R2000-28 RESOLUTION OF THE CITY OF FRIENDSWOOD AUTHORIZING INTERVENTION 1N THE TEXAS-NEW MEXICO POWER COMPANY AND RELIANT ENERGY HL&P'S TRANSMISSION AND DISTRIBUTION RATE CASES AT THE PUBLIC UTILITY COMMISION OF TEXAS, DOCKET NOS. 22349 AND 22355, RESPECTIVELY; AUTHORIZING THE JOINING WITH OTHER INTERVE1vING CITIES TO PROTECT MUNICIPAL AND RATEPAYER 1NTERESTS; AUTHORIZING THE HIRING OF ATTORNEYS AND CONSULTANTS; AND REQUIRING REIMBURSEMENT OF THE CITIES' RATEMAKING COSTS WHEREAS, the City of Friendswood is a regulatory authority under the Pliblic Utility Regulatory Act (PURA) and has exclusive original jurisdiction over the rates and services of Texas-New Mexico Power Company (TNMP) and Reliant Energy HL&P (HL&P) within the municipal boundaries of the city; and WHEREAS, pursuant to PURA § 39.201, TNMP and HL&P filed applications with the Public Utility Commission (PUC) on or about March 31, 2000 to establish transmission and distribution utility rates to become effective January 1, 2000; WHEREAS, HL&P's filing (Docket No. 22355) and TNMP's filing (Docket No. 22349) request nonbypassable delivery charges, including competition transition charges to collect estimated stranded costs; WHEREAS, the charges established by the PUC have the potential to hinder the development of competition within the municipal boundaries of the City of Friendswood; and WHEREAS, pursuant to PURA § 33.025, the City of Friendswood has standing to intervene in PUC proceedings relating to the provision of electric service to the City. WHEREAS, the interests of the City of Friendswood and the electric customers residing within municipal boundaries can be protected most effectively by coordinating with other cities served by TNMP and HL&P. 1670\03\oth000426gmg 1 NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,TEXAS: Section 1. The City is authorized to intervene in TNMP and HL&P's transmission and distribution rate cases filed at the Public Utility Commission of Texas, Docket Nos. 22349 and 22355, respectively. Section 2. The City is authorized to join other cities served by TNMP and HL&P and to create Steering Committees to coordinate efforts to protect the interests of the City of Friendswood and protect the interests of TNMP and HL&P customers residing and conducting business within municipal limits. Section 3. Subject to the right to terminate employment at any time, the City of Friendswood hereby authorizes the hiring of Geoffrey Gay and the law firm Lloyd, Gosselink, Blevins, Rochelle, Baldwin & Townsend, P.C. and other qualified consultants, to be selected by the Steering Committees, to review the TNMP and HL&P filings, to represent the City of Friendswood at the PUC and to prosecute any appeals as directed by the Steering Committees. Section 4. Fees and expenses incurred by the City of Friendswood in this ratemaking matter shall be promptly reimbursed by TNMP and HL&P. PASSED, APPROVED AND RESOLVED this ls`day of May, 2000.
