R2003-20 A RESOLUTION OF THE CITY OF FRIENDSWOOD, TEXAS, ENDORSING S.B. 1792 and H.B. 2615. * * * * * * * * * * WHEREAS, the City of Friendswood, Texas (City) has historically been active in the process of regulation of rates charged by electric utilities; and WHEREAS, the City and its residents are Price to Beat customers of First Choice Power, Inc., a retail electric provider affiliated with Texas New Mexico Power; and WHEREAS, First Choice Power has made its second, and final, request this year to increase its Price to Beat fuel factor pursuant to PURA § 39.202(�; and WHEREAS, the Public Utility Commission has determined that First Choice Power, Inc. is not required to reimburse the City's rate case expenses; and WI�REAS, the City endorses legislative efforts to modify electric deregulation legislation to permit decreases to the Price to Beat fuel factor when natural gas prices fall and to reimburse the City for rate case expenses incurred in Price to Beat rate cases; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. That S.B. 1792, permitting the City to seek decreases to the Price to Beat fuel factor when natural gas prices decrease and H.B. 2615, requiring the affiliated retail electric provider to reimburse the City for rate case expenses incurred by participating in Price to Beat rate cases, are hereby supported by the City. Section 2. A copy of this resolution shall be sent to the elected lawmakers representing the City's interests in the Texas House and Senate.
