ORDINANCE NO. 2016-40 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2015-27, PASSED AND APPROVED OCTOBER 5, 2015, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2015-2016 BY APPROVING "BUDGET AMENDMENT XI" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2015- 2016"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2015-27, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2015-2016";.and WHEREAS,the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2015-2016; i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2015-2016," is hereby amended for municipal purposes as shown on "Budget Amendment XI to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2015-2016" attached hereto. Said Budget Amendment XI shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and "B" and made a part hereof for all purposes. Section 3. In the event any clause,phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Police Department Vehicle Insurance Reimbursement, $7,912. Appropriate insurance reimbursements received from Texas Municipal League Intergovernmental Risk Pool. Funding will be appropriated to the Police Department Patrol division vehicle maintenance account for repairs made to units P275 and P282. 2. Parks.& Recreation Vehicle Insurance Reimbursement, $1,561. Appropriate insurance reimbursements received from Texas Municipal League Intergovernmental Risk Pool. Funding will be appropriated to the Parks division vehicle maintenance account for repairs made to unit CS12. 3. Chapter 380 Economic Development Grant, $10,000. Appropriate undesignated general fund balance for Chapter 380 Economic Development Grant reimbursement. On January 15, 2016, the City of Friendswood and Destination Holdings, LLC signed the economic development agreement for a business incentive grant to help defray a portion of the costs of construction and development of a new 9,318 square feet commercial building, located at 3800 East FM 528 and to make exterior renovations to an existing 10,384 square feet commercial building at 3736 East FM 528. The agreement granted reimbursement to the Developer for an amount not to exceed $10)000. 4. Library Renovation Donation, $1,050. Appropriate donation received in honor of Dr. John A. Hart, Jr. The donation will be used to purchase a reading chair and ottoman that will be placed in the reading area. Funds will be appropriated to the operating expense account for the Library renovations.
