ORDINANCE NO. 2014-12 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2013-37, PASSED AND APPROVED OCTOBER 7, 2013, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2013-2014 BY APPROVING "BUDGET AMENDMENT VIII" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2013- 2014"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2013-37, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2013-2014'; and WHEREAS,the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2013-2014; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2013-2014," is hereby amended for municipal purposes as shown on "Budget Amendment VIII"to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2013-2014" attached hereto. Said Budget Amendment VIII shall be attached to and made apart of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and `B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Public Works Insurance Reimbursement, $4,063. Appropriate insurance reimbursement received for vehicle damage claims to Public Works vehicle unit PW40. Funds will be appropriated to the Public Works water operations division budget to offset the vehicle repair expenses. Reimbursement was received from Texas Municipal League on April 10, 2014 2. Police Investigation Fund Revenue, $5,195. Appropriate asset forfeiture funds received. Funds will be appropriated from the undesignated Police Investigation Fund balance to the Police Investigation Fund (PIF) operating services account. 3. Police Department Reimbursement, $3,370. Appropriate funds received from HIDTA to the Police Department. The City has a Memorandum of Understanding with the agency for reimbursement for expenses spent on Drug Task Force activities. The reimbursement is for activities through the month of February 2014. The funds will be appropriated to the Police Department Patrol division. 4. Community Service Keep Friendswood Beautiful donations, $1,032. Appropriate revenue collected by the Keep Friendswood Beautiful (KFB) at its 2014 Spring Sparkle Garage Sale and Fig Festival. Funds received will be used by KFB to purchase operating supplies during Fiscal Year 2014. 5. Community Service Parks Operations, $2,551. Appropriate revenue collected from the sale of scrap metal accumulated by Parks Division. Funds will be used to purchase materials to construct additional storage space to be located at the Community Services Parks building. 6. Stevenson Park Pool Heating, $1,719. Appropriate funds received from the Sharks Swim Team for reimbursement of expenses incurred by the City for heating the pool during winter month swim practices. Funds will be appropriated to the Community Services Stevenson Park Pool division natural gas account. As per agreement, the swim team(s) will be responsible for the natural gas expenses associated with their utilization of the pool facility. 7. Deputy Director of Public Works, $72,836. Transfer to reallocate funding from the existing personnel budget in the Community Development Department Capital Improvements Administration division to the Public Works Administration divisions. The transfer will align budgeted personnel funding with budgeted expenditures related to the new reporting structure of the Deputy Director position in Public Works with 40% being General Fund supported and 60% being Water and Sewer Fund supported. Net impact of this transfer to the FY 14 adopted budget is zero. Ord 2014-12 Exhibit A Exhibit A Page 2 8. Fire Station #4 Expansion and New Fire Station Architectural Design, $451,453. Appropriate funds for architectural design services related to the 2013 Bond Election approved fire station capital improvements which include expansion of the existing Fire Station #4 and construction of a new fire station to be located adjacent to the City's Public Safety Building. The May 5, 2014 Council Meeting agenda includes a recommendation to approve a professional services contract with Joiner Partnership, Inc. to complete the architectural design phase of the project. Pursuant to the Reimbursement Resolution #R2014-07 approved by City Council on March 3, 2014, funds for the architectural design contract will be appropriated from undesignated General Fund balance and reimbursed when the bonds authorized in 2013 are issued. 9. Whispering Pines/Friendswood Link Road Phase II Right-of-Way Title Report, $1,000. Appropriate undesignated General Fund balance to obtain a title report of right-of-way (ROW) property related to the Whispering Pines/Friendswood Link Road Phase II pavement improvement construction project. The City has been awarded General Land Office/Community Development Block Grant (CDBG) funds for the majority of the pavement improvement project. The City will receive the funds on a reimbursement basis for project expenditures incurred. 10.Whispering Pines/Friendswood Link Road Phase II Paving Improvements Construction, $4,705,838. Appropriate funds related to the construction contract for the pavement improvements project. The City Council meeting agenda for May 5, 2014 includes a recommendation to approve a construction contract as follows: • David Wight Construction Company - $4,576,751.50 • Terracon - $60,434.00 (materials testing) • Contingency funds of 1.5% - $68,652.00 In 2011, Community Development Block Grant Disaster Recovery funding was allocated for this project by the General Land Office (GLO). The award was in the amount of$4,509,549. Of that, the following allocations were made: • Engineering Services by HDR, Inc. - $453,272 (TX General Land Office contracted directly for engineering services) • Administrative Services by the Riveron Law Firm - $225,000 (TX General Land Office contracted directly for administrative services) • Environmental Services - $9,000 (TX General Land Office contracted directly for environmental services) • Construction - $3,822,277 remains available Therefore, an appropriation of$500,807 from the General Fund Balance (above 90-day reserve) and $382,754 from the Water & Sewer Fund Working Capital (above 90-day reserve is needed). Appropriate funds for Job Order Contracting (JOC) services related to the 2013 Bond Election approved Sportspark improvements which include construction of two new youth softball fields, updated field lighting and two new restroom/concession buildings. Total estimated cost of the project is $1,718,000. The May 5, 2014 Council Meeting agenda includes a recommendation to approve a professional services JOC with Jamail & Smith Construction for project design engineering in the amount of$125,820. Pursuant to the Reimbursement Resolution #R2014-07 approved by City Council on March 3, 2014, funds for the design contract will be appropriated from undesignated General Fund balance and reimbursed when the bonds authorized in 2013 are issued. 12.Centennial Park Basketball Pavilion Architectural Design, $33,000. Appropriate funds for design services related to the 2013 Bond Election approved Centennial Park improvements which include construction of a new basketball pavilion to be located at the front of the Park adjacent to the Evelyn B. Newman Amphitheater. Total estimated cost of the project is $750,000. The May 5, 2014 Council Meeting agenda includes a recommendation to approve a professional services contract in the amount of$33,000 with Hall, Barnum, Lucchesi for architectural design of the project. Pursuant to the Reimbursement Resolution #R2014-07 approved by City Council on March 3, 2014, funds for the architectural design contract will be appropriated from undesignated General Fund balance and reimbursed when the bonds authorized in 2013 are issued.
