FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR KEVIN HOLLAND MAYOR PRO-TEM JIM HILL COUNCILMEMBER STEVE ROCKEY COUNCILMEMBER 'BILLY ENOCHS COUNCILMEMBER MIKE FOREMAN COUNCILMEMBER JOHN SCOTT COUNCILMEMBER CARLGUSTAFSON CITYATTORNEY ARNOLD POLANCO CITY MANAGER ROGER ROECKER CITY SECRETARY MELINDA WELSH REGULAR SESSION Mayor Holland called the meeting to order. The invocation was given by Pastor Mike Cervantes with New Hope Church. Mayor Holland led the Pledge of Allegiance to the United States and to the State of Texas. ' COMMUNICATIONS FROM THE PUBLIC Michael Stacy, Friendswood resident, addressed Council and stated that Councilmember Scott knowingly made several false statements concerning the enforcement of City ordinances at the August 1, 2016, Council meeting, and quoted several comments Councilmember Scott made that he believes are false. Mr. Stacy further state that the City changes the rules as in the Imperial Estates Subdivision, according to Ordinance No. 2013-13, asked if Councilmember Scott was willing to say he was wrong and provided false information. Joe DeBonis, Friendswood resident, addressed Council and stated he has lived in the City of Friendswood for 41 years, believes all past Mayors and Councils have done a great job, loves the City of Friendswood and hopes it stays the way it is, does not want it to turn out like a jungle like the City of Pearland. The City of Friendswood is a nice conservative City and he hopes it stays that way, traffic is getting heavier, but there is nothing that can be done about that. The City spends money on a lot of different things, why can the City not-spend money on the Gulf Coast Connect Transit. There are a lot of elderly people in Friendswood, it will hurt the City if this benefit is not supported, a lot of cities have buses that pick residents up, Friendswood•does not, residents have to call a service to come and pick them up, has to pay someone to drive him around, and Gulf Coast Connect Transit is only asking for$2,000 a year from the City. The City has bought a bus to transport seniors back and forth from the Senior Activity Center which is a great thing, that ride is needed now more than ever, who paid the taxes when the City was young, the old homeowners supported the City, and now that they are getting older the City js denying them a little benefit. i ' Bill Hausinger, Friendswood resident, addressed Council and stated he has been a resident of the City of Friendswood for 17 to 18 years, took seven grandchildren to get him here, at the meeting to discuss the Gulf Coast Connect Transit. You must be a citizen of Friendswood to sign up for the services, only transports people from Friendswood to places they need to go, is legally blind and cannot drive, needs i 09/12/16 4605 the;service, and is $8,000 for three years. If a person only used it once a month that would be 36 times, would like Council to do something about this before the end of the month when the service is cancelled. ' WORK SESSION Mayor Holland opened the discussion regarding the City's proposed Fiscal Year 2016-2017 General Fund Budget. Administrative Services Director Cindy Edge presented a PowerPoint presentation regarding the focus of the budget development, Fiscal Year 2017 total revenue of$52.7 Million, Fiscal Year 2017 total expenditures of$45.8 Million; General Fund revenue of$26.1 Million, Scenario No. 1 tax rate of$0.5460 approximately $0.011232 above the'Effective Tax Rate, Scenario No. 2 is the Effective Tax Rate of $0.5348, General Fund expenses of $26.1 Million, tax bill impact to the average homeowner, General Fund Forces At Work total of $279,712, General Fund Decision Packages of $1,700,917, Water and Sewer Fund revenues of$11.4 Million,Water and Sewer Fund Expenses of$12 Million,Water and Sewer Fund Forces at Work total of$152,317, Water and Sewer Fund Decision Packages total of$52,829, and a proposed tax rate comparison of neighboring cities. City Manager Roger Roecker.stated that the City is in litigation contesting the recent election regarding sales tax; and the City will not be able to collect until the matter is resolved. Mayor Holland opened the discussion regarding City facilities and park security measures. Parks and Recreation Director James Toney presented a PowerPoint presentation regarding the need to upgrade City facilities and park security measures. In March 2016, Police Chief Bob Wieners presented to Council the .need to upgrade the City's security procedures to become Criminal Justice Information Services (CJIS) compliant. During the discussion in March 2016, several areas were outlined which required the City to upgrade or replace.several security measures at that time, which included upgrades to the City's Encrypted Virtual Private Network (VPN) infrastructure, prevention of eavesdropping, providing support for Windows XP required by CJIS, and upgrade citywide personnel security measures. Staff was also ' required to upgrade the City's fiber connection, replace mobile data computers, and replace the Public Safety Building's (PSB) security.system to be CIJS compliant. Total cost to implement the approved upgrades/replacements was estimated at $78,500. Police Chief Wieners indicated Staff would be back before Council in the near.future to discuss the second phase associated with maintaining CJIS compliance as it relates to City facilities and parks. It is necessary to take advantage of software and hardware improvements that have recently been put into effect to bring all City facilities and parks under one security umbrella. As a result of current PSB software and hardware, Staff will have the option, if approved by Council, to allow all security measures at various City locations to be appropriately viewed and maintained at the PSB to remain CJIS compliant. Only minimal hardware upgrades/replacements would be required since the backbone of the security measures are already installed and located at the PSB. This upgrade/replacement would allow the Police Department the opportunity to view live footage of security events in order to better respond and resolve situations at various City facilities. Security measures funding'options are to do nothing, approve funding for the current fiscal year and take full advantage of the new security system, or consider phasing funding over the next three fiscal years. The estimated cost is$11,300 per facility. Further discussion took place between Mayor, Council, and Staff in regard for Staff to develop a plan and present the item as a Decision Package during budget planning for Fiscal Year 2017-2018. Mayor Holland opened. the discussion regarding fencing and residential lots. Assistant City Manager Morad Kabiri stated the agenda item was brought to Council by Councilmember Scott. The City's current Zoning Ordinance stipulates that if a person owns a two-acre lot, except for lots fronting a Texas Department of Transportation (TxDOT). roadway, the property can be fenced beyond the front building line, allowed to fence the perimeter of their property, if property is on a TxDOT roadway the two-acre limitation does not apply. There are a number of lots throughout the City that do not meet the two-acre threshold, and at the end of the day beauty is in the eye of the beholder. There was a recent case denied ' by the.Zoning Board of Adjustment, case was debated by the Planning and Zoning Commission who decided to leave the Zoning Ordinance as is for fear of unintended consequences. Staff needs guidance from Council if there is any desire to change the code. 09/12/16 4606 Discussion took place between Mayor, Council, and Staff regarding the consensus of Council to amend) the Zoning Ordinance to state two-acres or more than 120 feet of frontage requirement for decorative fencing, and Staff will bring the item back to Council for approval. Mayor Holland opened the discussion regarding an update on Capital Projects. Director of Public Works/City Engineer Patrick Donart presented a PowerPoint presentation regarding the progress made on Capital Projects since the August Council meeting. He reported on the library expansion project, Fire Station No. 4 expansion and the new fire station headquarters, Sportspark improvement projects Centennial Park improvements, Lake Friendswood project, conceptual plans for Old City Park, Round 1 Street Improvement project, Whispering Pines/Friendswood Link Road Expansion project, Lift Station No. 3, 18, and 23, reconstruction of Water Plant No. 2 and 7, and the Blackhawk Waste Water Treatment Plant. Further discussion took place between Mayor, Council, and Staff. The consensus of Council regarding the conceptual plans for the development of Old City Park was for Staff to proceed with Conceptual Plad A that would include two-way traffic and keeping the horse arena. CLOSED EXECUTIVE SESSION Mayor Holland asked if anyone would like to speak regarding the Executive Sessions. No one spoke. Council convened into Executive Session in accordance with the Texas Government Code, pursuant to Section 551.071 — Consultation with Attorney regarding contemplated litigation (Robert J. Bertrand, et al v. City of Friendswood) and Section 551.071 — Consultation with Attorney regarding pending claims against Olson & Olson, LLP, arising from settlement of legal action. ' RECONVENE INTO OPEN SESSION Council reconvened into Open Session with no action taken later in the meeting. With concurrence of Council, Mayor Holland moved to Agenda Item 12, City Manager's Report. CITY MANAGER'S REPORT City Manager Roger Roecker reported that the 33rd Annual National Night Out, a unique crime/drug prevention, community building event sponsored by the City of Friendswood, has been scheduled for Tuesday, October 4, 2016. National Night Out is designed to heighten crime and drug prevention awareness, generate support for and participation in local anti-crime programs, strengthen neighborhood spirit and police-community partnerships, and send a message to criminals letting them know that neighborhoods are organized and fighting back. To join in on National Night Out get your neighbors to turn their porch lights on, organize a block party or some type of neighborhood event, fill out and return an application to Officer Kevin Crouch at the Friendswood Police Department. The City Manager reported that Value Penguin's latest compilation of Safest Cities to Live in Texas has the City of Friendswood listed at number three among cities with 20,000 to 50,000 in population and first in the Houston Metro Area, based on the most recent Federal Bureau of Investigation (FBI) Crime Report numbers for all 217 Texas cities. The City is grateful for the partnership the Police Department has been able to develop with residents, the youth sports organizations, and the business community. This partnership has assisted in developing a community that works together to make the City a safer place. The City Manager reported that the City of Friendswood has received its second Investment Policy ' Certificate of Distinction from the Government Treasurers' Organization of Texas (GTOT). The City was commended for its continued commitment to maintaining a comprehensive written investment policy that is compliant with the Texas Public Funds Investment Act (PFIA) and meets the criteria set forth in the GTOT Investment Policy Review Checklist. This recognition is for a two-year period ending August 31, 09/12/16 4607 2018: To earn the GTOT Investment Policy Certificate of Distinction, an organization must submit its adopted investment policy and identify where each PFIA regulation is addressed in the organization's investment policy. The GTOT Investment Policy Review Committee determines if an organization's investment policy meets the established criteria and offers suggestions for policy improvements, as needed. The City Manager reported that a City dog park has been on the drawing board for five years. Staff applied for and was awarded $25,000 by the PetSafe Bark for Your Park program. PetSafe is developed out of Tennessee and makes, pet behavioral, containment, and lifestyle product solutions. The City of Friendswood is one of five communities that will receive $25,000 which is part of the $250,000 PetSafe Bark for Your Park dog park grants given nationwide this year. Council has also allocated funds to the project along with Caden Fischer a Friendswood High School student who has made this his Eagle Scout Project, and he has raised over $16,000. The City will be presented with a $25,000 grant award on September 16, 2016, at Stevenson Park. The evening will also include a concert from Velvet Punch, pet portraits, food trucks,L and door prizes; The dog park will be located in Old City Park, during the events on September 16, 2016, there'will be a ribbon cutting ceremony for the new bridge that links Old City Park and Stevenson Park together over Cowards Creek. With concurrence of Council, Mayor Holland moved to Agenda Item 8, Special Recognition and Acknowledgements. SPECIAL RECOGNITION AND ACKNOWLEDGEMENTS Mayor Holland administered the Ceremonial Oath of Office to the Board of Directors of the Friendswood Downtown Economic Development Corporation, and members present were Arden Hill, Patrick McGinnis, Paul Marx and Bubba Johnson. City Manager Roger.Roecker presented the Five Star Spirit Award for the second quarter of 2016 to ' Sergeant Anthony Aprile and Officer Carlos Granillo with the City's Police Department. Over the Memorial Day weekend, Sergeant Aprile and Officer Granillo were dispatched to an elderly resident's home after she had lost her longtime companion, 011ie the Beagle. Due to the holiday weekend, she could not get anyone to pick up the dog and was understandably upset. Officers Aprile and Granillo not only.consoled the resident, but helped her dispose of her pets remains, giving her much comfort. They left the residence and returned with a sympathy card. Sergeant Aprile and Officer Granillo certainly exemplified the attributes of the Five Star Spirit Award which are — Courteous, Competent, Reliable, Professional, and Enthusiastic. In addition they have shown their willingness to step up and take action, while showing compassion for others. Keep Friendswood Beautiful Committee Chair Sherry Goen recognized Parks & Recreation Department employee Paul Stacy for his efforts in saving the crepe myrtles removed from the FM 518 medians. The crepe myrtles were placed around other.City facilities where they could thrive. Mr. Stacy came up with different ideas to water the trees and he watched over them every day, devised a PVC pipe system to keep the trees at the Sportspark irrigated, and Keep Friendswood Beautiful is extremely grateful to Mr. Stacy and the City for all their efforts. With concurrence of Council, Mayor Holland moved to Agenda Item 20, Communications from the Mayor and Councilmembers. COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS Mayor Holland read a letter from United States Senator John Cornyn regarding the 15'h anniversary of the attack on America on September 11, 2001, "out of that tragedy rose countless American Heroes and those heroes have come to define part of the spirit and the soul of the United States of America, so while ' it is inevitable, that the 151h anniversary of September 11, 2001, we recall somber memories, it is right to also remember the unity born that faithful day." 09/12/16 4608 Councilmember Enochs stated since September 11, 2001, over 7,000 service members have given their life in the fight trying to keep anything like that event from happening again on the country's home front. Even though it has been 15 years the fight continues, and Americans cannot forget and must stay unified. Councilmembers Rockey, Hill, Foreman, Scott, and Gustafson stated they had nothing to report. With concurrence of Council, Mayor Holland moved to Agenda Item 11, Communications from the Public. COMMUNICATIONS FROM THE PUBLIC Ruth Pifer, Friendswood resident, addressed Council and stated she is in favor of the Sunmeadow Subdivision, but is opposed to the development of Friendswood Trails. David Allen, Friendswood resident, addressed Council and stated he was at the meeting to speak regarding inspiring local resilience on a global scale, need to look out for locals being contacted by people in the United Nations (UN), making UN rules for local police who should be under constitution rules, the best practice is the Bill of Rights, police officers are currently sworn to uphold the Bill of Rights, and UN is trying to get control away from citizens. Pasadena Independent School District and Friendswood Independent School District are tied down by federal regulations, are not independent anymore, cannot decide what*books to use, or how to teach, hands are completely tied, the UN is trying to do the same thing to police. Laurie Salomon, Friendswood resident, addressed Council and stated she would like more information on why rezoning is necessary on West Winding Way for Good Shepard Church, and she lives next door! Mayor Holland stated the rezoning item had been removed from the agenda per the request of the applicant.. Ms. Salomon asked for confirmation in writing, and the Mayor informed her that it had been decided to not move forward at this time per the applicant. I ' Richard Wolff, Friendswood resident, addressed Council and stated he was at the meeting to discus) Gulf Coast Connect Transit, is aware they have requested funds from Council, and the company provides transportation for disabled and elderly citizens that makes use of the ride program. His son has used the company for the past couple of.years, which has allowed him to function at a higher level due to him not being able to drive or get out on his own. Mr. Wolff asked Council to consider providing funds for the program, provided Council with a letter that was sent to participants from Gulf Coast Connect Transit, it states plans of the program being terminated at the end of September 2016. With concurrence of Council; Mayor Holland moved to Agenda Item 10,Joint Public Hearings. JOINT PUBLIC HEARINGS Mayor Holland and Planning and Zoning Commission Chair David O'Farrell called a Joint Public Hearing to order to receive comments from the public, both oral and written regarding a zone classificatioh change request for a .18.acre tract of land being the remainder of a called Reserve D, Block 1, Park 518 Reserve "B" Replat and Addition, property located at 212 East Parkwood Avenue, Friendswood, Galveston County, Texas, to change from_Community Shopping Center (CSC) to Community Shopping Center/Specific Use Permit(CSC/SUP)to allow NAICS No. 517 Telecommunications. Deputy Director of Community Development/Planner Aubrey Harbin explained the request. Verizon Wireless would be the owner of the tower and others could come on as tenants. The applicant is at thel meeting to explain or answer any questions. Discussion took place between Mayor, Council, Planning and Zoning Commission members, and Greg ' Gow, representative from Verizon Wireless, in regards to the proximity of the cell tower to the Polly Ranch air strip, height of the cell tower will be 130 feet, and applicant has received clearance from the Federal Aviation Administration (FAA). 09/12/16 4609 Planning and Zoning Commission Chair O'Farrell asked if anyone would like to speak in favor of the request. No one spoke. Planning and Zoning Commission Chair O'Farrell asked if anyone would like to speak in opposition of the request. .Pat McGinnis, Friendswood resident, stated he was opposed to the request, is not the best decision to put a tall tower in.line with an active runway, an alternate location would be better, would be glad to work with the City and applicant to find an alternative location. Dave Forster, Friendswood,resident, stated he was opposed to the rezoning request, provided Council with handouts of a diagram of the proposed communication tower, location proposed is directly in line with the Polly Ranch runway, and read Federal Aviation Administration (FAA) guidelines. Al Saylor, Friendswood resident, stated he is a pilot and professional skydiver, and lives in Polly Ranch which has been around since the 1950's. He stated he requested the City help Verizon Wireless relocate their tower due to the amount of activity and contributions the Polly Ranch runway provides, and Life Flight has used their airstrip several times as has the Coast Guard and Coast Guard Auxiliary. Planning and Zoning Commission Chair O'Farrell adjourned the Planning and Zoning Commission's portion of the Joint Public Hearing. Mayor Holland adjourned Council's portion of the Joint Public Hearing. Mayor Holland stated the zone classification change request for 4.773 acres of land out of Lot 14, property located at 1208 West Winding Way (also known as 1207 West Winding Way), Harvey and Stout Subdivision, Friendswood, Galveston County, Texas, to change from Single Family Residential (SFR) to Community Shopping Center (CSC); keeping current Specific Use Permit for "Religious Organizational ' Purposes" had been pulled per the applicant. With concurrence of Council, Mayor Holland moved to Agenda Item 9, Public Hearing. PUBLIC HEARING Mayor Holland called a Public Hearing to 'order to receive comments from the public, both oral and written, regarding the proposed Fiscal Year 2016-2017 General Operating Budget for the City of Friendswood. Mayor Holland asked if anyone would like to speak in favor of or in opposition to the proposed Fiscal Year 2016-2017 General Operating Budget for the City of Friendswood. No one spoke. With concurrence of Council, Mayor Holland moved to Agenda Item 13, Discussion and possible action regarding approving appointments/reappointments to Boards and Commissions. ACTION ITEMS **Councilmember Scott moved to approve the appointment of Kirk Lippert to the Charter Review Commission to fill a vacancy with a term to expire March 2016; appointment of Katie O'Farrell Travis to the Keep Friendswood Beautiful Committee to fill a vacancy with a term to expire November 2017 and the appointment of Shawn' Potter to the Keep Friendswood Beautiful Committee with a-term to expire November 2019; and appointment of Mona Palmer to move from alternate member to regular member of the Senior Citizens Advisory Committee to fill a vacancy with a term to expire November 2019. Seconded by Councilmember Hill. The motion was approved unanimously. **Councilmember Hill moved to approve the appointment of Frank Harper to the West Ranch ' Management District Board to fill a vacancy to an unexpired term ending June 1, 2019. Seconded by Councilmember Foreman. The motion was approved unanimously. 09/12/16 46101 With concurrence of Council, Mayor Holland moved to Agenda Item 11, Communications from the Public. COMMUNICATIONS FROM THE PUBLIC (continued) Caden Fischer, addressed Council and stated he is helping the City build a dog park for his Eagle Scout project, and funding received so far from various donors and events equals a little over$16,000. The dog park will include two separate fenced areas, one for large dogs and one for small dogs, covered trash and recycling bins, waste station, three water fountains, plumbing, benches, repurposed fire hydrants and culverts for dogs to play. The next step is to complete the cost estimates, waiting on complete cos{ estimates for irrigation, the front entrance, plumbing, trees, trashcans, and signage. He stated he will continue and possibly complete fundraising efforts by the end of winter, and construction should take six months to a year. ACTION ITEMS (continued) "Councilmember Foreman moved to approve the proposed Harris County Mayors' and Councils' Association Rules and Bylaws changes. Seconded by Councilmember Rockey. The motion was approved unanimously. "Councilmember Scott moved to adopt the Effective Tax Rate of$0.534757. Seconded by Councilmember Hill. The motion failed 2-5 with Mayor Holland, Councilmembers EnOChs Rockey, Foreman, and Gustafson opposed. Discussion took place between Mayor, Council, and Staff regarding the pros and cons of the proposed adoption of the Effective Tax Rate, and the Decision Packages that would not be funded. ' Councilmember Rockey moved to approve Scenario No. 1, with a tax rate of$0.5460. Seconded by Councilmember Foreman. '""Mayor Holland moved to amend the main motion to approve Scenario No. 1, with tax rate of$0.5460, split in half the Pavement Management Study cost and include the Fire Department bunker gear for $10,000, SCBA replacement program for$9,000, firefighter training funds for$10,000, and replace non- capital equipment for Fire Division for$10,000. Seconded by Councilmember Foreman. The amended motion was approved 5-2 with Councilmembers Hill and Scott opposed. "Councilmember Foreman moved to approve scheduling Special Council meetings to hold publi hearings for the proposed tax rate for Fiscal Year 2016-2017. Seconded by Councilmember Rockey. The motion was approved 5-2 with Councilmembers Hill and Scott opposed. City Manager Roger Roecker stated the Special meetings would be scheduled for September 26, 2016, and September 29, 2016. RESOLUTIONS *'Councilmember Rockey moved to approve Resolution R2016-12 — A resolution of the City Council of the City of Friendswood, Texas, approving the Seventh Bond Issuance of the West Ranch Management District, for the proposed amount of$3,500,000. Seconded by Mayor Holland. The motion was approved 6-1 with Councilmember Gustafson opposed. "Councilmember Rockey moved to approve Resolution R2016-17 — A resolution of the City of ' Friendswood, Texas, in support of the application to the Texas Commission on Environmental Quality for a Municipal Settings Designation for 900 and 902 Gemini Street, Webster, Texas, also known as Lot 3A and Lot 4, Block 17 of the Clear Lake City Industrial Park, Webster, Harris County, Texas.; finding that the 09/12/16 4611 meeting at which this resolution is passed is open to the public as required by law; requiring notice of this resolution to the company and legal counsel. ' Seconded by Mayor Holland. The motion was approved unanimously. ORDINANCES **Councilmember Hill moved to approve the Second and Final reading of Ordinance No. 2016-19 with amendments to Exhibit B —An ordinance amending Appendix "C" "Zoning", of the Code of Ordinances of the City of Friendswood, Texas, Section 3, "Provision for Official Zoning Map", rezoning the property generally consisting of 261.09 acres from Single-Family Residential (SFR) and Multi-Family Residential- Medium Density (MFR-M) to Planned Unit Development (PUD) and consisting of 2.238 acres from Multi- Family Residential-Medium Density (MFR-M) to Neighborhood Commercial (NC), situated in the William Henry Survey, A-84 & the Mary Sloan Survey, A-184, Galveston County, Texas, and the R.A. Magee Survey, A-349 & the H. Stevens Survey, A-595, Brazoria County, Texas, more fully described in Exhibit "A", incorporated by reference, with such Planned Unit Development (PUD) to be governed for all purposes and conditions,pursuant to the attached Conceptual Plan included in Exhibit "B", all as more specifically provided herein; providing for the amendment of the Official Zoning Map; providing a penalty in an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability. Seconded by Councilmember Foreman. The motion failed 1-6 with Mayor Holland and Councilmembers Enochs, Rockey, Foreman, Scott, and Gustafson opposed. Councilmember Hill stated his proposed amendments to Exhibit B were to guarantee the horseshoe tract would remain open space maintained by the Friendswood Trail Homeowner's Association (HOA) or any other third party; any proposed park improvements.would be planned at a future date, the proposed drainage system and four ponds would accommodate a 100 year storm event, buffer areas between Sunmeadow Subdivision and Friendswood Trails shall include engineer drainage improvements to ' accommodate the existing sheet flow, such improvements shall be included in the ATC-RAS model for the overall development. Additionally, the bottom cord of any new bridges installed over Chigger Creek shall be two foot above the 100 year water surface elevation of the creek. The first phase will consist of construction of a four lane boulevard roadway section from FM 528 to Chigger Creek. The storm water detention east of Chigger Creek should have engineer drainage improvements to the 47 acre horseshoe tract to accommodate a 100 year storm event. Section One and Two shall consist of 64 — 55 foot wide lots. As market demand dictates, Phase 2 will consist of a four lane boulevard bridge section over Chigger Creek. At a minimum all residential lots shall have a two car garage.
