HomeMy WebLinkAboutOrdinance No. 84-04 , . . . r.- � ORDINANCE N0. . � AN ORDINANCE ESTABLISHIr:G A MAXIMUM GROSS VEHICLE WEIGHT OF FIVE (5) TONS UPON THE WHISPERING PINES BRIDGE AS IT CROSSES CLEAR CREEK FOR THAT PORTION OF SUCH BRIDGE WHICH IS LOCATED WITHIN THE CITY OF FRIENDSWOOD; MAKING CERTAIN FINDINGS ; AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS ; AND PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED TWO HUNDRED DOLLARS ($200 .00) FOR VIOLATION OF ANY PROVISION HEREOF. * � � ,� �r WHEREAS, the County Engineer for Harris County , Texas , has notified the City Council that as a result of certain tests upon the Whispering Pines Bridge , as it crosses Clear Creek, Harris County has imposed a Five (5) Ton Gross Vehicle Weight Limit for all traffic upon the portion of such bridge which lies outside the City but within Harris County; and WHEREAS , the City Manager , based upon an engineering investigation, has ' determined that said Whispering Pines Bridge has deteriorated to the extent that the City of Friendswood should also impose a Gross Vehicle Weight Limitation of Five . (5) Tons for all traffic upon the portion of such bridge which lies within the City; now, therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS : Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct . Section 2. It shall be unlawful for any person to operate, or cause to be operated , any vehicle , as that term is defined in Tex . Rev. Civ. Stat . Ann . art . 6701 (d) , upon the Whispering Pines Bridge , as it crosses Clear Creek, within the City of Friendswood , whose gross vehicle weight exceeds five (5) tons . Section 3. This Ordinance shall not apply to official vehicles of federal, state, or local governments utilized in the performance of the duties of such governments . , • " , • ,� ��, _n� _.� _ � ' �- . . ,--. . — . � � ' � Section 4. The City Manager be, and he is hereby , author- ized and directed to erect , or cause to be erected , in accord- ance with the laws of the State of Texas , signs giving notice of the prohibitions set forth in Section 2 above. Section 5. Any person who shall violate any provision of this Ordinance, or who shall fail to observe and obey any traffic sign duly erected in accordance with this Ordinance , shall be deemed guilty of a misdemeanor and , upon conviction ttiereof, be fined in an amount not to exceed two hundred dollars ($200. 00) .
