ORDINANCE NO.2014-15 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2013-37, PASSED AND APPROVED OCTOBER 79 2013, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2013-2014 BY APPROVING "BUDGET AMENDMENT X" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2013- 2014"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2013-37, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2013-2014'; and WHEREAS,the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2013-2014; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2013-2014," is hereby amended for municipal purposes as shown on "Budget Amendment X" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2013-2014" attached hereto. Said Budget Amendment X shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A"and "B" and made a part hereof for all purposes. Section 3. In the event any clause,phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Library Book Donation Appropriation, $1,110. Appropriate funds donated to the Library. The funds will be used to purchase books in fiscal year 2014. Donations were received from December 2013 through June 2014. 2. Library Book Sales Revenue Appropriation, $5,732. Appropriate Library book sale revenue funds to the Library department's operating budget. The revenue comes from the sale of books. The funds will be appropriated in the Library operating budget and will be used for operating supplies and equipment purchases in fiscal year 2014. 3. Community Service Event $2,280. Appropriate revenues collected from the Valentine's Daddy/Daughter Dance held on February 22, 2014. The event was hosted by the Community Services Recreation division at the Leavesley Park Hanger. The funds will reimburse the Recreation community events account for the expenditures related to the dance. 4. Community Services July 4th Program Division. $6,976. Appropriate revenues from the sale of wristbands at the July 4 event to offset expenses incurred for the event. 5. Stevenson Park Pool Heating, $1,406. Appropriate funds received from the Houston Cougar Aquatic Sports for reimbursement of expenses incurred by the City for heating the pool during winter month swim practices. Funds will be appropriated to the Community Services Stevenson Park Pool division natural gas account. As per agreement, the swim team(s) will be responsible for the natural gas expenses associated with their utilization of the pool facility. 6. Splash Pad Improvements. $77,687. Appropriate advance funding for final phase of the Splash Pad improvements at Stevenson Park. At the June 2, 2014 Council meeting, Council approved the co-op purchasing agreement through the Texas Buy board, to Fun Abounds. The final phase of improvements to the Splash Pad will add an additional 1,450 square feet to the existing splash pad. Advanced funding will come from the Park Land Dedication Funds and will be reimbursed when the bonds authorized in 2013 are issued. 7. Police Investigation Fund Revenue, $1,020. Appropriate asset forfeiture funds received. Funds will be appropriated to the Police Investigation Fund (PIF) operating services account. 2014 BA X-Exhibit A 07-14-14 Exhibit A Page 2 8. Police Department JAG Grant. $14,775. Appropriate grant reimbursement received from Edward Byrne Memorial Justice Assistance Grant (JAG) Program. The City was awarded grant funds to reimburse the City for purchasing an Interview Recording System for the Criminal Investigations Division. The system will replace the existing system that is out dated and inoperable. Funds were used from the Patrol division capital equipment account in the general fund to purchase the equipment. The reimbursement will be appropriated back to the Patrol division capital equipment account in the general fund. 9. Police Department Reimbursement, $1,509. Appropriate funds received from Houston High Intensity Drug Trafficking Area (HIDTA) to the Police Department. The City has a Memorandum of Understanding with the agency for reimbursement for expenses spent on Drug Task Force activities. The reimbursement is for activities through the month of March 2014. The funds will be appropriated to the Police Department Patrol division. 10.Baker Road Rehabilitation. $71,059. Appropriate funds for the Baker Road Rehabilitation project. Currently the road and subgrade is beyond repairable and needs to be replaced. The July 14, 2014 Council Meeting agenda includes a recommendation to approve a contract with Metro City to complete the project. The total cost of the contract is $571,059. Funds in the amount of$500,000 are included in the FYI adopted budget designated for street maintenance will be used for the project.
