ORDINANCE NO. 2017-09
AN ORDINANCE AMENDING THE CODE OF
ORDINANCES, CHAPTER 86, BY AMENDING SECTION
86-75 ENTITLED "BACKFLOW PREVENTION AND
CUSTOMER SERVICE INSPECTIONS; AND PROVIDING
FOR SEVERABILITY.

WHEREAS, the City Council of the City of Friendswood, Texas (the "City") seeks to
promote the public health, safety, morals and general welfare of the municipality and the safe,
orderly and healthful development of the City; and
WHEREAS, the City Council finds that updates to Section 86-75(k)(4) a. are necessary
in order to conform to Texas Commission on Environmental Quality regulations for newly
constructed systems or work of any type on said existing systems in regards to the limits of lead
used for the installation or repair of plumbing at any connection which provides water for human
use; and
WHEREAS, the City Council finds and determines that the following amendment will
promote the public health, safety and welfare of the citizens of the City.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The foregoing recitals are hereby found to be true and correct and are
hereby adopted by the City Council and made a part hereof for all purposes as findings of fact.
The City Council hereby further finds and determines that the rules, regulations, terms,
conditions, provisions and requirements of this ordinance are reasonable and necessary to protect
the public health, safety and welfare of the citizens of the City.
Section 2. Chapter 86 of the Code of Ordinances entitled "Backflow Prevention and
Customer Service Inspections" is hereby amended by amending Section 86-75(k)(4) a., to read
as follows:
"Sec. 86-75.—Backflow prevention and customer service inspections.

(k) Minimum standards of a required customer service inspection. The required
customer service inspection must certify that: ,

(4) For all newly constructed systems and for any portion of an existing
system at or within view from a backflow prevention device or work of any type
performed on said existing system,the following statements are required:
a. Lead tests have been performed as required, and no pipe or pipe
fitting which contains more than " 0.2 percent lead has been
used for the installation or repair of plumbing at any connection i
which provides water for human use; and

Section 3. In the event any clause phrase, provision, sentence, or part of this
Ordinance or the application of the same to any person or circumstances shall for any reason be
adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect,
impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part
declared to be invalid or unconstitutional; and the City Council of the City of Friendswood,
Texas, declares that it would have passed each and every part of the same notwithstanding the
omission of any such part thus declared to be invalid or unconstitutional, whether there be one or
more parts.
Section 4. This ordinance shall become effective from and after its date of passage in
accordance with law.
