AN ORDINANCE OF TtiE CITY OF FRIENDSWOOD, TEXAS, MAKING CERTAIN
FINDINGS; SETTING FORTii A PETITION FOR ANNEXATION OF CERTAIN
TERRITORY; SETTIfVG FORTH THE RESULTS OF A PUQLIC HEARING;
EXTENDING THE CITY LIMITS OF THE CITY OF FRIENDSWOOD, TEXAS,
TO INCLUDE ALL LANDS �NU AREA WITHIN CERTAIN LIMITS AND
BOUNDARIES AND ANNEXING TO THE CITY OF FRIENDSWOOD ALL OF
THE AREA WITHIN SUCH LIMITS AND BQ�NDARIES; PROVIDING THE
PASSAGE OF THIS ORDINANCE SHALL NOT IMPAIR OR AFFECT ANY OTHER
ANNEXATION ORDINANCE WHETHER PASSED ON ONE OR MORE READINGS
ANU IVOT YET PASSED ON FINAL READING; PROVIUING A SAVING AND
SEVERABILITY CLAUSE.
WHEREAS, a petition for annexation has been presented to the Mayor
and City Council of the City of Friendswood} Texas; and
WHEREAS, a public notice was given in the Friendswood News on
Thursday, October 26y 1972, the Friendswood News being a newspaper of general
circulation in the City of Friendswoods Texas, and
WHEREAS, an affidavit evidencing the pub1ication of said notice is
made a part of this Ordinance along with a copy of� the petition for annexation:
METES AND BOUNDS
BEING a 6350.07 acres more or less located wholly within Galveston
County, Texas, which lies adjacent to the present City Limits of the City of
Friendswood= Texas, said 6350,07 acres being more particularly described by
metes and bounds as follows to wit;
BEGINNING at the intersection of the Galveston-Harris County lineA
which is the center line of Clear Creek, and the Southeasterly line of Sloanes
2nd Subdivision in the John Dickinson Survey Abstract 9 for corner;
THENCE Southwesterly along the Southeasterly boundary line of the
said Sloanes 2nd Subdivision to the intersection of the South 1ine of the John
Dickinson Survey Abstract 9, same being in the North line of the I.& G.N.R.R.
Survey Abstract 614, for a corner;
THENCE Westerly along the South line of the John Dickinson Survey

TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS
We, the undersigned persons who voted for annexation, each
being an inhabitant of the territory hereinafter described by metes
and bounds, and being a majority of the qua1ified voters residing in
such territory, acting pursuant to the provisions of Article 970a,
Vernon's Texas Civil Statutes, as amended, respectively petition your
Honorable Body to annex the territory herein described to the City of
Friendswood, Texas. In support of this petition, the undersigned
persons who voted for annexation would respectfully show the following:

That the territory to be annexed is situated wholly within
Galveston County, Texas, adjoins and is adjacent to the City of Friends-
wood, is not more than one mile in width from the existing corporate
boundaries of the City of Friendswood and is described by metes and
bounds as follows:

within the City limits , or the extraterritorial jurisdiction,
as that term is used in Article 970a, Clernon' s Texas Civil
Statutes, of any ir�corporated city , town or village except
�� the City of Friendswood, �Texas, and all of. said territory ,
may be properly annexed to the City of Friendswood.

That each inhabitant, resident and qualified voter
in the territory hereiz� described was given an opportunity
to express his choice and vote on the, question of the
. annexation of such territory to the City of Friendswood, -
Texas , by affixing his signature under the appropriate
column at the end of this petition.

AND WHEREAS, on the 6th day of November, 1972 , at
7: 30 p.m. in the City Hall of the City of Friendswood, Texas,
a public hearing was duly held, according to the published notice,
affording the opportunity for several interested persons to appear
before the City Council of Friendswood, Texas to present evidence
in regard to the feasibility and practicability of the annexation
of such territory to the City; and,
WHEREAS, the hearing was completed and every person
who desired to be heard was given a full opportunity to present
evidence on the advantages or disadvantages of such annexation; and
WHEREAS, the City Council finds that all prerequisites
of the law regarding notice and hearing of the proposed annexation
have been complied with; and,
WHEREAS, the City Council finds that the territory described
in the aforementioned legal notice, and hereafter, lies wholly
within the extraterritorial jurisdiction of the City of Friendswood
and is within the extraterritorial jurisdiction of no other
municipality and further that such territory is contiguous and
adjacent to the city limits of the City of Friendswood; and,
WHEREAS, the necessary Ordinance or Ordinances have been
prepared to complete the annexation proceedings, now therefore:
BE IT ORDAINED BY TIiE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
Section l. That the boundaries and limits of the City
of Friendswood are hereby extended so as to embrace and include

Section 2, This ordinance shall not repeal � impairs modify or
in anywise affect any other ordinance annexing territory to the City of
Friendswood, or any other ordinance heretofore passed on one or more
readings and not yet passed on final reading annexing any territory to
the City of Friendswood, but such other ordinance or ordinances shall remain
and continue to be effective to their intent and purpose as therein stated
wholly unaffected in any way or manner by the passage of this ordinance.
This ordinance shall not in anywise be impaired or affected by any other
ordinance heretofore introduced or passed on any reading� whether final
or not; nor shall it be affected by any other ordinance which may there-
after be introduced or passed on one or more readingsb pending the final
passage of this ordinance; and this ordinance shall be effective to its
intent and purpose as hereinabove stated, wholly unaffected by any other
annexation ordinance introduced and passed or hereafter introduced and
passed on any reading� whether final or not final , annexing territory to
the City of Friendswood, and wholly unaffected by any ordinance h�retofore
or hereafter passed calling a hearing and giving notice relative to the
institution of any annexation proceeding. The procedure initiated hereby
and the annexation proceedings instituted hereunder shall be independent
of any other proposed and pending annexation of such territory and such
other proceedings shall not be affected hereby.
Section 3. If any sectionp or part of this ordinance shall be held
unconstitutional � illegal or invalidy or the application thereof ineffective
or inapplicable as to any territory� such unconstitutionalityx illegality,
invalidity or ineffectiveness of such section or part shall in no wise
affect, impair or invalidate the remaining portion or portions thereof,
but as to such remaining portion or portions� the same shall be and remain
in full force and effect; and should this ordinance for any reason be
ineffective as to any part of the area hereby annexed to the City of
Friendswood, such ineffectiveness of this ordinance as to any such part
or parts, of any such area shall not affect the effectiveness of this
ordinance as to all of the remainder of such area, and the City Council

Dear Mayor Lowe:
Attached are copies of the annexation petition describing parcel 1 of
the public hearing notice published by the city October 31, 1972. They
contain 1�+0 signatures, more or less (with 7 abstentions not noted),
and represents the majority of residents in the described area. The
signatures are primarily from the Sunsneadow and Tower Estates sub-
divisions. Not every area resident reviewed the petition; however,
attempts were made to contact them.
Al1 petitioners herein favor annexation by Friendswood rather than
incorporation into the Village of Sunmeadow; all are strongly opposed
to annexation by League City. The position taken by petitioners does
not imply annexation by Friendswood at any price, but in return for
.. financial and moral support by area residents that: _
a. Dual taxation wi11 not result, umbrella concept or otherwise.
b. The assets and liabilities of the Sunmeadow Municiple Utility
District will be absorbed by the City of Friendswood in a timely manner
and
c. Ful1 city services enjoyed by current Friendswood residents
wi11 be extended to the annexed area as soon as practical, within sound
planning guidelines and schedules.

hereby declares it to be its purpose to annex to the City of Friendswood
every part of the area described in Section 1 of this ordinancey regardless
of whether any other part of such described area is hereby effectively
annexed to the City. Provided further, that if there is included in the
general description of territory set out in Section 1 of this ordinance
to be hereby annexed to the City of Friendswood any lands or area which
are already a part of and included within the general limits of the City
of Friendswood, or which are presently part of and included in the
limits of any other city9 town or village, or which are not within the
City of Friendswood jurisdiction to annex, the same is hereby excluded
and excepted from the territory to be annexed hereby as fully as if
such excluded and excepted area were especially described herein.
