ORDINANCE NO. 2016-29
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF FRIENDSWOOD, TEXAS, CONFIRMING AND
VALIDATING THE LEVY AND COLLECTION OF A
SALES AND USE TAX OF ONE-EIGHTH (%8) OF ONE
PERCENT TO PROVIDE REVENUE FOR THE BENEFIT
OF A TYPE B CORPORATION, AS AUTHORIZED BY
CHAPTER 505 OF THE TEXAS LOCAL GOVERNMENT
CODE; PROVIDING FOR A REPEALER, FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE IS PASSED WAS NOTICED AND IS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Section 505.251 of the Texas Local Government Code authorizes eligible
municipalities to call an election for the imposition of a sales and use tax for the benefit of a
Type B corporation; and
WHEREAS, such election called by Ordinance No. 2016-09 occurred on May 7, 2016,
to submit the question to the voters on the levy and collection of a sales and use tax within the
City of Friendswood, Texas at the rate of one-eighth ('/8) of one percent to be used to undertake
projects authorized under Chapter 505 of the Local Government Code, to promote new or
expanded business enterprises in the downtown area as defined by the City of Friendswood
Downtown District Map, including but not limited to sheets, targeted infrastructure, paved
sidewalks, pedestrian amenities including lighting, benches, signage, and other related public
improvements, and the maintenance and operations expenses for any of the above-described
projects; and
WHEREAS, the voters of the City of Friendswood voted for and passed the imposition
of a sales and use tax of one-eighth (%) of one percent in the City of Friendswood to provide
revenue for the put-poses authorized under Chapter 505 of the Local Government Code as
heretofore stated, as canvassed and acknowledged in Resolution No. 2016-10;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
Section 1. That there be, and there is hereby, levied and shall be collected a sales and
use tax of one-eighth(y8) of one percent from the sale and use of all taxable items within the City of
Friendswood to be used to undertake projects authorized under Chapter 505 of the Local
Government Code, to promote new or expanded business enterprises in the downtown area as
defined by the City of Friendswood Downtown District Map, including but not limited to streets,
targeted infrastructure, paved sidewalks, pedestrian amenities including lighting, benches,
signage, and other related public improvements, and the maintenance and operations expenses
for any of the above-described projects.
Section 2. That such tax will be effective, imposed, computed, administered, and
collected in accordance with the provisions of Chapter 505 of the Texas Local Government Code
and Chapter 321 of the Texas Tax Code, as amended.
Section 3. That all ordinances or pants of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 4. That the City Secretary is hereby authorized and directed to submit to the
Texas State Comptroller of Public Accounts by United States certified or registered mail, a
certified copy of this Ordinance, along with a certified copy of Resolution No. 2016-10, along
with a map of the City, clearly showing the boundaries of the City, as required by Section
321.405 of the Texas Tax Code.
Section 5. That it is hereby further found and determined that the City Secretary
posted written notice of the date, place and subject of the meeting at which this ordinance was
introduced and passed on the bulletin board located in the City Hall, a place convenient and
readily accessible to the general public, and such notice having been so posted and remaining
posted continuously for at least seventy-two (72) hours preceding the scheduled time of such
meeting.
