REGULAR SESSION Mayor Holland called the meeting to order. i ' The invocation was given by Pastor Jim Bass with Friendswood United Methodist Church. Mayor Holland led the Pledge of Allegiance to the United States and to the State of Texas. COMMUNICATIONS FROM THE PUBLIC Edwin Turney, Friendswood resident, addressed Council and stated he is at the meeting to compliment a Staff member, lives in Falcon Ridge, had a problem with overgrown brush in an easement behind his house which created a problem with wild animals. He further stated he called the City and spoke to Alex Mendoza, Code Enforcement Officer, who made sure it was quickly mowed, weed-eated and made sure the problem was resolved. Mr. Mendoza made a promise and kept it. If there is an employee of the year or decade then Alex Mendoza should win it. WORK SESSION Mayor Holland opened the discussion regarding the proposed amendments to the Sign Ordinance. Planning Manager Nick Haby presented a PowerPoint presentation regarding the Sign Ordinance. When Staff meets with the development community they sometimes have ideas or situations that do not mesh with the current City Code and Staff decides to take a look at the codes again to make sure they still meet the City's needs. Staff has spent a long time poring through the Sign Ordinance, came up with items that should be considered for amendments, and redlined some items. Staff has identified three subject matters to consider for amendment which are wall signs, monument signs, and off-premise signs. The current language in the Sign Ordinance regarding wall signs is that one wall sign is allowed for each business establishment and the sign area is 1.5 square foot per linear foot of business frontage. Mr. Haby gave an example of a free-standing emergency room that was currently under construction in the City of Friendswood. The emergency room submitted a permit application to place numerous signs on� ' their building. This is something that Staff encounters continually with the development community. The proposed language for wall signs is to remove the "one sign' requirement and allow multiple signs but keep the total sign area at 1.5 square foot per linear foot of business frontage. The current language in the Sign Ordinance regarding monument signs is that one monument sign is allowed per building. 11/03/14 4356 Multiple businesses can be listed on a monument sign but the current ordinance requires them to be in a "common building". The proposed language for monument signs is to allow one monument sign per ' business establishment and allow multiple businesses to be listed on the monument sign despite how many buildings are on the lot. The current language in the sign ordinance regarding off-premise signs is that the only 'off-premises' sign allowed is a four square foot directional sign on a contiguous piece of property. The proposed language for off-premise signs is to allow business establishments on contiguous lots to utilize a common monument sign. Discussion took place between Mayor, Council, and Staff regarding the recommended amendment for monument signs is to allow one monument sign per business establishment but have serval business names on the sign, square footage of the monument and wall signs. The suggestion was made to add verbiage stating to not exceed a certain number of wall signs on a building. Clarification was given that the monument sign amendment would be for one monument sign per lot. Mayor Holland opened the discussion regarding the City's electric power supply contract. Administrative Services Director Cindy Edge introduced David Quin, Program Manager with Public Power Pool. Mr. Quin presented a PowerPoint presentation regarding the method in which the City purchases electricity, and explained the program. Since 2001, the Public Power Pool has saved members over $114 Million against market rates. The City of Friendswood has saved $375,000 against market rates since becoming a member and currently pays a fixed weighted three-year average price of 4.91 cents/kWH from Constellation, and had members procured the power alone the price would have averaged 5.10 cents/kWH. Reasons were given why the Public Power Pool is the City's best option for purchasing power, negotiate bulk discounts unavailable to individual entities, nonprofit owned and operated by its members, transparent aggregation fee is the lowest in the business, valued and customized support to City Staff, and the contracts are the most member-friendly contracts in the business. Based on available prices for 2017 through 2019, the board approved a new procurement so that an aggressive price target can be secured while adhering to the principles of price risk management and budget stability. All ' members have 60 days to review the procurement proposal, all registered retail electric providers doing business in Texas will be invited to bid, the current agreement will be the baseline for discussions with suppliers, and no procurement can be completed unless it meets the "Trigger Point" and secures a rate under 5.11 cents/kWh to 5.28 cents/kWh price ceiling for future years. Discussion took place between Mayor, Council, and David Quin with Public Power Pool regarding outdoor lighting, the proposed contract is for an additional three years after the current contract, other programs could be considered if Council desired, within the consortium the City could use a separate meter system for outside lights, and individual members can have different demand size programs within the procurement, and the main purpose of procurement is to negotiate bulk rate electricity. Mayor Holland opened the discussion between Council, Staff, and the Planning and Zoning Commission regarding home occupations. Planning and Zoning Commission Chair Mark McLean opened the Planning and Zoning Commission's portion of the Joint Work Session and gave the floor to Planning Manager Nick Haby who explained that several months ago there was an expressed desire by City Council to bring back a discussion regarding home occupations. The Planning and Zoning Commission (P&Z) met and workshopped home occupations, formed a subcommittee consisting of P&Z members Sally Branson, Jim Nye, and Craig Lovell. The subcommittee came back to the full commission with a recommendation. The ordinance currently does not allow retail in residential areas and does not allow for any stock or trade to be kept on location. Discussion revolved around if retail was to be allowed, what kind of retail, and whether or not to allow stock. P&Z requested the work session with Council to receive guidance on how to proceed. Chair McLean stated for 30 years there has been prohibition for home occupations, times are changing, need to decide what kind of retail would be allowed, how to define, P&Z is looking for Council's guidance, do not have a final recommendation yet, need to know if they are on the right track, keep prohibition but relax ' requirements. Discussion took place between Mayor, Council, the Planning and Zoning Commission, and Staff I 11/03/14 4357 i i regarding that the topic of home occupations arose due to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) stripping a resident of their license to sell firearms due to the fact that the current City ordinance did not have a provision stating that a resident could sell firearms from their home. Councilmember Gustafson suggested to state in the ordinance the exact types of businesses that would be allowed to operate as a home occupation. Mayor Holland stated the topic of home occupations has been a contentious item discussed by the Planning and Zoning Commission over the past 30 years. Councilmember Scott stated he agrees with restrictions on signage, no impedance of traffic, no store fronts, but cautions against stating the exact type of businesses that would be allowed. Councilmember i Rockey stated he agrees with restrictions on signage and allowing residents to have small businesses at their place of residence. Councilmember Hill stated the ordinance should state no business is allowed within the residence unless it complies with a list of requirements included in the ordinance. The Planning and Zoning Commission will bring proposed amendments back to Council at a later date. Planning and Zoning Commission Chair Mark McLean adjourned the Planning and Zoning Commission's portion of the Joint Work Session. Mayor Holland opened the discussion regarding future Council Planning Retreats and stated a retreat is needed to follow-up with the Community and Economic Development Committee (CEDC) after the retreat with the committee earlier this year, and to also hold a retreat with the Friendswood Volunteer Fire Department, and would like to have the retreat before the holidays. i Discussion took place between Mayor, Council, and Staff regarding dates available to attend a retreat, total duration of retreat should last four to five hours, suggestion was made to have the retreat during the middle of the week and/or one evening. The consensus of Council was to hold the retreat with the Community and Economic Development Committee and the Friendswood Volunteer Fire Department on December 6, 2014, and the City Manager would notify both groups to make sure they would be available , to attend. ' Mayor Holland opened the discussion regarding an update on capital projects. Director of Public Works/City Engineer Patrick Donart addressed Council and stated Council was provided information in their backup documents. Architecture and civil design activities are well underway for the library expansion, schematic layouts have been completed, Staff has received a set of 90% percent plans for review, have commented on plans, and returned the plans to the architect. Galveston County Consolidated Drainage District (GCCDD) granted a request to utilize regional detention and waive the detention fee, key items are being addressed on the drainage plan in order for it to be placed on a GCCDD agenda in the near future for approval, and Staff is working with the Texas Department of Transportation (TxDOT) on the driveway permit. In regards to Fire Station No. 4 and the new fire station at the Public Safety Building, Staff, in conjunction with the architect, is working on the solicitation of proposals for construction managers in pursuit of a "Construction Manager at Risk" approach to tackling the two facilities. A pre-proposal meeting was held on October 21, 2014, and proposals are due on November 4, 2014. Staff will provide a recommendation to Council at the December Council meeting. A professional services contract was awarded at the May Council meeting for the design of Sportspark improvements. The proposed improvements include new restrooms and concession facilities, parking lot, four youth softball fields, and lighting upgrades. Staff conducted meetings with the Girls Softball Association to receive their input, and is discussing cost estimates prior to coming back to Council. Architectural and civil design activities are well underway for the basketball pavilion, and the lighting improvements at the detention pond fields and front parking lot are complete. An agreement has been struck with Friendswood Development Company (FDC) for improving access to Lake Friendswood. FDC has agreed to allow access to the lake through the West Ranch Subdivision. Additionally, FDC will build 55 to 60 parking spaces, a restroom/concession pavilion and an automatic gate for controlled access. Following a meeting in June with the landscape architect, a professional services design proposal was resubmitted in late October for improvements at the lake, and Staff met with the developer and architect ' to discuss the overall plan of the park, including the improvements by both parties. A contract has been awarded for the final phases of the Splash Pad and the proposed Rotary Pavilion at Stevenson Park. Separate from those improvements, modeling efforts and final design plans are underway for the bridge crossing Cowards Creek, and Staff continues to work with nearby property owners regarding the 11/03/14 4358 alignment of a trail system to and from the bridge. Surveying and geotechnical services for the Round 1 Street Improvements project are complete and preliminary engineering is currently underway. The Whispering Pines Avenue/Friendswood Link Road Expansion project is currently under construction and the contractor is shifting the traffic lanes to begin paving the first part of November. The intersection of David Glen and Friendswood Link Road will be closed the entire week of Thanksgiving and part of the week following Thanksgiving due to the intersection being constructed during the school break. As part of the five-year Capital Improvement Plan (CIP) for water and sewer, Water Plants No. 2 and 7 are being reconstructed. The reservoirs for both locations have been installed, pumps and control room will be installed in late 2014, and the project will be completed by early 2015. Regarding the Baker Road project, Hackney Road and Stonewall Pass have asphalt placed, Staff is conducting tests to comply with the technical specifications, the Baker Road portion of the project is being excavated, and the entire project should be completed in 2014. City Staff projected the cost of an Inflow\Infiltration Study to be in the $200,000 range in order to properly determine source areas and create a five-year plan for repairs. If Council desires,Staff can start the process to create a Request for Qualification (RFQ) to select a firm to perform the study. Discussion took place between Mayor, Council, and Staff regarding that the Inflow/Infiltration (1&1) Study would determine where the W problems are located throughout the City. Staff could narrow the search down to certain lift stations that are having problems but Staff cannot identify the integrity of the pipe. The I&1 Study would show if taps have come loose in older subdivisions, then narrow the search down by video inspecting in specific neighborhoods to determine the integrity of the pipes. The I&I study can be tailored to how Council would like it done, can have a"do not exceed" clause, look at particular areas, can focus on older subdivisions. The estimated $200,000 for the I&1 Study came from linear feet of pipe, will include video inspecting, smoke testing, and reviewing global positioning system (GPS) maps to find manholes, and could take 90 to 120 days to perform the survey depending on intensity and weather conditions. With concurrence of Council, Mayor Holland moved to Agenda Item 12, City Manager's Report. ' City Manager's Report City Manager Roger Roecker reported that in conjunction with America Recycles Day, the City and Keep Friendswood Beautiful (KFB) are holding the Annual Fall Haul-A-Day, cleanup and garage sale event on Saturday, November 8, 2014, at Centennial Park. This is not an area-wide event, but is presented for the benefit of the citizens of Friendswood. Free paper shredding is once again being sponsored by Copy Dr. from 10 a.m. to 2 p.m. or until the truck is full. There is a 200 pound limit of paper per vehicle. Only non- hazardous items will be accepted. Residents can donate garage sale items to KFB. Garage sale items can be dropped off the morning of the event at Centennial Park. All proceeds from the garage sale will benefit the beautification of City facilities and parks. KFB would like to encourage residents to bring items that would benefit the wildlife rehabbers in Friendswood. They need aquariums (do not have to hold water), dog and cat kennel carriers, clean rags (towels/shirts), and shallow crock bowls. These volunteers take care of the many injured wild animals that make their home in Friendswood's green space. Hazardous waste will not be accepted. The City Manager reported that Wednesday, November 5, 2014, the Friendswood Senior Citizens Program, VFW Post 7109 and Ladies Auxiliary, AT&T Pioneers, and H-E-B will be sponsoring the Fifth Annual Veterans Day Luncheon. The event will be held at Jones Hangar in Leavesley Park. The guest speaker will be Chaco Ramirez, a Prisoner of War (POW) in the Korean War, Congressman Randy Weber and State Representative Greg Bonnen will be present as well. Highlights will include veterans speaking about their military service, patriotic songs, and prayers for those who have served to protect us, and over 17 tables of military memorabilia will be on display. There is no charge and all are welcome to attend. The City Manager reported that the City received positive financial news from Standard & Poor's Ratings ' Services (S&P) who has affirmed their long-term rating of "AA+" for the City's general obligation (GO) bonds. They have also assigned their "AA+" rating to the City's series 2014 GO refunding bonds. The 11/03/14 4359 stable financial outlook assessment reflects S&P's opinion that the City's financial position is strong, and their expectation that the area economy will not change significantly. According to S&P, this rating review reflects their assessment of the City's strong conservative management, very strong reserves, adequate debt burden, and strong economy with access to the Houston metropolitan statistical area. This positive, news is an indication to the taxpayers, of the City of Friendswood's commitment in ensuring the City's long-term financial health. A bond rating, similar to a person's credit score, represents the' creditworthiness of the city's bonds to potential investors. With concurrence of Council, Mayor Holland moved to Agenda Item 24, Consent Agenda. CONSENT AGENDA **Councilmember Scott moved to approve all items on the Consent Agenda as presented: A. Authorizing. Council to invoke Rule 1(A) of the Rules of Procedure to schedule the December City Council meeting for the second Monday, December 8, 2014. B. Approving an excused absence for Councilmember Pat McGinnis for the November 3, 2014, City Council meeting. C. Accepting the September 2014 Property Tax Report. D. Approving the Minutes of the September 8, 22, and 29, 2014, Council Meetings. I Seconded by Councilmember Rockey. The motion was approved 6-0. With concurrence of Council, Mayor Holland moved to Agenda Item 23, Communications from the Mayorl and Councilmembers. i COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS Councilmember Gustafson stated the landscaping work done on the esplanades of FM 2351 looks wonderful and will enhance the City's image. ' Councilmember Scott stated Election Day is tomorrow, one of the greatest things you can do in this country is to go vote or do not complain. I Councilmember Hill stated he agreed with Councilmember Scott's comments. Councilmember Enochs stated he agreed with Councilmember Scott's comments, and complimented Staff on the number of emails that have been received on positive stories which have increased and residents speaking at public forums. Thanked Staff for the great job they continue to do in taking care of the citizens of the City of Friendswood. Councilmember Rockey stated Historween was a great event, lots of participants including Councilmember Gustafson and his family along with Councilmember McGinnis. The second Farmer's Market took place with great weather, most vendors sold out, have had positive feedback, and the Friendswood Animal Advocates were able to get three dogs adopted at the last event. With concurrence of Council, Mayor Holland moved to Agenda Item 6, Closed Executive Session. CLOSED EXECUTIVE SESSION Mayor Holland asked if anyone would like to speak regarding the Executive Session. No one spoke. Council convened into Executive Session in accordance with the Texas Government Code, pursuant to Section 551.071 - Consultation with Attorney regarding pending or contemplated litigation (Wight Realty Interests, Ltd., vs. City of Friendswood) (Horn, et al vs. City of Friendswood) and Section 551.072 - Deliberation regarding real property. (Parkland development; legal advice only regarding potential ' development of real property located within the City of Friendswood) RECONVENE INTO OPEN SESSION 11/03/14 4360 Council reconvened into Open Session with action taken later in the meeting regarding Section 551.072. SPECIAL RECOGNITION AND ACKNOWLEDGEMENTS City of Webster Finance Director Mike Rodgers, representing the Gulf Coast Government Finance Officers Association (GFOA), presented a Certificate of Achievement for Excellence in Financial Reporting for Fiscal Year 2013 to Administrative Services Director Cindy Edge. This is the 26th consecutive year for the City to receive this award. Ms. Edge thanked her Staff and thanked Council for the opportunity to develop Staff, have a highly educated Staff. City Manager Roger Roecker presented the Five Star Spirt Employee Award. The Five Star Spirt Award is awarded each quarter to an employee who has exhibited the five characteristics on which the award is based — Courteous, Competent, Reliable, Professional and Enthusiastic. The recipient for the third quarter of 2014 is Catherine Gray, Stormwater Coordinator/Code Enforcement Officer, who has been with the City since 2009, and is now a two-time recipient of the Five Star Spirit Award, having also been recognized in 2010. Ms. Gray was nominated by a fellow employee who received a call for assistance from a resident. The resident's request was not related to Ms. Gray's normal job duties but rather than taking the easy route and transferring the caller a second time, Ms. Gray went out of her way to get the desired information and provide it to the resident needing assistance. The resident later called back and praised Ms. Gray for her help and for how nice she was while assisting her. With concurrence of Council, Mayor Holland moved to Agenda Item 10, Communications from the Public. COMMUNICATIONS FROM THE PUBLIC David Allen, Friendswood resident, addressed Council and stated he would like to speak on City water, appreciates Comprehensive Annual Financial Report(CAFR) award, shows open government, discussed , fluoride in the water, where we receive the City water from puts fluoride in, passed out a tube of toothpaste for each member of Council, there is a poison warning on it because of the fluoride, need to minimize the amount, is an expense, creates cancer in males, listed other health issues that are caused by fluoride use, discussed letting nature do its duty and take care of trees along FM 2351, do not need a water line, and need to save water. With concurrence of Council, Mayor Holland moved to Agenda Item 9, Joint Public Hearing. JOINT PUBLIC HEARING Mayor Holland and Planning and Zoning Commission Chair Mark McLean called a Joint Public Hearing to order to receive comments from the public, both oral and written, regarding a zone classification change request for a tract of land containing 1.600 acres out of Lot 2, Block 1, Friendswood Subdivision located at FM 2351/West Edgewood Drive, Galveston County, TX, from Business Park (BP) to Single Family Residential (SFR). Planning and Zoning Commission Chair McLean asked if anyone would like to speak in favor of or in opposition of the request. Kim Brizendine, Friendswood resident, stated he appreciates Council and the Planning and Zoning Commission for what they do, two groups that are underappreciated and do a great service for the City of Friendswood, takes time and sacrifice, wishes auditorium was always filled so people could see the dilemmas brought before the groups and how the issues are negotiated, came to speak against the rezone but was wrong, knows intent of the rezoning request, knows the applicants and they are good- hearted, smart people and knows they would only work for the greater good of the community, is in support of the rezoning. Mark Verati, applicant, stated he is a neighbor of Kim Brizendine, and thanked the City of Friendswood for making it such a wonderful place to live, wife and four kids relocated two years ago, looked at all areas 11/03/14 4361 around and chose the City of Friendswood, would like an extended back yard and when the opportunity presented itself he took it. Planning and Zoning Commission Chair McLean adjourned the Planning and Zoning Commission's] portion of the Joint Public Hearing to the Executive Conference Room. Mayor Holland closed Council's i portion of the Joint Public Hearing. With concurrence of Council, Mayor Holland moved to Agenda Item 11, Communications from Committees and Special Reports. COMMUNICATIONS FROM COMMITTEES AND SPECIAL REPORTS Friendswood Historical Society President Ann Whitaker gave the annual report. The Historical Society) continues to make it their mission to preserve and share the history and heritage of Friendswood, museum is open every Saturday except for holidays, and group tours can be scheduled upon request.) The annual Historween event continues to be successful, just completed. the 4th annual event, student' and adult volunteers make it a great Halloween event, and proceeds from the Historween go to the respective clubs of the students who participated. The annual Christmas tree lighting will be held December 2, 2014, at the Frank J. Brown Museum, a community event to start the Christmas season, will have a youth choir for entertainment, gingerbread and wassail will be served. As part of their community service, the Historical Society provides history talks to groups throughout the community for any group interested. The grounds at the museum are a popular site for picture taking, encourages young people to carry out the mission of the Historical Society. Two Girl Scouts are currently working on projects that will earn them their Gold Badge (equivalent to an Eagle Scout). One of the Girl Scouts has a traveling display of historical pictures she will be displaying at different locations throughout the City. The other Girl Scout is working on training docents to get the Perry House open for tours every Saturday. Some of ' the projects that the Historical Society has accomplished over the past year are contracting with a local landscape company who will maintain the grounds at both museums, the garden at the Perry House has been turned over to gardeners at the retirement home on FM 528, provided seeds and tools for the gardeners, and a picnic table has been purchased for the gardeners to use. Projects the Historical Society will be working on for the upcoming year will include repairing the brick walk and put LED lighting in the barn at the Frank J. Brown Museum, replace siding on the Perry House, and hopes to get an irrigation system installed at the Frank J. Brown museum. Mrs. Whitaker thanked the City for their support, and stated without the financial support of the City, the society's work to maintain the museums for future generations would not be possible. Friendswood Chamber of Commerce Treasurer Gerry Stacy gave the annual report and stated the mission of the Chamber of Commerce is to provide opportunity for development, growth, and success within the business community. The Chamber of Commerce's political policy in part states that it is the policy of the Chamber of Commerce to take no action in or participate in no activity that would or could adversely affect the tax exempt status of the Chamber of Commerce. It is the policy of the Chamber of Commerce not to support or oppose any candidate for office, but a candidate, if they are a member of the Chamber, may purchase appropriate venue at a particular function and provide information and campaign materials in a professional manner consistent with the decor expected at the function. The Chamber of Commerce actively partners with the City, promotes the City to residents, businesses, and visitors, and provides answers to people who have questions about the City. Chamber staff routinely answers questions about how to start a business in the City of Friendswood, provides answers to questions regarding schools in the area, a newcomer packet, and the City newsletter. The Chamber also provides venues for the Mayor to communicate with the public, Police Department for emergency management, and the State of the City Address. The Chamber also supports events such as the Fourth of July program and interacts with the public and provides the Chamber's board room for dignitaries to rest inside away from the weather conditions, promotes the City on the Friendswood Chamber of Commerce, website, newsletters, and the annual directory, plans, promotes, prepares, and performs a variety of events that serve the City, the community, and its members. Mr. Stacy introduced the members of the Chamber of Commerce who were present at the meeting such as President Carol Marcantel, Chairman Robert Rinehart, and board member Buzz Crainer. I 11/03/14 4362 With concurrence of Council, Mayor Holland moved to Agenda Item 13, Discussion and possible action regarding approving a contract with Friendswood Historical Society in the amount of $15,000 for the maintenance and preservation of historical sites in the City and authorizing the Mayor to execute the contract. ACTION ITEMS **Councilmember Rockey moved to approve a contract with Friendswood Historical Society for maintenance and preservation of historical sites in the City and authorizing the Mayor to execute the contract and approving the budgeted amount of$15,000. Seconded by Councilmember Gustafson. The motion was approved 6-0. **Councilmember Scott moved to approve a contract with Techline Sports Lighting for the installation of lighting for the tennis, basketball and volleyball courts in Stevenson Park in the amount of$54,800. Seconded by Councilmember Rockey. The motion was approved 6-0. **Councilmember Scott moved to approve a contract with Wilson McLain, Landscape Architect PLLC, for the design of Lake Friendswood Park in the amount of$70,000.
