ORDINANCE NO. 2015-03 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS, APPENDIX C, "ZONING," BY AMENDING TAE ZONING CLASSIFICATION FOR 108 W. EDGEWOOD DRIVE, A 5.6008 ACRE TRACT OF LAND, RESTRICTED RESERVE "A" OUT OF THE PARTIAL REPLAT OF FRIENDSWOOD SQUARE RESERVE "A", A SUBDIVISION OF 6.1227 ACRES OF LAND BEING A REPLAT OF RESTRICTED RESERVE "A" FRIENDSWOOD SQUARE, RECORDED IN VOLUME 2005A, PAGE 62 OF THE MAP RECORDS OF GALVESTON COUNTY, TEXAS, REZONING SUCH PROPERTY FROM "COMMUNITY SHOPPING CENTER" (CSC) TO "COMMDNITY SHOPPING CENTER — SPECIFIC USE PERMIT" (CSC-SUP) TO ALLOW NAICS USE #8131 — "RELIGIOUS ORGANIZATIONS"; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. k * d' .`P % X X X X % dC WHEREAS, New Hope Community Clu�istian Church is the Owner, ("Owner") of a 5.6008 acre tr•act of land, located at 108 W. Edgewood Drive, Friendswood, Texas, being Restricted Reserve "A" out of the partial replat of Friendswood Square Reserve "A", a subdivision of 6.1227 acres of land being a replat of Restricted Reserve "A" Friendswood Square, recorded in Volume 2005A, Page 62 of the Map Records of Galveston County, City of Friendswood, Texas, more specifcally described in the attached Exhibit "A", including a location map, zoning map, and aerial map, which are incorporated by reference for all purposes and made a part hexeof(the"Property'); and WHEREAS, the Owner, by and tlu•ough its agent, Todd Branson, has made application for a Specific Use Permit ("SUP') and provided related information to address requirements of the City Code of Ordinances, ("Code"), which are attached hereto as Exhibit "B" and incorporated by reference, to allow for NAICS use #8131 — "Religious Organizations" in place of prior Ordinance No. 99-13, which granted a SUP for a used merchandise store for the Property, situated in the Community Shopping Center district ("CSC"), for the City to detennine compliance with the curxent Code requirements for the protection of the health, safety and welfare of its residents; and WHEREAS, the Planning and Zoning Coirunission and the City Council have conducted, in the time and manner required by law and the Zoning Ordinances of the City of Friendswood, a public hearing on such request; and WHEREAS, the Planning and Zoning Commission("Commission"') has filed its written report with the City Council of Friendswood, which recommends anproval of the application; and WHEREAS, the City Council deems it appropriate to grant such request, subject to any applicable regulations, restrictions, and conditions; and WHEREAS, City Council has determined that all public notices have been posted and published, all required hearings on this matter have been held, and that this Ordinance complies with the provisions of Yhe City Charter, City Code and all other applicable laws; now, Yherefore, Ord 2015-03 2 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section L The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct and incorporated by reference, including the representations of Applicant, as referenced in its application for SUP amendment, the final report from the Planning & Zoning Commission, the minutes of the Commission and City Council, and the submitted plans, attached in Exhibit "B", al] of which the City Council is specifically relying upon in granting this SUP amendment, as provided hereafter. Section 2. The Code of Ordinances of the City of Friendswood, Appendix C — "Zoning" ("Zoning Code") is hereby amended to approve a Specific Use Permit "SUP" for NAICS Use #8131 — "Religious Organizations" in place of Ordinance No. 99-13, which granted an SUP for a used merchandise store far the Properry, subject to the applicable Code of Ordinances of the City of Friendswood. Section 3. The Zoning District Map of the City of Friendswood shall be revised and amended to show the designation of the Property, as described and as provided in Section 2 above, with the appropriate reference thereon to the number and effective date of this Ordinance, and a brief description of the nature of the change. Section 4. This Ordinance shall in no manner amend, change, supplement, or revise any provision of any ordinance of the City of Friendswood, save and except the change in zoning classification of said Property as described in Section 2 hereof. Section 5. In the event any section, paragraph, subdivision, clause, pluase, pirovision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a eourt of competent jm•isdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part ox provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and eveiy part of the same notwithstanding the omission of any and every pa1�C of the same notwitbstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts. Ord 2015-03 3 Section 6. Any person who shall willfully, intentionally, or with criminal negligence violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction thexeof, shall be fined in an ainount not to exceed $2,000.00.
