E 85-38 , AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE N0. 84-15, PASSED AND APPROVED NOVEMBER 19, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY ADDING TO PARAGRAPH 14 OF SUBSECTION K OF SECTION 8 THEREOF A NEW SUBPARAGRAPH C; PROVIDING THAT ON-PREMISE PORTABLE SIGNS NOT EXCEEDING 32 SQUARE FEET IN SIGN AREA MAY BE USED IN NON-RESIDENTIAL DISTRICTS BETWEEN DECEMBER 3, 1985 AND DECEMBER 31, 1985 ; PROVIDING OTHER MATTERS RELATING TO THE SUBJECT; PROVIDING FOR SEVEK- ABILITY; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED ' $1,000 FOR EACH DAY OF VIOLATION HEREOF; AND DECLARING AN EMERGENCY. � �r � � � BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS : Section l. City of Friendswood, Texas , Ordinance No. 84-15, passed and approved the 14th day of November, 1984, and being the Zoning Ordinance of the City, is hereby amended by adding to Paragaph 14 of Subsection K of Section 8 the following sub- paragaph c : "c. Holida Use - Notwithstanding any other provision of t is Or �nance to the contrary, portable signs may be erected and used between December 3, 1985 and December 31, 1985, under the following terms and con- ditions : 1) No off-premise portable signs shall be permitted; 2) Not more than one (1) portable sign shall be per- mitted for each business establishment ; 3) No portable sign shall be erected in a residen- tially zoned district ; 4) No portable sign shall exceed 32 square feet in sign area; 5) Portable signs erected in integrated business developments shall be limited to not more than one (1) portable sign for every two businesses or fraction thereof; 6) Each business in an integrated business develop- ment shall be limited to the use of only one (1) side or face of such portable sign; 7) Any portable sign erected and used hereby which has only one (1) sign face or side in use must have a non-commercial seasonal message on the vacant side ; 8) A permit shall be obtained prior to the installa- tion of any such portable sign; 9) Any portable sign erected hereby shall be removed by midnight, December 31, 1985; 10) Such portable sign shall otherwise comply with all provisions of this Ordinance." Section 2. In the event any section, paragraph, subdivi- sion, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or cir- cumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional ; and the City Council of the City of Friendswood, Texas , declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts . Section 3. Any person who shall violate any provision of this Ordinance shall be deemed �uilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $1,000.00. Each day of violation shall constitute a separate offense. Section 4. Emergency. The City Council of the City of Friendswood hereby declares that an emergency exists which requires consideration and adoption of this Ordinance for the reason that failure to allow the advertising provided hereby will irreparably harm the financial viability of the businesses of the City.
