R2000-06 A RESOLUTION OF THE CITY OF FRIENDSWOOD, TEXAS, PROVIDING FOR THE REIMBURSEMENT OF COSTS ASSOCIATED WITH THE OVERSIZING OF CERTAIN PUBLIC IMPROVEMENTS IN AUTUMN CREEK DEVELOPMENT. � ,� * � � � * � * WHEREAS, Texas Local Government Code Chapter 212 provides that cities may participate in the payment of construction costs for oversizing of public improvements where a private developer wants to construct and install certain improvements; and WHEREAS, Friendswood Development Company has constructed and installed certain public improvements within its Autumn Creek development, and has oversized such improvements for future developments within the City of Friendswood; and WHEREAS, the City of Friendswood has, by previous motion, authorized the expenditure of funds for these improvements through the sale of water and sewer bonds; and WHEREAS, the City of Friendswood believes there is a significant public benefit and purpose to reimbursing Friendswood Development Company for such oversizing, and wishes to make such reimbursement so that the public will receive the benefits of increased water and sewer capacity; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. Friendswood Development Company has heretofore installed a certain twelve inch sanitary sewer force main and related appurtenances in connection with the installation and construction of subdivision improvements required by the City ` � of Friendswood for its Autumn Creek Development, as that development is shown and described on those subdivision plats filed of records in the Galveston County Plat Records under that name. Friendswood Development Company further oversized such improvements beyond what was required for its developments at the request of the City. Section 2. The City Engineer has reviewed the bids, the contracts, the final construction costs, and has made periodic inspections under the City Code to inspect the construction and the work completed, and has recommended to the City Council that all work has been done in accordance with City ordinances and requirements, and that the City Council should accept the improvements on behalf of the public. Section 3. The City of Friendswood, Texas, by and through its governing body, and having read the reports of the City Engineer as to the satisfactory completion of the described improvements, does hereby authorize the reimbursement of an amount not to exceed One Hundred, Eleven Thousand, Seven Hundred and Two Dollars and Ninety Cents ($111,702.90).
