' .. , .�.. ,._, , ' . . . . , , . - ORDINANCE NO. 9 9—3 AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY REVISING THE OFFICIAL ZONING MAP OF THE CITY OF FRIENDSWOOD TEXAS BY DESIGNATING CERTAIN ROADS WITHIN THE CITY LIMITS AS ENTRYWAY OVERLAY DISTRICTS IN ACCORDANCE WITH SECTION 3 AND SECTION 7.R OF THE ZONING ORDINANCE; AMENDING SECTION 7.R, ENTRYWAY OVERLAY DISTRICT BY ADDING AND CLARIFYING STANDARDS FOR COMMERCIAL DEVELOPMENT; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning Ordinance of the City, shall be and is hereby revised and amended to show the designation of the following described streets within the municipal corporate boundaries of the City of Friendswood, Texas, for a distance of a minimum of 200 feet from the street right-of-way or the rear of the property having frontage, whichever is less, in accordance with Section 7.R of the Zoning Ordinance as Entryway Overlay District: State Farm-to-Market Road 528; State Farm-to-Market Road 2351; State Farm-to-Market Road 518 north of State Farm-to-Market Road 2351• and State Farm-to-Market Road 518 south of State Farm-to-Market Road 528• such roadways being shown on the attached Exhibit "A" which is attached hereto and incorporated herein by reference, and being measured in depth as described above. ' The provisions of Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning Ordinance of the City, Ordinance No. 84-15, originally adopted the 19th day of November, 1984, Section 7.R., shall apply to such above described property after the effective date of this Ordinance in addition to other applicable regulations contained within the Zoning Ordinance, or other city ordinances. The underlying zoning classification of such property shall not be amended, altered, changed or otherwise affected by this Ordinance. Section 2. Appendix C of the Friendswood City Code, same being city of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by insert the words and enhance into the first sentence of paragraph 1 of subsection R of Section 7 thereof, after the words"is intended to preserve." Section 3. Appendix C of the Friendswood City Code, same being city of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by deleting the first sentence of paragraph 6 of subsection R of Section 7 thereof which reads as follows: [6. Screenin�. The following uses shall be screened to a height sufficient to completely screen the use from view at ground level:] and substituting therefor the following: 6. Screenin�. The following uses when located at front and sides of the main structure on the site shall be screened to a height sufficient to completelv screen the use from view at�round level: Section 4. ' 1984, and being the Zoning Ordinance of the City, is hereby further amended by deleting the second note of paragraph 6 of subsection R of Section 7 thereof which reads as follows: [**Berms used for any type of screening will be limited to a height of three feet(3') and must be landscaped.] and substituting therefor the following: **Berms used for anv type of screening will be limited to a height of three feet (3') above finished ra� de at property line (not includin� detention facilitiesl and must be landsca e�d., Section 5. Appendix C of the Friendswood City Code, same being city of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by deleting paragraph 7 of subsection R of Section 7 thereof which reads as follows: [7. Utilities. All on-site utilities shall be located underground, at owner's expense, unless required by the utility company to be otherwise located. This requirement does not apply to electrical transmission or distribution lines.] and substituting therefor the following: 7. Utilities. All permanent utilities servin� the property shall be located under�round, at owner's expense, unless required by the utilitv companv to be otherwise located. Section 6. Appendix C of the Friendswood City Code, same being city of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by deleting the current subparagraph b of paragraph 8 of subsection R of Section 7 thereof which reads as follows: [b. One tree shall be required for every twenty-five feet (25'), or portion thereof, of frontage. For example, a lot sixty-five feet (65') wide would require three trees. One-half of the required trees must have a minimum caliper of four inches (4"); the remaining one-half must have a minimum caliper of two inches(2").] Enhyway Oveday District AmendAl/OS/99 3 Section 7 Appendix C of the Friendswood City Code, same being city of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by deleting the current language in subparagraph a of paragraph 9 of subsection R of Section 7 thereof which provides as follows: [a. Commercial: l. The design of retaining walls and other architectural elements used to screen outdoor storage areas, dumpsters, vehicles, etc., shall incorporate harmonious colors, materials, and textures so as to be compatible with the design and architecture of the main building on the lot. 2. Structures within the EOD shall be of a construction compatible with the characteristics and heritage of the City of Friendswood. Exterior walls must be masonry or wood.] and substituting therefor the following: a. Commercial: 1. Commercial developments must have facades of wood, brick, masonry, stone, stucco, �lass, or architectural metals such as co�per or bronze. 2. The desi�n of walls and other structures located on the same site. includin� those used to screen outdoor stora�e areas, dumpsters, vehicles etc. shall be constructed of the same materials as the main buildin�on the lot. 3. Provided however, that in the case of both subpara�raphs 1. and 2, above, an anplicant ma�present to the Commission and Council on the site plan, specifications, which shall include elevation drawing� of p�osed alternative materials, which meet or exceed the a�pearance and durabili requirements above. Section 8. Except as otherwise herein expressly amended, all other provisions of Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being Entryway Overlay District Amend.Ol/OS/99 4 . . , • , _. ,.� , . - the Zoning Ordinance of the City, Ordinance No. 84-15, originally adopted the 19th day of November, 1984, as it may have been previously amended, remain unchanged and in full force and effect. Section 9. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 10. In the event any clause phrase,provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts.
