HomeMy WebLinkAboutOrdinance No. 2016-28 (Title: An ordinance validating the levy of street maintenance sales and use tax) ORDINANCE NO. 2016-28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, CONFIRMING AND VALIDATING THE LEVY AND COLLECTION OF A SALES AND USE TAX OF THREE-EIGHTHS (%) OF ONE PERCENT TO PROVIDE REVENUE FOR THE MAINTENANCE AND REPAIR OF MUNICIPAL STREETS, AS AUTHORIZED BY CHAPTER 327 OF THE TEXAS TAX CODE; PROVIDING FOR A REPEALER, FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED WAS NOTICED AND IS OPEN TO THE PUBLIC AS REQUIRED BY LAW. * * * * * * Y * X * * * * * * * * WHEREAS, Section 327.006 of the Texas Tax Code authorizes municipalities to call an election for the imposition of a sales and use tax for street maintenance; and WHEREAS, such election called by Ordinance No. 2016-05 occurred on May 7, 2016, to submit the question to the voters on the levy and collection of a sales and use tax within the City of Friendswood, Texas at the rate of three-eighths C18) of one percent to be used to provide revenue for the maintenance and repair of municipal streets; and WHEREAS, the voters of the City of Friendswood voted for and passed the imposition of a sales and use tax of three-eighths (%) of one percent in the City of Friendswood to provide revenue for the maintenance and repair of municipal streets, as canvassed and acknowledged in Resolution No. 2016-10; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. That there be, and there is hereby, levied and shall be collected a sales and use tax of three-eighths C18) of one percent from the sale and use of all taxable items within the City of Friendswood to be used to provide revenue for the maintenance and repair of streets within the City of Friendswood,Texas. Section 2. That such tax will be effective, imposed, computed, administered, and collected in accordance with the provisions of Chapter 327 of the Texas Tax Code, as amended. Section 3. This sales and use tax will expire on the fourth anniversary of the date the tax takes effect in accordance with the terms of Section 327.005 of the Texas Tax Code. Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. That the City Secretary is hereby authorized and directed to submit to the Texas State Comptroller of Public Accounts by United States certified or registered mail, a certified copy of this Ordinance, along with a certified copy of Resolution No. 2016-10, along with a map of the City, clearly showing the boundaries of the City, as required by Section 321.405 of the Texas Tax Code. Section 6. That it is hereby further found and determined that the City Secretary posted written notice of the date, place and subject of the meeting at which this ordinance was introduced and passed on the bulletin board located in the City Hall, a place convenient and readily accessible to the general public, and such notice having been so posted and remaining posted continuously for at least seventy-two (72) hours preceding the scheduled time of such meeting.
