The invocation was given by Pastor Mike Cervantes with New Hope Church. ' Mayor Holland led the Pledge of Allegiance to the United States and to the State of Texas. COMMUNICATIONS FROM THE PUBLIC Mayor Holland asked if anyone would like to speak. No one spoke. WORK SESSION Mayor Holland opened the discussion regarding an update on capital projects. Assistant City Manager Morad Kabiri stated architecture and civil design activities are well underway for the library expansion, schematic layouts have been completed, Staff has received a set of 90% plans and reviewed, commented, and returned the plans to the architect, and will be meeting with the architect and their su6- consultants in the near future to finalize. Galveston County Consolidated Drainage District (GCCDD) granted a request to utilize regional detention and waive the detention fee, key items are being addressed on the drainage plan in order for it to be placed on a GCCDD agenda in the near future for approval, Staff is working with the Texas Department of Transportation (TxDOT) on a permit to tie in utilities, antl advertising for bids is anticipated to start in January 2015. In regards to Fire Station No. 4 and the new fire station at the Public Safety Building, Staff, in conjunction with the architect, developed a solicitation of proposals for"Construction Manager at Risk" services. On November 4, 2014, proposals were received and subsequently reviewed. A review committee met thereafter to discuss scoring results, Staff is investigating references, will be visiting existing structures prior to their selection, and anticipates bringing a recommendation to Council in January. A professional services contract was awarded at the May Council meeting for the design of Sportspark improvements. The proposed improvements include new restrooms and concession facilities, parking lot, four youth softball fields, and lighting upgrades. Staff conducted meetings with the Girls Softball Association to receive their input, plan to have the layout finalized soon so the girls' softball season is not affected, and are discussing cost estimates prior to coming back to Council. Architectural and civil design activities are well underway for the basketball pavilion at Centennial Park, and the lighting improvements at the detention pond fields and front parking lot are complete. An agreement has been struck with Friendswood Development Company (FDC) for 12/08/14 4368 improving access to Lake Friendswood. FDC has agreed to allow access to the lake through the West Ranch Subdivision. Additionally, FDC will build 55 to 60 parking spaces, a restroom/concession pavilion and an automatic gate for controlled access. Following a meeting in June with the landscape architect, a professional services design proposal was resubmitted in late October for improvements at the lake, and Staff met with the developer and architect to discuss the overall plan of the park, including the improvements by both parties. A contract has been approved with Wilson McClain to design the improvements at the lake, design services will soon be underway during which input will be solicited from the Parks and Recreation Board and neighboring residents, and construction is estimated to begin the second quarter of 2015. A contract has been awarded for the final phases of the Splash Pad and the proposed Rotary Pavilion at Stevenson Park. Separate from those improvements, modeling efforts and final design plans are underway for the bridge crossing Cowards Creek, and Staff continues to work with nearby property owners regarding the alignment of a trail system to and from the bridge. Improvements are currently going on regarding the lighting at the basketball and tennis courts. Surveying and geotechnical services for the Round 1 Street Improvements project are complete, and Staff is currently reviewing the 50% submittal from the consulting engineer. The Whispering Pines Avenue/Friendswood Link Road Expansion project is currently under construction, and the intersection of David Glen Drive and Friendswood Link Road should be open shortly. As part of the five-year Capital Improvement Plan (CIP) for water and sewer,Water Plants No. 2 and 7 are being reconstructed. The reservoirs for both locations have been installed, pumps and control room will be installed in late 2014, and the project will be completed by early 2015. The Baker Road project should be completed in two weeks, asphalt will be placed December 9, 2014. Staff is working with RJN Group to create a detailed scope of work for the Inflowllnfiltration Study prior to presenting to Council for approval, and plan to provide a recommendation to Council at the January Council meeting. The Public Works Department has received a number of calls for clean out services for the sewer lines over the last few weeks. As a reminder the City can and does go out to clean out the sewer lines on the right-of-way to the sewer main in the public right-of-way, to the residence is the responsibility of the resident. Discussion took place between Mayor, Council, and Staff regarding that the delay on the completion of ' the Splash Pad is due to a delay in the contractor getting the equipment in, and Staff is looking into converting an unused office space at the corner of the pool for a restroom facility with an exit to the Splash Pad. Councilmember Rockey has assisted Staff with the development of a series of spreadsheets to help identify the problem areas with the pumping of the lift stations. The library should remain open for normal operations during the construction of the library expansion. Mayor Holland opened the discussion with Russell Gallahan, M.P.A., Senior Economic Development Analyst, Economic Development&Analysis Division of the Texas Comptroller's Office regarding the local sales tax options. Mayor Holland introduced Russell Gallahan who presented a PowerPoint presentation regarding the sales tax options and potential of entities being able to adopt sales tax within the city's boundaries. Cities have a number of options to collect revenue necessary to provide needed services, including fees and/or fines, property tax, and sales and use tax. Property tax tends to be a city's largest source of revenue, followed by sales tax and then various other fees and fines. Thousands of cities, counties, school districts and special purpose districts in Texas levy a property tax, revenue from'thfs tax is used to fund law enforcement, fire departments, hospitals, schools, libraries, parks, roads, utilities, economic development and many other locally operated public services, and the constitutional property tax rate cap for home rule cities is $2.50 per $100 of property value. The City of Friendswood's Fiscal Year 2014 property tax rate is $0.5914, and the city offers a Homestead Exemption of 20% regular, with minimum of $5,000, over the age of 65 or disabled $25,000, and tax levy freeze over the age of 65 or disabled. Local entities that can impose sales tax are most Texas cities, 123 counties, 281 special purpose districts, and 10 transit districts. The current sales tax rate in the City of Friendswood is 1.5% which consists of 1% regular rate and .5% property tax relief, approximate revenue the city received from sales tax combined is $4.3 Million. Local Sales Tax Cap states the maximum combined local sales tax rate is 2%, and includes the combined sales tax rates of the county, city, and several types of special purpose districts. Adopting or changing an additional sales tax requires City Council to call an election of the eligible voters residing in the city limits. Elections may be held only on the first Tuesday after the first Monday in November or the second Saturday in May. Two types of city sales tax are sales tax administered by the City Council, and sales tax administered by a board of directors appointed by the City 12/08/14 4369 Council. Sales tax that can be administered by the City Council are regular sales tax (1 %), sales tax for property tax relief (0-0.5%), and street maintenance sales tax (0-0.25%). Most cities in Texas have the regular sales tax form of sales tax, may be imposed by any incorporated city, and revenues are deposited into the city's General Revenue Fund and may be used for any lawful purpose. Sales tax for property tax relief maybe imposed by most incorporated cities, revenues are deposited into a city's General Revenue Fund, cities adopting this form of local sales tax must reduce the effective and rollback property tax rates within the city, and counties may also impose this tax. Regarding street maintenance sales tax, all cities are authorized to hold an election to adopt a sales tax to repair and maintain existing city streets, tax expires after four years unless a new election is held to reauthorize the tax, and revenue from this tax may be used only to maintain and repair existing city streets (not for constructing new streets). Others are sales taxes administered by a board appointed by the City Council, sales tax for Economic Development (0-0.5%) two options (Type A or Type B), Crime Control & Prevention District (0-0.5%), Venue Tax (0-0.5%), Municipal Development Corporation (0-0.5%), and Municipal Development District (0-0.5%). The Development Corporation Act was authorized by the legislature in 1979, and as of November 2013, Texas cities have adopted 708 Type A and B sales tax corporations, generated nearly $660 Million in sales tax (Fiscal 2013), and 58% of Type A/B cities have populations of less than 5,000'. Sales Tax for Economic Development Type A is a form of tax that may be imposed by most incorporated cities, revenues must be turned over to a development corporation formed to act on behalf of the city, and may fund programs related to industrial development and the promotion of new and expanded business enterprises that create or retain primary jobs. Sales Tax for Economic Development Type B is a form of tax that may be imposed by any incorporated city, revenues must be turned over to a development corporation formed to act on behalf of the city, and may fund a wide variety of projects including industrial development, public parks and business development. Crime Control and Prevention District is subject to voter approval, this sales tax may be imposed by a city located in a county with a population of more than 5,000 or by a county with a population of more than 130,000, governing body in a municipality or commissioners court may specify the length of time the district would be continued (5, 10, 15, or 20 ' years), and revenues from the sales tax may be used to finance a wide variety of crime control and prevention programs. The Venue Tax is one of several revenue options available to a city to fund sports and community "venue" projects, cities, counties or cities and counties in any combination may join to form a venue district. A Municipal Development Corporation allows a city to create a municipal development corporation funded by a sales and use tax to fund a variety of services. Permissible services include job training, early childhood education, after-school programs, scholarships, literacy promotion, and other projects. A Municipal Development District authorizes a city to hold an election in all or part of the city, including the extra-territorial jurisdiction, to create a Municipal Development District, may be funded with a sales and use tax approved by the voters, district funds may be used to undertake a variety of projects including a convention center, civic center, auditorium or other projects authorized of Type B Economic Development Corporations. Fire Control, Prevention, and Emergency Medical Services (EMS) District, cities with a population between 25,000 and 550,000 or more than 1.9 Million may create an EMS District, may include all or any part of a city, and may finance the operation of a fire control, prevention and EMS program. Sales tax that may be implemented only by a county are County Assistance District (0-2%) and Emergency Services District (0-2%). With a County Assistance District, counties may hold an election in all or part of the county, to create one or more County Assistance Districts and adopt a sales tax to fund the districts. A district may undertake a variety of projects including roads or highways, provision of law enforcement and detention services, the maintenance dr improvement of libraries, museums, parks or other recreational facilities, or other services that benefit the public welfare. With an Emergency Services District, counties may hold an election in all or part of the county, to create one or more emergency services districts and adopt a sales tax to fund the districts. Funds may be used to hire emergency personnel, contract with other entities to provide emergency services, and/or purchase equipment and facilities. Mr. Gallahan asked Council if they had received enough information, or would they like to hear more information on the Sales Tax for Economic Development Type A and B. The consensus of Council was to hear more information on Sales Tax for Economic Development Type B. Mr. Gallahan continued the PowerPoint presentation focusing on Sales ' Tax for Economic Development Type B, a brief history was given, combined local sales tax cannot exceed 2%, can be used in 1/8 increments. If an election is held in May and an additional sales tax is approved by the voters, the sales tax does not become effective until October. Board members of an Economic Development Corporation Type B are elected by City Council, seven board members, serve 12/08/14 4370 two-year terms, may be reappointed, three members may not be city officials, and members must be city residents. A corporation must be created to manage the Economic Development funds, submit to the Secretary of State for incorporation with a corporation name and bylaws, receive a Certificate of Formation, and file Form AP-204, Application for Exemption with the Texas State Comptroller. All board members are required to receive one hour of Open Meetings Act training and one hour of Texas Public Information Act training within 90 days of appointment from the Office of the Attorney General. The City Manager and the City Attorney and/or the City Secretary are required to receive training in Economic Development every 24 months from the Texas Economic Development Council. Project approval process for Economic Development Corporation Type B is City Council would approve the project first after the board members have presented the project, and if the project is outside the city limits the county would have to approve of the project after City Council has approved, public notice and a public hearing is required, voters have the opportunity to petition for 60 days after the public notice, and then an election. Non-permissible projects are educational facilities including libraries, K-12 classrooms, or K-12 athletic facilities, municipal buildings construction, sewage systems for the general public, and residential city street construction or repair. An Economic Development Corporation may contract with other entities to manage activities funded with tax revenue. Each contractor must sign a performance agreement with "claw-back" provisions to assure compliance with state law and the intent of the Economic Development Corporations' board of directors. Examples of contractors include other Economic Development Corporations, businesses, chambers of commerce, cities, counties and non-profit organizations. Economic Development Corporations are required to report annually to the State Comptroller, report is due February 1, and failure to report may result in exclusion from the comptroller's biennial report to the Legislature. CLOSED EXECUTIVE SESSION Mayor Holland asked if anyone would like to speak regarding the Executive Session. No one spoke. Council convened into Executive Session in accordance with the Texas Government Code, pursuant to , Section 551.071 — Consultation with Attorney regarding pending or contemplated litigation (Wight Realty Interests, Ltd., vs. City of Friendswood), Section 551.072: Deliberation regarding real property (Parkland development; legal advice only regarding potential development of real property located within the City of Friendswood), and Section 551.087: Deliberation regarding economic development negotiations; to deliberate the offer of a financial or other incentive to a business prospect. RECONVENE INTO OPEN SESSION Council reconvened into Open Session with action taken later in the meeting regarding Section 551.072. COMMUNICATIONS FROM THE PUBLIC Cooper Dixon, Friendswood resident, addressed Council and stated he had spoken to Council twice before, in the beginning he requested Council to make his Eagle Scout project of a disc golf course in 1776 Park a reality, thanked Council for allowing him to work with them on his project and specifically thanked the City for the time that City Staff put in to help him and his fellow scouts accomplish the project, and their labor was crucial to making the project happen. Staff assisted in making everything work smoothly by laying concrete, setting the baskets, and getting equipment to the site. Mr. Dixon stated he raised a portion of the funds on his own but the City contributed as well, was very helpful and thanked Council again for their support, and stated he hopes to see Council on Sunday at the grand opening. CITY MANAGER'S REPORT City Manager Roger Roecker reported that November 8, 2014, was Keep Friendswood Beautiful's (KFB) Annual Fall Haul-A-Day at Centennial Park, was a popular event with citizens, and wanted to share some ' details about how successful it was. A total of 720 residents attended the cleanup event, KFB volunteers and seven employees from the Community Services Department worked the event, and Police Officers helped direct traffic. Progressive Waste Solutions collected the majority of the debris dropped off, with 1 12/08/14 4371 I their employees working all day at the event, collected 35.2 tons of residential waste, 28,02 tons of roll off waste, and a 40 yard box of scrap metal. The Galveston County Consolidated Drainage District brought in their chipper for the green waste items and mulched 60 cubic yards of green waste. Many items were donated for the animals that are rescued by Wildlife Rehabilitators, Inc. Donated items for the garage sale sold for$1,015, which will go toward the beautification of City facilities and parks. Copy Dr. arranged for the services of a shredding truck, the company was TriStar Shredding and they donated their services working all day to shred 8,000 pounds of paper. Ackles Air & Heat was onsite to remove the freon from appliances that were dropped off, so that they could be disposed of properly. The City Manager thanked the many community-oriented businesses and generous, hard-working volunteers that again helped to make this year's Fall Haul-A-Day a success. The City Manager reported on the upcoming Community Holiday Events. Friendswood will be very busy throughout the rest of this year with a number of special events to look forward to. The City Staff., Chamber of Commerce, Keep Friendswood Beautiful, Friendswood Fine Arts Institute and many Friendswood volunteers will be working hard to coordinate a number of exciting events. For many years', the Friendswood Blue Santa program has been helping Friendswood's needy children enjoy a happy holiday season. The Friendswood Blue Santa program, sponsored by the Friendswood Police Officer's Association (FPOA) and the Friendswood Police Department, are now accepting donations and applications. Blue Santa provides gifts for children 12 and younger who might not otherwise have presents to open on Christmas morning. Applications are limited to families who live in the City of Friendswood and demonstrate a need. Blue Santa depends on the generosity of local businesses, schools, civic groups and citizens to help make the program possible. Donations of new, unwrapped toys can be dropped off any time at the Friendswood Police Department, program runs from November 1�, 2014 to December 19, 2014, and deadline for applications is December 5, 2014. Another event is the City of Friendswood and Friendswood Fine Art Institute's (FFAI) Third Annual Deck the House Holiday Lighting Contest. Homes may enter by visiting the FFAI website at www.ffaionline.com and submitting an ' official entry form online, entry deadline is Wednesday, December 10, 2014. There is no cost for participation and the contest is open to all homes located in the City of Friendswood, five finalists will be selected from all participants, finalists will be featured on the City of Friendswood website, as well as the Friendswood Fine Arts website and Facebook page, and online voting will begin December 15, 2014. Participating homes will also be included on the "2014 Lights 2 See List," available on the Friendswood Fine Arts Institute's website. Another event is the Friends of the Library December Book Sale. The Friendswood Public Library Book Sale will be held Friday, December 12, 2014 through Saturday, December 13, 2014. The sale will be open to the general public, book sellers, and vendors starting at 12:00 PM. The 28th Annual Christmas Lighted Parade will be sponsored by the Friendswood Chamber of Commerce and begins at 6:00 PM on Saturday, December 13, 2014, from the corner of Friendswood Drive and Heritage Drive, and ends at Stevenson Park. There is no charge for parade entries, and bring your camera to take pictures with Santa. Another exciting event is the Seventh Annual Santa in the Park - Home for the Holidays with HomeTown Bank on Saturday, December 13, 2014. The title sponsor for this year's Santa in the Park event is Friendswood's HomeTown Bank. Many fun-filled activities will be provided including a spectacular Tree Lighting Ceremony and Fireworks at 7:30 PM. The event will be held at Stevenson Park and coordinated by Keep Friendswood Beautiful and the City of Friendswood. The fun begins at 3:00 PM and goes strong until 8:00 PM. Wristbands for amusements rides are $1,0 each or bring a canned food item to donate to the Mary Queen Church food pantry and save $5 off a wristband. There will also be coloring contests, music, dancers, choirs, holiday arts and crafts market, refreshments, and a snow hill. Children can have pictures taken with Santa from 3:00 to 6:00 PM. Sponsors HomeTown Bank, Keep Friendswood Beautiful, City of Friendswood, along with others, helped provide a snow hill with 20,000 pounds of snow. A children's train will travel around the walking trail, a live band will perform and a Christmas concert will take place from 7:30 PM to 8:00 PM provided by the First Baptist Church of Friendswood. Pet adoptions will be available along with lots of other outdoor activities and performances by local talent. Food and beverages will be available for purchase. All those who bring a new unwrapped gift for a boy or girl for Friendswood's Blue Santa Program will receive a free ' bowl of delicious chili from the Light House Charity Cooking Team. The City Manager reported that earlier in the year the Texas Department of Transportation (TxDOT) underwent a comprehensive evaluation of most of the signalized intersections in the City of 12/08/14 4372 Friendswood. As a result of that evaluation, a number of adjustments were made to achieve optimal traffic progression and reduce frequent stops, delays, and fuel consumption on the heaviest traveled corridors. One of the proposed improvements analyzed, but yet to be implemented was the use of Flashing Yellow Arrows (FYAs). These signals (FYAs) have proven to be a more effective alternative for permissive left turn movements prevalent at a number of intersections in the City. Permissive left turn movements are those signalized intersections that allow for left turn movements, provided motorists yield to oncoming traffic which also has a green light. Staff has been notified by TxDOT that FYAs will be installed at two intersections along FM 518 on December 10, 2014 and December 11, 2014 (weather permitting). The two intersections being upgraded are FM 518 at Eagle Lakes Drive, and FM 518 at West Boulevard. Other intersections will follow at a later date. ACTION ITEMS **Discussion and possible action regarding reinstating the Appointment Policy for Boards, Committees, and Commissions with amendments died for lack of a motion. **Councilmember Rockey moved to approve a contract with Flooring Source for flooring repair services at the Leavesley Park Jones Hangar facility and authorize the Mayor to execute the contract in the amount of$29,785. Seconded by Councilmember Gustafson. The motion was approved 6-1 with Councilmember Enochs opposed. **Councilmember Hill moved to approve a.contract with Lockwood, Andrews and Newman for the design of Lift Station No. 18 and authorizing the Mayor to execute the contract in the amount of$86,390. Seconded by Councilmember McGinnis. The motion was approved unanimously. **Councilmember Hill moved to approve the purchase of a new ambulance for the Friendswood Volunteer ' Fire Department and the disposal of the old ambulance. Seconded by Councilmember Enochs. The motion was approved unanimously. **Councilmember Rockey moved to approve an earnest money contract for the purchase of two acres at 220 Shadwell Lane, Friendswood, Galveston County, Texas, and authorizing the Mayor to execute the contact in the amount of$375,000. Seconded by Councilmember Hill. The motion was approved unanimously. RESOLUTIONS **Councilmember Enochs moved to approved Resolution R2014-22 - A resolution of the City of Friendswood, Texas, hereby designating Carl Gustafson as representative and Jim Hill as alternate to the Houston —Galveston Area Council 2015 General Assembly and Board of Directors. Seconded by Councilmember Rockey. The motion was approved unanimously. **Councilmember McGinnis moved to approved Resolution R2014-23 -A resolution of the City Council of the City of Friendswood, Texas, determining that a waterline easement is needed for construction and maintenance of public improvements near FM 2351 and Woodlawn; approving the acceptance of said easement from MRC Ventures, LP, and RB &VN Partners, LP, property owners. Seconded by Councilmember Rockey. The motion was approved unanimously. **Councilmember Enochs moved to approve Resolution R2014-24-A resolution of the City Council of the City of Friendswood, Texas, approving the Public Funds Management and Investment Policy. Seconded by Councilmember Hill. The motion was approved unanimously. ORDINANCES ' **Councilmember Scott moved to approve the Second and Final reading of Ordinance No. 2014-32 -An ordinance amending Appendix "C" "Zoning", of the Code of Ordinances of the City of Friendswood, 12/08/14 4373 Texas, Section 3, "Provision for Official Zoning Map", rezoning a tract of land generally located on FM 2351 (between Garden Dr. and Woodlawn Dr.), consisting of approximately 1.600 acres of land (out of a called 4.621 acres) situated in Lot 2, Block 1 of Friendswood Subdivision, Friendswood, Galveston County, Texas according to the map or plat thereof recorded in Volume 254-a, Page 18 of the map records and transferred to Plat Record 7, Map No. 20, both of the map records of Galveston County,, Friendswood, Texas, more fully described herein from the current designation of Business Park ("BP") to Single Family Residential ("SFR"), all as more specifically provided herein; providing for the amendment of the Official Zoning Map; providing a penalty in an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability. Seconded by Councilmember Hill. The motion was approved unanimously. **Councilmember Rockey moved to approve the First and Final reading of Ordinance No. 2014-36 - A ordinance authorizing the issuance and sale of City of Friendswood, Texas general obligation bonds Series 2015; levying an annual ad valorem tax for the payment of said bonds; approving an official statement; and enacting other provisions relating to the subject. Seconded by Councilmember McGinnis. The motion was approved unanimously. **Councilmember Hill moved to approve the First reading of Ordinance No. T2014-37 - An ordinance amending the Code of Ordinances, Friendswood, Texas, relating to the prohibition of illicit synthetic drugs; containing findings and other provisions relating to the foregoing subject; declaring certain conduct to be unlawful and providing a penalty therefore; providing for severability; and declaring an emergency. Seconded by Mayor Holland. The motion was approved unanimously. **Councilmember Scott moved to approve the First reading of Ordinance No. T2014-38 - An ordinance amending Appendix A of the Code of Ordinances of the City of Friendswood, Texas, being the City's Sign Ordinance, by amending various sections therein; repealing all ordinances or parts of ordinances ' inconsistent or in conflict herewith; and providing for severability. Seconded by Councilmember Rockey. The motion was approved unanimously. **Councilmember Rockey moved to approve the First reading of Ordinance No. T2014-39 -An ordinance of the City of Friendswood, Texas, City Council, amending Appendix D of the Friendswood City Code to establish the rates to be charged by the City for water and sewer utility services. Seconded by Councilmember McGinnis.
