ORDINANCE NO. 2017-15 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2016-41, PASSED AND APPROVED OCTOBER 3, 2016, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2016-2017 BY APPROVING "BUDGET AMENDMENT VII" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2016- 2017"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2016-41, the City Council of the City of Friendswood, j i Texas, adopted its "Original General Budget for Fiscal Year 2016-2017"; and WHEREAS,the City Council has determined that revenues and/or reserves are available i for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is i economically feasible and in the best interest of prudent budgeting and for municipal purposes; i and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2016-2017; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the t Fiscal Year 2016-2017," is hereby amended for municipal purposes as shown on "Budget j Amendment VII" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2016-2017" attached hereto. Said Budget Amendment VII shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and "B" and made a part hereof for all purposes. I Section 3. In the event any clause,phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. f PASSED AND APPROVED this 3rd day of April,2017. Library Book Sales and Donation, ($3,150). Reverse duplicate appropriation made on March 6, 2017 with budget amendment VI. Funding was already approved and appropriated at the February 6, 2017 Council meeting on BA V. 2. Police Department Reimbursement, $408. Appropriate funds received from Houston High Intensity Drug Trafficking Area (HIDTA) to the Police Department. The reimbursement is for activities through the month of December 2016. The funds will be appropriated to the Police Department Patrol division. i 3. Police Investigation Fund, $1,050. Appropriate asset forfeiture funds received from the current fiscal year. Funds will be appropriated to the Police Investigation ! Fund (PIF) operating services account. 4. Police Department Insurance Reimbursement, $1,486. Appropriate insurance reimbursement received for vehicle damage claims to the Police Department vehicle unit P277. Funds will be appropriated to the Police Department Patrol division budget to offset the vehicle repair expenses. Reimbursement was i received from Texas Municipal League on March 21, 2016. 5. Sales Tax Election Contest Legal Services, $15,000. Appropriate funds to cover invoices received for legal services rendered near the end of the prior fiscal year and early fiscal year 2016 —2017 related to the recently dismissed sales tax election contest case. Since the dismissal, an appeal has been filed. Therefore, staff anticipates further expenses related to this legal matter. The funding source for the additional legal expenses will be undesignated general fund balance. 6. City Website Upgrade, $1,500. Transfer funds from the Economic Development division contract services account to the Information Technology division contract services account. Funds will be utilized to upgrade the City's website. The current website design is over seven years old. The City's website plays a vital role in promoting economic development within Friendswood. The total cost of the upgrade is $4,800. The remaining funds needed to cover the cost of the upgrade will come from the Information Technology operating budget. 7. Old City Park, $10,500. Appropriate funding for design services related to the parking lot project for Old City Park. Round 2 of the bond projects included improvements to other parks as listed on proposition 3 of the voter approved May 2013 election. Funds for the expense will be appropriated from the 2016 G.O. Bond proceeds. Ord 2017-15 Exhibit A Exhibit A Page 2 8. Uninterruptible Power Supply, $924. Appropriate funding for an uninterruptible power supply (UPS) for the Council Chamber TV equipment and video editing computer. The UPS will prevent damage to the equipment and will allow ample time to properly shut down the equipment in the event of electrical power fluctuations or total electrical power failure.
