R2002-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, ESTABLISHING THE FEES TO BE CHARGED BY THE CITY TO NON-RESIDENT CUSTOMERS OF THE CITY'S WATER AND SEWER SERVICE. � � * * * WHEREA5, the City of Friendswood, Texas (the"City") currently charges the same fees to all customers of the City's water and sewer system, whether such customers are located inside or outside the corporate limits of the City; and WHEREAS, the City Council of the City recognizes that the provision of water and sewer services to customers located outside the corporate limits of the City provides a benefit to those non-resident customers, and indirectly imposes a financial burden on resident customers, which is not shared by non-resident customers; and WHEREAS, the City Council of the City desires to change the fees it charges to water and sewer customers located outside the corporate limits of the City, uniformly, to ease the financial burden imposed on the City's resident customers; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The rates for water and sewer system services to be charged to customers located outside the City's corporate limits shall be one and one-half(1.5) times that charged to customers located inside the City's corporate limits. Notwithstanding the foregoing, customers located outside the City's corporate limits shall be billed at the same rates as those charged customers inside the City's corporate limits if (i) such services are provided pursuant an interlocal cooperation agreement and the interlocal cooperation agreement does not provide for different rates, or (ii) such services are provided pursuant to an agreement entered into prior to the effective date of this Resolution. Such out of city customer rates shall be calculated by multiplying the base rates heretofore approved by City Council, as set forth in Appendix D of the Friendswood City Code,by one and one-half(1.5). Section 2. The rates charged to non-resident water and sewer customers set forth in Section 1 hereof shall not apply to entities engaged in non-profit enterprises as that term is defined in 26 U.S.C. §501, as amended, which can demonstrate satisfactory proof of such non- profit status. Such non-profit customers will be charged at the standard rate charged to resident water and sewer customers. Section 3. The fee schedule approved and adopted in Section 1 hereof shall apply to all billings for water and sewer service beginning after the ls`day of July 2002.
