R2002-14 A RESOLUTION AMENDING CITY OF FRIENDSWOOD, TEXAS, RESOLUTION NO. 2002-10, PASSED AND APPROVED THE 18TH DAY OF FEBRUARY, 2002, AND BEING A RESOLUTION PROVIDING FOR THE HOLDING OF A GENERAL OFFICERS ELECTION AND TWO SPECIAL ELECTIONS, BY ADDING TO SECTION 7 THEREOF A NEW PROPOSED AMENDMENT NO. 16, BY ADDING TO SECTION 8 THEREOF A NEW PROPOSITION NO. 16, AND BY DELETING ALL OF SECTION 9 THEREOF AND SUBSTITUTING THEREFOR A NEW SECTION 9; PROVIDING FOR THE SUBMITTING OF AN ADDITIONAL PROPOSED AMENDMENT TO THE EXISTING CHARTER OF THE CITY AT SUCH ELECTION; DESIGNATING ELECTION OFFICIALS FOR PRECINCTS IN HARRIS COUNTY; AND PROVIDING OTHER MATTERS RELATING TO THE SUBJECT. �x * � �x � � �x � �x �x BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. City of Friendswood, Texas, Resolution No. 2002-10, passed and approved the 18`h day of February, 2002, and being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, PROVIDING FOR THE HOLDING OF A GENERAL ELECTION ON MAY 4, 2002, FOR THE PURPOSE OF ELECTING COUNCILMEMBERS TO POSITION NOS. 2 AND 5 FOR THE CITY; PROVIDING FOR THE HOLDING OF A SPECIAL ELECTION ON THE 4TH DAY OF MAY 2002, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY A PROPOSITION RELATING TO WHETHER THE CITY SHALL BE AUTHORIZED TO IMPOSE A ONE-HALF OF ONE PERCENT SALES AND USE TAX PURSUANT TO SECTION 4B OF ARTICLE 5190.6, TEXAS REVISED CIVIL STATUTES (THE DEVELOPMENT CORPORATION ACT OF 1979); PROVIDING FOR THE HOLDING OF A SPECIAL ELECTION ON THE 4TH DAY OF MAY 2002, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY CERTAIN PROPOSED AMENDMENTS TO THE EXISTING CHARTER OF THE CITY; STATING THE PROPOSED AMENDMENTS TO THE CITY CHARTER TO BE VOTED UPON AT SAID ELECTION; DESIGNATING THE POLLING PLACES AND APPOINTING ELECTION OFFICIALS FOR SUCH ELECTIONS; PROVIDING THE FORM OF THE BALLOTS AT SUCH ELECTIONS; DIRECTING THE GIVING OF NOTICE OF SUCH ELECTIONS; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT, is hereby amended by addition to Section 7 thereof Proposed Amendment No. 16, to provide as follows: PROPOSED AMENDMENT NO. 16 The last sentence Section 3.10 of Article III of the Charter of the City of Friendswood, Texas, shall hereafter provide as follows: "Sec. 3.10. Rules of procedure. ...Four (4) members of the council shall constitute a quorum for the transaction of business and no action of the council, except as provided in section 3.06 above, shall be valid or binding unless adopted by the affirmative vote of four or more members of the council." Section 2. Said City of Friendswood, Texas Resolution No. 2002-10 is hereby further amended by adding to Section 8 thereof Proposition No. 16, to provide as follows: PROPOSITION NO. 16 Shall the last sentence of Section 3.10 of Article III of the Charter of the City of Friendswood, Texas, which provides that a quorum of the council shall be four councilmembers, be amended to provide that a quorum shall be four members of the council? Section 3. Said City of Friendswood, Texas Resolution No. 2002-10 is hereby further amended by deleting all of Section 9 thereof and substituting therefor a new Section 9 to provide as follows: "Section 9. Polling Places; Election Officials. Said elections shall be held in each of the election precincts within said City and the polling places and election officials for each of said precincts shall be as follows: 2 Election Precinct Nos. 220, 456, 457, 460, 461, 462, 482, 483, 484, and 485 (Galveston County�: Boundaries the same as those portions of Galveston County Election Precincts 220, 456, 457, 460, 461, 462, 482, 483, 484, and 485 located within the corporate limits of the City. Each Presiding Judge shall have the authority to appoint no more than three (3) qualified voters as clerks to assist in the holding of said election, but in no event shall the Presiding Judge appoint less than two (2) clerks." 3 Section 4. All resolutions or parts of resolutions inconsistent or in conflict herewith are, to the extent of such inconsistency or conflict, hereby repealed.
