charge at the will of the City Council. Such officer so fill- ing such position shall receive such compensation as the City Council shall from time to time by ordinance or resolution designate and shall furnish such indemnity bond as may be re- quired by law, or by the City Council by ordinance or resolu- tion. SECTION 4: The effective date of this ordinance shall be the I _day of April A. D. 1964 at 12-. 01 o' clock A. M. SECTION 5: If any part of any section, portion or section of this Ordinance shall be held by a Court of competent jurisdlic- tion to be void or unconstitutional, the rest and remainder of such Ordinance not held to be void or unconstitutional shall continue to remain in full force, and effect, and any such partial illegality shall not affect the same as a whole. SECTION 6: The fact that there is not now in effect an ordi- nance or resolution providing for the assessment and collection of taxes by any designated officer and that an imperative public necessity exists for the creation of such office and officer, the parlimentary rule of procedure requiring that Ordinances be read on three separate meetings, be, and the same is hereby suspended and this Ordinance shall take effect from and after its passage and approval. Speck with the following absent: Dale Brown , constituting a quorum, at which time the following proceedings were had: Councilman Harry Hatcher introduced for considera- tion of .the City Council an Ordinance. The Ordinance was read in full by the City Secretary. Councilman H.K. Speck made a motion that the Ordinance be passed. The motion was seconded by Councilman Arden Hill , The Motion carried by the following vote: AYES: Mayor Harry Wagner , Councilmen Arden Hill Alan McGinnis H.K.
