HomeMy WebLinkAboutOrdinance No. 85-12 ORDINANCE N0. 85-12 AN ORDINANCE AMENDING PARAGRAPH 21 OF SUBSECTION K OF SECTION 8 OF ORDINANCE 84-15 OF THE CITY OF FRIENDS- WOOD TO PROVIDE THAT A READER PANEL MAY BE ERECTED UPOPd PERMANENT SIGNS PERMITTED IN RESIDENTIAL ZONES ; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING A PENALTY. � � � � � BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDS- WOOD, STATE OF TEXAS : Section l . City of Friendswood, Texas Ordinance No . 84-15, as amen�ed , being the Zoning Ordinance of the City, is hereby amended by striki_ng all of Pa.ragraph 21 of Subsection K of Section 8 thereof, which provides as follows : ["21 . PERMANENT SIGNS PERMITTED AND REGULATED IN R S DEN ZONFS a. This Section shall apply to all residential zones as given in the Zonin� Ordinance. b . Size and Number - One sign not exceeding two and one-half 2-1 2) square feet in sign area shall be perm�tted per dwelling unit . For multiple dwelling units in MFR-H, one additional sign totaling not more than thirty two (32) square feet in sign area shall be permitted. c . Location - Permitted signs may be anywhere on the premises except as restricted by the Zoning Ordinance and this Subsection. They may not project beyond any property line and, if ground mounted, the top shall not be nore than five (5) feet over natural ground level . If building mounted, such sign shall be f.lush mounted and shall not project above the roof line. d . Read�r Panels are prohibitec� in residential areas . e. Subdivisions are allowed one (1) permanent identi- fication sign at each entrance. The total sign surface area at each entrance shall not exceed fi£ty (SO) square feet. f. Permits - Signs allowed by this Subsection which c�o not exceed two and one-half (2-1/2) square feet do not require a permit for erection. "] and substituting therefor the following : "21. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect , impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friends- wood , Texas , declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional , or whether there be one or more parts . Section 3 . Any person who shall violate any provision bf this Ordinance shall be deemed �uilty of a misdemeanor and upon conviction, shall be fined in an amount not to excee� $1 ,000.00.
