AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
THE CITY OF FRIENDSWOOD, TEXAS, APPENDIX C —
"ZONING," BY AMENDING THE ZONING CLASSIFICATION
FOR A TRACT OR PARCEL CONTAINING 6.081 ACRES OF
LAND PLATTED AS UNRESTRICTED RESERVE A,BLOCK 1 OF
CALVARY CHAPEL SOUTHEAST AMENDED PLAT, HARRIS
COUNTY CLERK FILE NO. 20060081527, AND A TRACT OR
PARCEL CONTAINING .583 ACRES OF LAND OUT OF
RESERVE 66G2," BLOCK 19, FOREST BEND SUBDIVISION,
SECTION 3, CITY OF FRIENDSWOOD, HARRIS COUNTY,
TEXAS; AMENDING THE ZONE CLASSIFICATION FROM
COMMUNITY SHOPPING CENTER/SPECIFIC USE PERMIT
FOR A SCHOOL (CSC/SUP 99-18) TO COMMUNITY SHOPPING
CENTER/SPECIFIC USE PERMIT (CSC/SUP) AND GRANTING A
SPECIFIC USE PERMIT FOR NAICS USE # 8131 "RELIGIOUS
ORGANIZATIONS;" PROVIDING FOR AMENDMENT OF THE
OFFICIAL ZONING MAP; PROVIDING A PENALTY IN AN
AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF
VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING
FOR SEVERABILITY.
WHEREAS, Calvary Chapel Southeast Houston is the Owner of a 6.081 acre parcel of
land platted as Unrestricted Reserve A, Block 1 of Calvary Chapel Southeast Houston Amended
Plat, Harris County Clerk File No. 20060081527, and Michael Nassif is the Owner of a .583
acre parcel of land out of Reserve "G2," Block 19, Forest Bend Subdivision, Section 3, City of
Friendswood, Harris County, Texas, as also depicted in Exhibit "A" incorporated herein by
reference, (the"Property'); and
WHEREAS, the Owners previously made application to the City to change the zoning
classification of the Property from Community Shopping Center/Specific Use Permit 99-18 for
a School (CSC/SUP 99-18) to Community Shopping Center/Specific Use Permit (CSC/SUP) to
permit the use classification NAICS use # 8131 "Religious Organizations," as depicted in
Exhibit`B", attached hereto and incorporated by reference; and
WHEREAS, the Planning and Zoning Commission and the City Council have
conducted, in the time and manner required by law and the City Code of Ordinances, a public
hearing on such request, allowing all persons attending to be heard on the question of whether
the changes of the uses being requested would affect the public health, safety, or general welfare
of the citizens of Friendswood; and
WHEREAS, the Planning and Zoning Commission has filed its written report with City
Council, which recommends approval of the application, subject to any certain conditions made
the subject of said recommendation; and
WHEREAS, the City Council deems it appropriate to grant such request, subject to
applicable regulations, restrictions, exceptions and conditions; and
WHEREAS, City Council has determined that all public notices have been posted and
published, all required hearings on this matter have been held, and that this Ordinance complies
with the applicable provisions of the City Charter, City Code and all other applicable laws;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are

hereby found to be true and correct and incorporated by reference, including the representations
of Applicants, (as referenced in its Zone Change Application), the final report from the Planning
& Zoning Commission, and the minutes of City Council, which City Council is specifically
relying upon in adopting this Ordinance, as provided hereafter.
Section 2. The Friendswood City Code, Appendix C, "Zoning," Section 3,
"Provision for Official Zoning Map," is hereby amended, rezoning the Property identified in the
attached Exhibit "A", from Community Shopping Center/Specific Use Permit 99-18 for a
School (CSC/SUP 99-18) to Community Shopping Center/Specific Use Permit (CSC/SUP) to
permit the use classification NAICS use # 8131 "Religious Organizations," for such purposes
and conditions as depicted in Exhibit `B," but otherwise consistent and subject to the current
Zoning Code, and related conditions contained therein.
Section 3. The Zoning District Map of the City of Friendswood shall be revised and
amended to show the designation of the Property, as described and as provided in Section 2
above, with the appropriate reference thereon to the number and effective date of this
Ordinance, and a brief description of the nature of the change.
Section 4. This Ordinance shall in no manner amend, change, supplement or revise
any provision of any ordinance of the City of Friendswood, save and except the change in zoning
classification of said Property as conditioned and described above. Consistent with the foregoing,
upon passage of this Ordinance, Ordinance No. 99-18 passed and adopted on July 26, 1999 is
hereby deemed repealed.
Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or
provision hereof other than the part declared to be invalid or unconstitutional; and the City

Council of the City of Friendswood, Texas, declares that it would have passed each and every
part of the same notwithstanding the omission of any and every part of the same notwithstanding
the omission of any such part thus declared to be invalid or unconstitutional, or whether there be
one or more parts.
Section 6. Any person who shall willfully, intentionally, or with criminal negligence
violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be fined in an amount not to exceed $2,000.00. Each day of violation
shall constitute a separate offense.

FIRST MODIFICATION AND RATIFICATION OF LEASE AGREEMENT
This First Modification and Ratification of Lease Agreement is made and entered into between
MICHAEL NASSIF("Landlord")and CALVARY CHAPEL SOUTHEAST HOUSTON("Tenant")for and
in consideration of ONE AND NO/100 DOLLARS($1.00)and other good and valuable consideration,receipt
of which is hereby acknowledged.
WITNESSETI-1:
i. Landlord and Tenant hereby confinn and ratify,except as modified below,all the terms,conditions and
covenants in that certain written Lease Agreement dated January 25, 2006, between Landlord and
Tenant for the rental of the property described in the Lease(the "Lease") for the rental of the
property described in the Lease Agreement.
2. It is hereby agreed between Landlord and Tenant that effective January 24,2016,the aforementioned
Lease Agreement shall be changed as follows:

Landlord a notice of Tenant's election to accept within the time required for such notice,Tenant
will be deemed to have refused the offer to sell or the right to meet the offer to purchase. If
Tenatil elects or is deemed to refuse the offer,Landlord is free to sell or accept the offer to buy
the property subject to the continuation of the leasehold estate created by this lease.

(3) Continuation of tghl. If for any reason the property is not sold by Landlord following an
offer from a third-party,the right of first refusal granted and described in the preceding section
shall continue in full force and effect,on the same terms and conditions.
D. Entire Agreement: This Lease,and the attachments,riders and exhibits thereto,constitute the
entire agreement between the parties Hereto with respect to the subject matter of this Lease. in
that regard,all written or oral understandings and agreements heretofore had or made between
the parties are merged in this Lease and in any other written agreements)made between the
parties hereto concurrently herewith and which expressly refer to this Lease ("Ancillary
Agreements)"),which Lease and Ancillary Agreement(s)alone fully and completely express
the agreement of the parties with respect to the subject matter hereof and thereof and are entered
into by the parties after full investigation and consideration. In that regard,in executing this
Lease,each party hereto unequivocally represents,acknowledges and states that such party was

EACH PARTY HERETO UNEQUIVOCALLY REPRESENTS, ACKNOWLEDGES AND
