ORDINANCE NO.2015-23 AN ORDINANCE AMENDING APPENDIX "C" "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS, SECTION 3, "PROVISION FOR OFFICIAL ZONING MAP", REZONING THE PROPERTY GENERALLY LOCATED AT 810 S. FRIENDSWOOD DR, A TRACT OF LAND OF APPROXIMATELY .6402 ACRES, ALSO KNOWN AS RESERVE "A" IN THE FINAL PLAT OF CEDARWOOD ESTATES SUBDIVISION, FRIENDSWOOD, GALVESTON COUNTY, TEXAS, MORE FULLY DESCRIBED HEREIN FROM THE CURRENT DESIGNATION OF DOWNTOWN DISTRICT ("DD") TO DOWNTOWN DISTRICT/SPECIFIC USE PERMIT ("DD/SUP"), PERMITTING NAICS USE #713940 "FITNESS AND RECREATIONAL SPORTS CENTERS" LIMITED TO THE SPECIFIC AREA DENOTED IN EXHIBIT 11134", ALL AS MORE SPECIFICALLY PROVIDED HEREIN; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. WHEREAS, Tannos Land Holdingsl, LLC, (the "Owner"), (acting by and through its duly authorized representative Louis Tannos, owner of real property, and agent, Richard Harris), generally located at 810 S. Friendswood]Jr. within the City, same consisting of.6402 acres also known as Reserve A in the Final Plat of Cedarwood Estates Subdivision, Friendswood, Galveston County, Texas, according to the map or plat thereof recorded in Volume 18, Page 662 of the Map Records of Galveston County, Texas, (the "Property"), as more fully shown in the deed, legal description, location map, zoning map, and aerial maps in the attached Exhibit "A", has filed an application to rezone the property currently zoned Downtown District ("DD") to Downtown District/Specific Use Permit ("DD/SUP") to permit NAICS Use # 713940, "Fitness and Recreational Sports Centers" for the Property, limited to the area denoted in Exhibit "134"; and WHEREAS, the Planning and Zoning Commission and the City Council conducted a joint public hearing to consider such application; and WHEREAS, the hearing was duly called as provided by the laws of the State of Texas and Appendix C of the Code of Ordinances of the City, and that in such hearing all persons attending were allowed to be heard on the question of whether or not to rezone the Property from Downtown District ("DD") to Downtown District/Special Use Permit ("DD/SUP") for the Property, to allow for NAICS Use # 713940, "Fitness and Recreational Sports Centers" as requested in the application and as further depicted in the site plan, elevation, drainage plan and related documents in Exhibit "B", attached hereto and incorporated by reference, to determine whether such rezoning would affect the health, safety, convenience, or general welfare of the citizens of Friendswood, and whether or not such change in zoning would violate the rights of any interested person; and WHEREAS, the Planning and Zoning Commission has filed its written report with City Council, which recommends denial of the application for rezoning of the subject Property; and Ord 2015-23 2 WHEREAS, as a result of the said public hearing, the City Council hereby finds and determines that the proposed change in zoning classification and the rezoning of the Property would not be detrimental to the community, and is in conformance with the zoning ordinance; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The Friendswood City Code, Appendix C, "Zoning," Section 3, "Provision for Official Zoning Map," is hereby amended, permitting rezoning from Downtown District ("DD") to Downtown District/Special Use Permit ("DD/SUP"), for NAICS Use # 713940, "Fitness and Recreational Sports Centers", limited to 4,450 square feet, as depicted on Exhibit "134", "Lease Space Anytime Fitness", for the Property at 810 S. Friendswood Dr. within the City, consisting of approximately .6402 acres also known as Reserve A in the Final Plat of Cedarwood Estates Subdivision, Friendswood, Galveston County, Texas, (the "Property"), as more specifically described in Exhibit "A-1," (incorporated by reference), for the operation of a fitness center pursuant to the site plans, (including the elevations and related documents), attached hereto as Exhibit"B,"incorporated by reference for all purposes. Section 3. The Official Zoning Map of the City of Friendswood shall be revised and amended to show the designation of the Property, as described and as provided in Section 2 above, with the appropriate reference thereon to the number and effective date of this Ordinance, and a brief description of the nature of the change. Section 4. This Ordinance shall in no manner amend, change, supplement or revise any provision of any ordinance of the City of Friendswood, save and except the change in zoning classification of said Property as described above. Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Ord 2015-23 3 Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any and every part of the same,notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts. Section 6. Any person who shall willfully, intentionally, or with criminal negligence violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined in an amount not to exceed $2,000.00.
