HomeMy WebLinkAboutResolution No. 2002-29 RESOLUTION NO-.1Z2.(� A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A SPECIAL ELECTION HELD ON MAY 4, 2002, REGARDING A PROPOSITION TO AUTHORIZE THE IMPOSITION OF A ONE-HAI.F OF ONE PERCENT SALES AND USE TAX PURSUANT TO SECTION 4B OF ARTICLE 5190.6, TEXAS REVISED CIVIL STATUTES (THE "DEVELOPMENT CORPORATION ACT OF 1979"). �x � * * �x WHEREAS, a special election was held in the City of Friendswood, Texas, on May 4, 2002, at which a proposition was submitted to the duly qualified, resident electors of the City for their action thereon, such proposition relating to the imposition of a one-half of one percent sales and use tax to be used as authorized by Section 4B, Article 5190.6, V.T.C.S., as amended (the "Development Corporation Act of 1979"); and WHEREAS, there were cast at said special election 2544 votes, of which number there were cast: PR(1Pp,SiTinN Nn 1 FOR THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX WITHIN THE CITY AT THE RATE OF ONE-HALF OF ONE PERCENT TO BE USED AS AUTHORIZED BY SECTION 4B, ARTICLE 5190.6, V.T.C.S., AS AMENDED (THE "DEVELOPMENT CORPORATION ACT OF 1979"), INCLUDING, BUT NOT LIMITED TO, PROJECTS TO PROMOTE NEW OR EXPANDED BUSINESS ENTERPRISES, INCLUDING DRAINAGE AND RELATED IMPROVEMENTS, PROJECTS RELATED TO IMPROVEMENT OF THE MAIN STREET AREA, TARGETED INFRASTRUCTURE AND ANY OTHER IMPROVEMENTS OR FACILITIES THAT ARE RELATED TO ANY OF THE ABOVE PROJECTS AND ANY OTHER PROJECT THAT THE CORPORATION DETERMINES WILL PROMOTE NEW OR EXPANDED BUSINESS ENTERPRISES, AND THE MAINTENANCE AND OPERATIONS EXPENSES FOR ANY OF THE ABOVE DESCRIBED PROJECTS, ALL AS SUBJECT TO PUBLIC HEARING AS REQUIRED BY LAW. 1142 VOTES "FOR"; FVI'D/02 CANVAS-0B.RFS/5/9/02 AGAINST THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX WITHIN THE CITY AT THE RATE OF ONE-HALF OF ONE PERCENT TO BE USED AS AUTHORIZED BY SECTION 4B, ARTICLE 5190.6, V.T.C.S., AS AMENDED (THE "DEVELOPMENT CORPORATION ACT OF 1979"), INCLUDING, BUT NOT LIMITED TO, PROJECTS TO PROMOTE NEW OR EXPANDED BUSINESS ENTERPRISES, INCLUDING DRAINAGE AND RELATED IMPROVEMENTS, PROJECTS RELATED TO IMPROVEMENT OF THE MAIN STREET AREA, TARGETED INFRASTRUCTURE AND ANY OTHER IMPROVEMENTS OR FACILITIES THAT ARE RELATED TO ANY OF THE ABOVE PROJECTS AND ANY OTHER PROJECT THAT THE CORPORATION DETERMINES WILL PROMOTE NEW OR EXPANDED BUSINESS ENTERPRISES, AND THE MAINTENANCE AND OPERATIONS EXPENSES FOR ANY OF THE ABOVE DESCRIBED PROJECTS, ALL AS SUBJECT TO PUBLIC HEARING AS REQUIRED BY LAW. 1361 VOTES "AGAINST"; and WHEREAS, the above and foregoing totals are shown in the official election returns of said special election heretofore submitted to the City Council and filed with the City Secretary; and WHEREAS, said special election was called and held in all respects under and in strict conformity with the Constitution and laws of the State of Texas and of the United States; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: SfCt�On 1. The facts and matters set forth in the preamble of this Resolution are hereby found to be true and correct. �e.c�on 2. The special election relating to the authority of City Council to adopt a one-half of one percent sales and use tax pursuant to TEx. REV. CIV. STAT. ANN. section 4B of Article 5190.6, as reflected in Proposition No. 1, has resulted as follows: FV✓D/02 CANVAS-4B.RES/5/9/02 R2002-29 2 A Majority voted against the adoption of an additional sales and use tax within the city at the rate of one-half of one percent to be used as authorized by Section 4b, Article 5190.6, V.T.C.S., as amended (the "Development Corporation Act of 1979"), including, but not limited to, projects to promote new or expanded business enterprises, including drainage and related improvements, projects related to improvement of the main street area, targeted infrastructure and any other improvements or facilities that are related to any of the above projects and any other project that the corporation determines will promote new or expanded business enterprises, and the maintenance and operations expenses for any of the above described projects, all as subject to public hearing as required by law. S�tinn �, It is hereby found and determined that the NOTICE OF MEETING relating to the regular meeting of the City Council at which this Resolution was considered and the posting thereof, was proper and said notice and posting are hereby authorized, approved, resolved, ratified, and confirmed.
