R2002-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, ESTABLISHING THE MAXIMUM FEES TO BE CHARGED BY AUTO WRECKER SERVICES IN PERFORMING POLICE AUTHORIZED AND NONCONSENT TOWS WITHIN THE CITY OF FRIENDSWOOD. � � � * * WHEREAS, the City Council of the City of Friendswood, Texas (the"City") passed and adopted an ordinance establishing regulations for wrecker services performing police authorized and nonconsent tows within the City on the 1 st day of July, 2002; WHEREAS, the ordinance required the City Council to establish the maximum rates that can be charged by an auto wrecker service performing police authorized and nonconsent tows within the City; and WHEREAS, the City Council of the City desires to establish such rates; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The City of Friendswood, Texas, hereby establishes the following fee schedule setting forth the maximum rates an auto wrecker service shall be permitted to charge for police authorized and nonconsent tows within the City. Such fees shall be set forth in Appendix D of the Friendswood City Code. The fee schedule shall be as follows: a. The standard auto wrecker service charge for towing a vehicle to a vehicle storage facility or to the place of business of the auto wrecker, shall not exceed eighty-five and no/100 dollars ($85.00); provided, however, if the destination of the tow exceeds fifteen (15) miles from the point where the wrecker picked up the tow, the operator shall be permitted to charge an additional fee not to exceed two and no/100 dollars ($2.00) for each mile towed in excess of fifteen (15) miles. This charge shall apply whether the tow is performed during the day, at night, on a Saturday or Sunday, or on a holiday. If the police department requires the vehicle to be moved from the location to which it was originally towed to another location within the City, an additional fee, not to exceed thirty and no/100 dollars ($30.00),may be charged for transferring the vehicle. b. The service charge for a heavy-duty wrecker performing police- authorized or nonconsent tows, where the services of a heavy-duty wrecker are required, shall not exceed one hundred twenty-five and no/100 dollars ($125.00) per hour, with a one (1) hour minimum. The time shall begin at the time of dispatch and end when the vehicle is delivered to the vehicle storage facility or designated location. 1 c. The service charge for removal and replacement of a tire and wheel assembly required to tow a vehicle shall not exceed twenty and no/100 dollars ($20.00). d. The service charge for righting an overturned vehicle on level ground shall not exceed fifty and no/100 dollars ($50.00). e. The service charge for placement of a vehicle on a dolly or dollies in order to tow the vehicle shall not exceed one hundred and no/100 dollars ($100.00). f. The service charge for towing a motorcycle shall not exceed one hundred and no/100 dollars ($100.00). g. The charge for up to two (2) hours work on specialized recoveries of vehicles that are submerged, or in dif�cult terrain, or in other abnormal locations shall not exceed one hundred twenty-five and no/100 dollars ($125.00); provided, however, if any such specialized recovery takes more than two (2) hours, the charge shall not exceed sixty-five and no/100 dollars ($65.00) per hour. h. The charge for or the storage, preservation, and any required notifications required of the permitted wrecker operator shall not exceed those charges established from time to time by the Texas Department of Transportation, pursuant to the Texas Vehicle Storage Facility Act, as amended, Section 685.001, et. seq., Texas Transportation Code. Section 2. The fee schedule approved and adopted in Section 1 hereof shall be effective from the date this resolution is passed. PASSED, APPROVED, and RESOLVED this 1�` day of July, 2002.
